3. INTRODUCTION
●Naina Sahni was a worker in the congress party and her husband Sushil Sharma a Congress youth leader and member
of the legislative assembly.
●Sushil suspected Naina of having an extramarital relationship with Matloob Karim, Naina classmate and fellow
Congress workers.
●On the night of 2 July 1995, Sushil came home to their house in Delhi and saw Naina talking on the phone with
Matloob and consuming alcohol. Enraged, he fatally shot Naina.
● Sharma then chopped off her body into pieces and stuffed it in a 'tandoor' on the roof of a popular restaurant, Bagiya
Restaurant, which was managed by his friend.
●Police arrested Keshav Kumar but Sharma managed to flee. He surrendered on 10 July 1995 in Bangalore.
●On 7 November 2003, Sushil Sharma was sentenced to death and restaurant manager, Keshav Kumar, was given seven
years rigorous imprisonment
●On 21 December 2018, Delhi High Court ordered immediate release of Sushil Sharma

5. EVALUATION OF BALLISTIC EVIDENCES
●Dr. Sarangi the investigating agency conducted post- mortem again on 12-07-1995.
●According to second post mortem examination conducted by 3 surgeons revealed presence of metallic piece in skull
and one in neck region of dead body on subjecting to X-ray examination.
●As per the 2nd post mortem examination the cause death was due to coma consequent upon firearm injury on head.
●Bullets recovered from the body (after 2nd postmortem), fired cartridge cases and one led bullet ( recovered from flat),
live cartridges and arminus revolver recorded from the possession of accused Sushil Sharma at Bangalore where sent
to central forensic science laboratory for examination by ballistic expert.
●On examining the above mentioned evidence, expert stated that, Arminus revolver was a firearm and was in working
condition and had been fired through.
●Expert also stated that the 5 cartridges cases and one lead bullet had been fired from said licensed Arminus .32”
revolver.
●Expert also opined on plywood that was seized from flat that hole observed on plywood could also have being caused
by led bullet.

6. CONCLUSION
●On 27 July 1995, The Delhi Police filed a charge sheet in a Sessions Court.
●On 7 November 2003, Sushil Sharma was sentenced to death and restaurant manager, Keshav Kumar, was given seven
years rigorous imprisonment by the trial court.
●On February 19, 2007, the trial court’s decision was upheld by the Delhi high court.
●In October 8,2013, the Supreme Court commuted his death sentence to life imprisonment.
●On 21 December 2018, Delhi High Court ordered immediate release of Sushil Sharma.
●The 'Tandoor Murder Case' became one of the landmark cases in India in which DNA evidence and a second autopsy
were used to establish guilt.
●Maxwell Pereira, who headed the team that investigated the tandoor murder case of Delhi, wrote a book on this case
titled "The tandoor murder - the crime that shook a nation and brought a government to its knees"

7. POINT OF VIEW
1.This was a clear instance of homicide in which a wife was slain by her husband in a rage after he suspected her of
having an affair.
2.Forensic science defines “application of science to those criminal and civil law that are enforced by police agencies in
criminal justice system. Thus the role of forensic science in criminal justice system is highly critical, but often
underrated.
3.The mentioned case remains one the most sensational case in CJS.
4.The mystery is not but fact that it took long stretch of time to come up with judgement.
5.Sharma had doubts about his wife's character, which was the motivation for the crime. The legal difficulty was that the
case was built on the basis of circumstantial evidence (DNA) and a second autopsy. The findings of the ballistic
experts, who established that the five cartridge cases and one lead bullet recovered from the flat at Mandir Marg, as
well as the two lead bullets extracted from the deceased's skull and neck, were fired from the Arminus revolver
recovered from the accused's possession, changed the direction of the case.
6.The accused was found guilty solely on the basis of these facts.
7.The case, however, took almost a decade to reach a suitable conclusion. The issue that arises in people's thoughts is,
"Why would such a case take such a long time to decide?"
