Republic Act No. 9048 AN ACT AUTHORIZING THE CITY OR MUNICIPAL CIVIL REGISTRAR OR THE CONSUL GENERAL TO CORRECT A CLERICAL OR TYPOGRAPHICAL ERROR IN AN ENTRY AND/OR CHANGE OF FIRST NAME OR NICKNAME IN THE CIVIL REGISTER WITHOUT NEED OF JUDICIAL ORDER, AMENDING FOR THIS PURPOSE ARTICLES 376 AND 412 OF THE CIVIL CODE OF THE PHILIPPINES.

What are the Common Problems? A. Wrong Spelling in the First Name B. A Different Name is Being Used C. Other Clerical Errors D. Wrong Gender/Sex E. Wrong Month and Day in the Date of Birth F. Last Name is the Surname of the Mother G. No birth record exists

A. Wrong Spelling in the First Name Examples: “Mary Anne” was entered as “Mary Ann” “ Baibee ” was entered as “Baby”

B. A Different Name has been used A different first name has been habitually and continuously used and has been publicly known with that first name in the community

C. Other Clerical Errors Examples: Date of birth was entered as “February 30, 2012” Date of birth registration was earlier (January 2, 2013) than date of birth Dec 25, 2013)

C. Other Clerical Errors Examples: Age of mother was entered as “92” Middle name and last name were interchanged

REPUBLIC ACT NO. 10172 An Act Further Authorizing the City or Municipal Civil Registrar or the Consul General to Correct Clerical or Typographical Errors in the Day and Month in the Date of Birth or Sex of a Person Appearing in the Civil Register Without Need of a Judicial Order, Amending for this Purpose Act Numbered Ninety Forty-Eight

D. Wrong Gender/Sex Examples from “Male” to “Female” from “Female” to “Male”

E. Wrong Month and Day in the date of birth Examples from “January 6, 1954” to “January 16, 1954” from “August 18, 1985” to “October 18, 198 5” Solution: Correction can be made thru filing of petition under RA 10172

REPUBLIC ACT 9255 An Act Allowing Illegitimate Children to Use the Surname of their Father. Illegitimate children born on August 3, 1988 to March 18, 2004 may still be acknowledge by the father through an Affidavit of Admission of Paternity (AAP) or Private Handwritten instrument (PH).

D. Last Name Used is the Surname of the Mother The surname of a child is the same as the surname of his mother in the following cases: father of the child is unknown (not indicated in the birth document) Solution: Child can use the surname of his father if the father acknowledges the child either thru legitimation or RA 9255

Last Name Used is the Surname of the Mother b) Father of the child is known (indicated in the birth document) but the child was born after the implementation of the Family Code (Aug 1988) and before the implementation of RA 9255 (March 19, 2004) Solution: Child can use the surname of his father either thru Legitimation or thru court

G. No birth record exists a) No record exists at PSA database but birth record exists at the Local Civil Registrar Office Solution: Request for endorsement of the birth record by the LCR to the nearest PSA CRS Outlet. The document will be endorsed electronically .

G. No birth record exists b) No birth record exists at PSA database and Local Civil Registry Office Solution: Apply for delayed registration of birth at the place of birth or thru out-of-town reporting

Example 1 RA 9048 (Clerical Error) REMARKS: Child’s first name JUVENTINA is hereby corrected to JOVENTINA pursuant to Petition No. CCE -0034-2008 by MCR on August 27, 2008 and affirmed by CRG and affirmed by CRG on September 23, 2008 pursuant to RA 9048 Certified Correct: Name/Signature Position

Example 2 Legitimation REMARKS: LEGITIMATED BY SUBSEQUENT MARRIAGE OF PARENTS Joselito S. Alulod and Gengelaine S. Zorro on February 22, 2012 at Sta. Mesa, Manila under Registry No. 2012-46. Certified Correct: Name/Signature Position

Example 3 RA 9255 REMARKS: Acknowledge by JIMMY RAMOS BAYAN on 01 February 2017 under Registry No. 2017-330. The child shall be known as “NATHASHA LOUIES CARABUENA BAYAN” pursuant to RA 9255. Certified Correct: Name/Signature Position
