Issues faced by the Sangguniang Bayan of Mlang in relation to its authority to enact a Zoning Ordinance

ZONING ORDINANCE A legal instrument for implementing the land use plan. .. A rule that defines how a property in specific geographic zones can be used. May also regulate development through imposition of building heights, bulk, open spaces, density, etc. The purpose is to separate residential property use from commercial and industrial property use.

1. RESOLUTION NO. 839–2022, ENTITLED: ENACTING ORDINANCE NO. 2022-06 ENTITLED: DECLARING AND RECLASSIFYING ALL 100-METER STRIP ALONG THE NATIONAL HIGHWAY OF THE MUNICIPALITY OF MLANG, PROVINCE OF COTABATO AS COMMERCIAL LAND P ortion of lands located along the periphery of the national highway starting from Crossing Bialong to Sangat and Barangays Inas , Bagontapay are New Rizal are the only land that were declared as commercial per Comprehensive Land Use Plan and Zoning Ordinance, leaving all others under agricultural use; Section 2. COVERAGE – This ordinance covers all lands 100-meter strip along the national highway from the boundary of M’lang-Tulunan , M’lang-Matalam , M’lang-Makilala and M’lang -Kidapawan from Agricultural to Commercial land. Existing Institutional and Industrial land uses shall remain on its present use unless otherwise there’s a request for reclassification.
