Persons found guilty of drink
driving in the UK are punishable
by law.

If you are accused of drink
driving, you can lose your
right to drive, or you can
receive a fine.

In serious cases, a consequence of
drink driving in the UK is imprisonment.

The penalty is determined by the
magistrates, and it depends on the
severity of the case and whether or not
the person is a repeat offender.

The Magistrate’s Courts sentencing guidelines focus on the type of offence,
according to the Road Traffic Act and the relevant revisions

3 months’ imprisonment;
a possible driving ban;
a fine of up to £2,500.
If you are in charge of a vehicle while
unfit through drink, the minimum penalty
can be:

You can get an unlimited fine, a driving
ban of at least one year, or 6 months’
imprisonment for driving or attempting
to drive while above the legal limit.

For the most serious offence of having caused death by careless
driving while unfit through drink you can get life imprisonment.

Repeat offenders, or those who are found guilty of certain drink driving offences will
need to pass a test before they can have their license returned to them.
