Introduction Intellectual property rights (IPR) are the rights which are given to people over the creation of their minds which may be in form of literary works , inventions , artist work or in form of names, symbols and images used in commerce. They usually provide the creator an exclusive private right over the use of his or her creation for certain period of time.

Importance of IPR for breeders and researchers IPR ensures breeders and researchers can recoup investments by protecting their novel varieties from unauthorized use. It promotes innovation by providing legal recourse against infringement and supports commercialization and market expansion. Strong IPR systems stimulate research, benefiting agricultural productivity and biodiversity conservation .

Types of IPR Intellectual Property Copyright Patent G.I Trademark Plant Breeders' Rights Trade Secret

PATENT A patent is an exclusive right granted to the original inventor/developer/researcher which prohibits others from making using or selling the invention. R egulated under Patent amendment rules, 2020 .

TRADEMARKS A trademark is a sign capable of distinguishing the goods or services of one enterprise from those of other enterprise Trademark are protected by intellectual property rights.

GEOGRAPHICAL INDICATIONS Geographical indication is a sign used on products that have a specific geographical origin and posses qualities or a reputation that are due to that origin. Qualities characteristics or reputation of that product is due to place of origin.

COPYRIGHT Copyright is a legal term used to describe the rights that creator have over their literary or artistic works. Works covered by copyrights ranged from books, music, painting, sculptures and films, to computer programmed database advertisement maps and technical drawings Regulated by Copyrights act, 1957.

TRADESECRET Trade secret are IPRs on confidential information that can be sold or licensed. To qualify for a trade secret information must be commercially viable known to limited group of persons and be subject to reasonable steps taken by owner to keep information secret.

Plant breeders' rights Earlier, India was not having any legislature to protect plant breeder’s rights India signed trade related aspects of intellectual property right agreement in 1994 Article 27.3 (b) of this agreement required signatories to provide protection to plant varieties either by patents or by sui generic system or by combination of both Existing Indian patent act 1970 excluded agricultural and horticultural methods of production from patentability Thus, protection of plant varieties and farmers rights act (PPV&FRA) 2001 came into existence to protect plant breeder rights.

Challenges in enforcing IPR in plant breeding Enforcement is often difficult due to the biological nature of plants, cross-breeding, and traditional farming practices. Balancing breeders’ rights with farmers’ privileges remains a persistent challenge in equitable IPR enforcement.
