Sub: Feedback on Draft Rules on Social Security Code by Delhi Government
Greetings from Gig Workers Association!
We are delighted to have gone through the draft rules on the Social Security Code, 2020 by
the Delhi government vide file number F. No. 15(43)/Lab/2021/2262-2267..
In reference to the above, on behalf of Gig Workers Association, a national network on the
registered unions such as Gig Workers Union, Platform based and other Commerce
Workers Union, Amazon India Workers Union, Janpahal General Workers Union and
common interest groups of the platform workers, we are pleased to submit that a special
welfare board for Gig and Platform Workers should be constituted as per the promise in the
election manifestoes of the various parties in Delhi and then in line with the precedents of
the laws for the registration ,welfare and social security for the gig and platform workers that
have been passed in the states of Bihar, Rajasthan, Karnataka etc .
Also this will be in line with SS Code,2020 provision of creation of National Social Security
Board with its counterpart in the state of Delhi once the SS Code,2020 gets rolled out. The
code provides for the establishment of a National Social Security Board, which will act
as the board for gig workers and platform workers, recommending and monitoring
relevant schemes.
The SS Code, 2020, defines a gig worker as someone participating in a work arrangement
and earning from activities outside a traditional employer-employee relationship. According
to the newspaper reports, this definition may be changed for incorporating the realities of
the working hours of the platform and gig workers as per the survey reports like RIGHTS
report which shows that more than 85 per cent of the gig and platform workers are working
for more than 8 hours per day.
The above mentioned Board will include representatives from the central government,
aggregators (digital platforms), gig and platform workers, state governments, and the
Director General of the ESIC. The SS Code, 2020 envisions that Schemes for gig and
platform workers may be funded through contributions from the central government, state
governments, and aggregators. The code identifies specific aggregators (like ride-sharing
and food delivery services) and outlines their potential contributions to the funding of
social security schemes, typically between 1-2% of their annual turnover. The code enables
the government to notify schemes for gig and platform workers, potentially covering life
and disability cover, accident insurance, health and maternity benefits, and old age
protection.
