WHAT IS MTP ????
It simply refers to ‘induced abortion’ in which there is termination of
pregnancy by means of drugs or surgical intervention .

DEFINITION.
➢It is the act passed by government of India to make abortions legal
and defines where, when and under what conditions abortion is
permissible.
➢The first provision was done in 1860 under the britishrule.
•Circumstances before act
1.Before 1970-71 it was described as intentionally causing miscarriage
except where abortion was done to save the life of patient.
2. Person doing abortion were put behind the bars or fined for doing
abortion.
3. Women was also imprisoned upto7 years.

What led to the formation of MTP Act ?
•Increased number of abortions taking place due to which Ministry of
Health and Welfare came into picture.
•A committee was made in 1964 which is led by ShantilalShah
•Recommendations of this committee were accepted in 1970 and
introduced in the parliament.
•Finally, bill was passed in August,1971 as MTP ACT and this act was
enforced nationwide from April 1
st
,1972 and was amended in 1975
and 2002.

OBJECTIVES
✓To improve the maternal health scenario by preventing large
number of unsafe abortions.
✓To decrease the mortality and morbidity.
✓To legalise abortion services.
✓To promote safe access to women for abortion services.
✓To offers protection to medical practitioners.

Indications for legal
terminations
•In case of failure of contraceptives in married women.
•Continuation of further pregnancy have a risk to the life o pregnant
women.
•Eugenic aspects where child to be born with abnormalities.
•In case of any Rape or rape done to lunatic women (mentally ill
women).
Upto12 weeks of gestation.
When length of pregnancy exceeds 12 weeks but less than 20 weeks
opinion of atleast2 medical practitioners.

Who can terminate ?
•A R.M.P. who has recognised medical qualifications.
•Whose name is registered in a state medical officer.
•Who has training experience as per MTP rule.
❑6 months House Surgery in Gynacecology.
OR
❑Have assisted a R.M.P. atleast25 cases of termination of pregnancy.

Where pregnancy can be terminated ?
Hospitals estabilishedor maintained by Government.
Or
A place approved by the government.

Consent-FORM-C
•Only the consent of women is required who attainted the age of 18
years.
•If the women is lunatic or having age less than 18 years ,consent of
guardian is required.

Offences & Penalities
•Any person who is violating the act were put behind the bars or
subjected to fine depending upon the crime.
Any person doing mtpand not R.M.P can be punished with a
imprisonment for 2-7 years.
Owner of unapproved place performing termination can be punished
with a rigorous imprisonment of 2-7 years
