•To analyze the key patent filing trends across – World, India, DeepTech Start-ups
•To understand the hits and misses in the patent filing process in India and recommendations to make it better for various stakeholders
Approach
•The study has extensively sourced data from annual reports of WIPO and Intellectual Property India, among others.
•Data sourced from Indian Patent Office is for financial year ending March, while data from WIPO is for year ending December.
•DeepTech start-ups’ analysis is based on a sample set of 364 major DeepTech starts-ups in India for which 922 patent families were identified through Questel Orbit
database. Sagacious is the knowledge partner for this exercise.
•For some start-ups, the patent data was extracted using their legal/parent name. The country of origin data is based on first filing of the patent family in the
mentioned country.
•The analysis is performed based on ‘Patent Family’. This implies that if a particular patent family has two members, only one patent reference has been taken into
account for the analysis. The distribution is based on automated numbers generated by the patent database using logical combination of key-words and
classification based strings.
•The data was extracted during March 2024. The count may vary for individual start-ups as many applications may not have been published yet in the public
domain, as there is a window of approximately 18 months from the filing date to the publication date.
•The mapping of patents to one specific domain/ application area is not mutually exclusive, as a single patent may be tagged in more than one technological/
application domain.
•The legal status trend is shown based on legal status of first filed application in the respective country.
•Discussions and surveys were conducted with key stakeholders to understand the patent filing process in India, existing challenges and recommendations.

The top five technology fields have retained their positions since 2012

•Dead: Patent that is no longer active or enforceable due to one of the reasons such as expiration of
20 years term, non-payment of maintenance fee, abandonment, or the like.
•First Filed: The initial patent application submitted for an invention. The first filed application
establishes the priority date for the invention.
•Granted: The term refers to a patent application that has successfully passed the scrutiny of the
patent office, leading to the issuance of a patent. This grant affirms that the invention is novel, non-
obvious, and useful, meeting all patentability criteria.
•PCT: The Patent Cooperation Treaty (PCT) assists applicants in seeking patent protection
internationally for their inventions, helps patent offices with their patent granting decisions, and
facilitates public access to a wealth of technical information relating to those inventions. By filing one
international patent application under the PCT, applicants can simultaneously seek protection for an
invention in a large number of countries.
