DEPED ORDER NO.40,2012 Child Protection Policy The DepEd shall ensure that schools are a safe place for the education of children. The best interest of the child shall be the paramount consideration in all decisions and actions involving children. This is a zero- tolerance policy for any act of child abuse, exploitation, violence, discrimination, bullying and other related offenses.

WHO IS A CHILD? Any person below eighteen (18) years of age, Above 18 but unable to fully take care of or protect themselves because of physical or mental disability or condition. Pupils or students who may be eighteen (18) years of age or older but are in school.

CHILD ABUSE Refers to maltreatment of a child, whether habitual or not, which include any of the following: 1. Psychological or physical abuse , neglect, cruelty, sexual abuse and emotional maltreatment; deeds or words which debases, degrades or intrinsic worth and dignity of a child as a human 2. CHILD ABUSE Unreasonable deprivation of the child’s basic needs for survival, such as food and shelter; Failure to immediately give medical treatment to an injured child resulting in serious impairment CHILD PROTECTION POLICY DepEd DO No. 40, s.2012

DISCRIMINATION Refers to any act of exclusion , distinction , restriction or preference which is based on: - Age - Origin - Sex - Language - Religion - Sexual Orientation - Political - Social - Birth, Disability - AIDS - CICL - Being pregnant CHILD PROTECTION POLICY DepEd DO No. 40, s.2012

CHILD EXPLOITATION Refers to use of children for someone else’s advantage, gratification or profit resulting in an unjust, cruel and harmful treatment of the child. SEXUAL EXPLOITATION – refers to the abuse of a position of vulnerability, power, and trust, for sexual purpose. ECONOMIC EXPLOITATION – use of the child in work or other activities, for gain or profit. CHILD PROTECTION POLICY DepEd DO No. 40, s.2012

VIOLENCE AGAINST CHILDREN COMMITTED IN SCHOOLS An act or series of acts committed by School Administrator or Academic and Non- Academic Personnel , including but not limited to the following: Physical Violence Sexual Violence Psychological Violence Other acts of violence similar in nature CHILD PROTECTION POLICY DepEd DO No. 40, s.2012

BULLYING OR PEER ABUSE (DO 55, s. 2013) BULLYING – is committed when a student commits a willful aggressive act or series of acts directed towards another student or several students in a school setting or place of learning which results in the physical or mental abuse, harassment, intimidation, or humiliation of the victim. (e.g. threats, stalking, public humiliation, etc. ) CYBER- BULLYING – is any conduct of bullying which results in harassment, intimidation, or humiliation, through electronic means or other technology. CORPORAL PUNISHMENT Refers to a kind of punishment or penalty imposed for an alleged or actual offense, which is inflicted, for the purpose of discipline/control , by a teacher , school administrator , an adult , or any other child given authority for discipline. CORPORAL PUNISHMENT Beating, Kicking, Hitting, Slapping, Lashing, any part of a child’s body, with or without use of an instrument; Striking of a child’s face or head – “no contact zone” Pulling hair, Shaking, Twisting Joints, Piercing Skin, Dragging, Pushing a Child; Forcing a child to perform physically painful or damaging acts – holding weights/kneeling for an extended period; Deprivation of a child’s physical needs as a form of punishment. CHILD PROTECTION COMMITTEE ALL PUBLIC & PRIVATE elementary and secondary school shall establish a Child Protection Committee. CHILD PROTECTION COMMITTEE FUNCTIONS OF CPC, including but not limited to : Draft a school child protection policy with a code of conduct; reviewable every three (3) years. Initiate information dissemination programs Develop and implement school- based referral and monitoring system. Identify, refer and, if appropriate, report to the appropriate offices cases of child abuse, exploitation, violence, and bullying. ADMINISTRATIVE MEASURES DISCIPLINARY Protective & Remedial Measure to Address Corporal Punishment & Other Acts of Violence by School Personnel Conduct of investigation & reporting of cases SH/SDS shall forward the complaint to disciplining authority within 48 hours Disciplining authority shall conduct a fact-finding investigation within 72 hours of report Disciplining authority shall impose administrative sanctions

IRR OF ANTI- BULLYING ACT

D. O. 55, s. 2013 (IRR Anti- Bullying Act of 2013) Any severe or repeated use by one or more students of a written, verbal or electronic expression, or a physical act of gesture, or an combination thereof, directed at another student that has the effect of placing the latter in reasonable fear of or emotional harm or damage to his actually physical property. Based on the RA 10627: Anti- Bullying Act of 2013

ANTI-BULLYING POLICIES ALL PUBLIC AND PRIVATE kindergarten, elementary and secondary schools shall adopt policies to address the existence of bullying in their respective institutions. Such policies shall be regularly updated and, at a minimum, shall include provisions on prohibited acts, prevention and intervention programs, mechanisms and procedures. PREVENTION AND INTERVENTION PROGRAMS SCHOOL- WIDE INITIATIVES – to existence of a positive school climate ensure the and environment conducive to learning. (e.g. activities for students and school personnel on how to recognize and address bullying) CLASSROOM- LEVEL INITIATIVES – reinforcing school- wide rules pertaining to bullying, teaching positive behavior, providing an inclusive and caring learning environment. PROCEDURE IN HANDLING BULLYING INCIDENTS IMMEDIATE RESPONSE: 1. School Personnel shall immediately separate and stop the bullying or retaliation; Remove from the site the victim and/or offender; Ensure the victim’s safety – address immediate safety or medical needs Bring the offender to the Guidance Officer ANTI- BULLYING ACT DepEd DO No. 55, s.2013

PROCEDURE : REPORTING OF BULLYING Report to Teacher/ Guidance Counselor INCIDENT Report to School Head shall inform the parents of both victim and offender School Head Designated Personnel INTAKE SHEET in DO 40 Fact- Finding & Documentation Separately interview the victim and offender. Determine level of threat and develop intervention strategies Inform the parents of the incident School Head shall inform the parents of both victim and offender Offender to be referred to CPC ANTI- BULLYING ACT DepEd DO No. 55, s.2013

Incident Management Intervention The CPC determine shall the appropriate intervention programs for the victim, the bully and bystanders. Referral The SH or the CPC may refer the victims and the bully to trained professionals outside the school For possible criminal charges against the bully or offending student, the designated school personnel shall notify the Women and Children’s Protection Desk (WPCD) of the local Philippine National Police.
