Whether Son/ Daughter of an under secretary of Government of kerala drawing 9 lakhs or more annual salary , eligible to get Non – Creamy Layer certificate?
Salary and agricultural income are not to be considered as income for calculating annual income for creamy layer status.As far as the Government employees are considered, the entry cadre/post is to be taken in to consideration.
For central purpose, parents of an applicantentered in the service as Class I officer before the age 40 (direct recruitment) , the applicant is considered as creamy layer. If both the parent are entered into service as class II officers, before the age 40 (direct recruitment), and entered into the service before the age of 40, the applicant is considered as creamy layer. In state purpose, these age limits are 35 years for Government service 36 years for educational purposes.
Except the above all employees having “Non Creamy Layer” Status.
Whether salary income of banking/public sector employees for availing thenon-creamy layer status?
salary and agricultural income will not be considered for considering “Creamy Layer” status for any category.As far as the case of banking and public sector companies, all comparable posts with government services can be considered in that way. But in case of non comparable cases of income from other sources except salary and agricultural income exceeds 8 lakhs, applicant must be included in “Creamy Layer”.
How can we determine the creamy layer status of retired Government employees?
The entry cadrewhile they are in services are to be considered for creamy layer status. Pension amount will not be considered.
While considering the creamy layer status of married persons, whether the income of spouse and spouse’s parents is considered or not?
The Creamy Layer Status of one is considered depend upon his /her parents status only.It will not consider the income of the applicant’s brothers, sisters, spouse or parents of spouses etc.
Is an officer directly entered into Government service as class1 officer is eligible for Non Creamy Layer Certificate?
The eligibility of Non Creamy Layer Certificate based on considering only the status of the parent of the applicant. In this case for the applicant , the status of class1 officer may not be an obstacle to get Non Creamy Layer Certificate for himself. But no eligibility for his/her children.

Subject: Revision of format for OBC Caste Certificate
The Government of lndia had issued instructions on 8"' September, 1993 vide DoPT
O.M. No. 36012/22/93-Estt.(SCT) providing for reservation to Other Backward Classes in
the services and posts under the Government of India. The format of the Caste Certificate was
prescribed vide Annexure A of the O.M. No. 36012/22/93-Estt.(SCT) dated 15~~~0ven1ber
1993. In the said format, the then Ministry of Welfare's Resolution No. 1201 1/68/93-BCC(C)
dated loth September 1993 was mentioned, which contained the list of castes and
communities treated as OBCs till that time. Since then, a large number of castes and
communities have been added to the Central List of OBCs through various resolutions of the
Ministry of Social Justice and Empowerment. The details ofthe resolutions subsequent to the
Resolution dated loth September 1993 do not find mention in the existing format. The said
format also prescribes that the certificate issuing authority should certify that the candidate
does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the
Schedule to the aforesaid O.M. dated 8.9.1993.
2. Representations have been received in this Department wherein candidates belonging
to OBC Communities have reportedly faced difficulty in getting the benefits of reservation.
This is because of the fact that in the caste certificate issued by the concerned district
authorities, although the name of the caste/community is mentioned in the certificate, the
specific resolution by which the said caste/community has been included in the Central List
of OBCs is not indicated.
3. Keeping in view such problems faced by the candidates, this issue was examined in
consultation with the National Commission for Backward Classes and it has been decided to
revise the existing format of OBC Caste Certificate. A copy of the revised format is enclosed
(Annexure). All the certificate issuing authorities are requested to invariably mention the
details of the Resolution (Number and Date) by which the caste/community of the
candidate has been included in the Central List of OBCs and also to ensure that helshe does
not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to
the aforesaid O.M. dated 8.9.1993 as amended from time to time.

Subject: Validity period of OBC Certificate in respect of 'creamy layer' status
of the candidates

This Departm 'ent has received various references on the issue of problem s
being faced by the candidates on the requirem ent to obtain m ultiple non-cream y
layer OBC certificates for appearing in various exam inations. With a view to address
this issue, the following revised procedure is proposed: -
(a)Every candidate seeking reservation in central governm ent posts and services
as OBC candidate is required to subm it a certificate confirm ing his/ her status as
OBC and also produce Non-cream y layer status issued by an authority m entioned in
DOPT Office Mem orandum No.36012/ 22/ 93-Est(SCT) dated 15.11.1993.
(b)The Non-creamy Layer Certificate would be applicable to OBC candidates
who are covered under I ncom e/ Wealth Test criterion. The incom e lim it is decided on
the basis of incom e earned during three previous financial years preceding the year
of appointment. To illustrate, the validity of non-creamy layer certificate issued
during any m onth of the financial year 2016-17 covering 3 preceding financial years
viz. 2013-14, 2014-15 and 2015-16 be accepted by the concerned authorities for any
appointm ents or recruitm ents which would be valid during the period April 2016 to
March 2017. The appointing authorities would accept production of self-attested
photo copy of the Non-cream y layer certificate, subject to verification of the original
Non-cream y layer certificate, as is the practice being followed for verification of other
original docum ents.
2. On this issue, the National Com m ission of Backward Classes has suggested
a new form at for issue of Non-cream y layer certificate, which is enclosed.
3. I t is requested that com m ents on the suggestions m ade in para 1 of this OM
and any other suggestion(s) to stream line the system of issue of Non cream y layer
certificate (NCL) m ay please be furnished.
