3. •Section63.Amanissaidtocommit“rape”ifhe—
•(a)penetrateshispenis,toanyextent,intothevagina,mouth,
urethraoranusofawomanormakeshertodosowithhimorany
otherperson;or
•(b)inserts,toanyextent,anyobjectorapartofthebody,notbeing
thepenis,intothevagina,theurethraoranusofawomanormakes
hertodosowithhimoranyotherperson;or

4. •Section63.Amanissaidtocommit“rape”ifhe—
•(c)manipulatesanypartofthebodyofawomansoastocause
penetrationintothevagina,urethra,anusoranypartofbodyofsuch
womanormakeshertodosowithhimoranyotherperson;or
•(d)applieshismouthtothevagina,anus,urethraofawomanor
makeshertodosowithhimoranyotherperson,

5. •underthecircumstancesfallingunderanyofthefollowingseven
descriptions:—
•(i)againstherwill;
•(ii)withoutherconsent;
•(iii)withherconsent,whenherconsenthasbeenobtainedbyputting
heroranypersoninwhomsheisinterested,infearofdeathorof
hurt;

6. •(iv)withherconsent,whenthemanknowsthatheisnother
husbandandthatherconsentisgivenbecauseshebelievesthatheis
anothermantowhomsheisorbelievesherselftobelawfully
married;

7. •(v)withherconsentwhen,atthetimeofgivingsuchconsent,by
reasonofunsoundnessofmindorintoxicationortheadministration
byhimpersonallyorthroughanotherofanystupefyingor
unwholesomesubstance,sheisunabletounderstandthenatureand
consequencesofthattowhichshegivesconsent;

8. •(vi)withorwithoutherconsent,whensheisundereighteenyearsof
age;
•(vii)whensheisunabletocommunicateconsent.

includelabiamajora.
•Explanation2.—Consentmeansanunequivocalvoluntaryagreement
whenthewomanbywords,gesturesoranyformofverbalornon-
verbalcommunication,communicateswillingnesstoparticipateinthe
specificsexualact:
•Providedthatawomanwhodoesnotphysicallyresisttotheactof
penetrationshallnotbythereasononlyofthatfact,beregardedas
consentingtothesexualactivity.

10. •Exception1.––Amedicalprocedureorinterventionshallnot
constituterape.
•Exception2.––Sexualintercourseorsexualactsbyamanwithhisown
wife,thewifenotbeingundereighteenyearsofage,isnotrape
