INTRODUCTION
•InIndiatherewasnorestrictiontopractisetheprofessionofpharmacy.Onecouldpractisethis
professionasanyotherprofession.Persons,havingnoknowledgeandhavingnoeducationin
pharmacyorpharmaceuticalchemistryorpharmacology,wereengagedinthisprofession.
•HundredsofcaseswerebroughttothenoticeoftheGovernmentwhereinthecompounding,
mixing,ordispensingofmedicineswasbeingdonebypersonswhowerenotadequately
educatedinthisline.Thesystemwascausinggreatharmtothehealthofpeoplebywrong
compounding,mixingordispensing.Itwasfoundnecessarytoenactalawfortheregulationof
theprofessionandpracticeofpharmacy.
•ToachievethisgoalthePharmacyBill,1947wasintroducedintheLegislaturewhichwaslater
referredtotheSelectCommittee.TherecommendationsoftheSelectionCommitteewere
incorporatedintheBill.

CommitteeregardingformationofCentralCouncilandStatePharmacyCouncils,fortakingcareof
educationofpharmacistsandformaintainingtheregisterofpharmacist,thePharmacyActcame
intoexistenceon4thMarch1948.
ACT8OF1948
•ThePharmacyBill,1947,havingbeenpassedbytheLegislaturereceiveditsassenton4thMarch,
1948.
•ItcameontheStatuteBookasTHEPHARMACYACT,1948(8of1948).
•ThisActextendstothewholeofIndiaexcepttheStateofJammuandKashmirandhasbeen
amendedincertainaspectsbythePharmacyAmendmentAct,1959andPharmacyAmendment
Act,1976.

ObjectivesofPharmacyAct,1948:
•ThemajorobjectiveofthisActistoregulatetheprofessionand
businessofpharmacy.Inadditiontothisotherobjectivesare:
•To provide the uniform education and training to all the new
pharmacists and
•To maintain the control over persons entering in the profession of
pharmacy.

DEFINITIONS
1.CentralCouncil:
•CentralCouncilmeansthePharmacyCouncilofIndiaconstitutedundersection3.
2.CentralRegister:
•CentralregistermeanstheregisterofpharmacistmaintainedbyCentralCouncil
undersection15A.
3.RegisteredPharmacist:
•Registeredpharmacistmeanspersonwhosenameisforthetimebeingentered
intheregisterofpharmacistforaStateinwhichheisforthetimebeingresiding
orcarryingonhisprofessionorbusinessofpharmacy.
4.ExecutiveCommittee:
•Executive Committee means the Executive Committee of Central Council or State
Council as the context may require.

5.StateCouncil:
•StateCouncilmeansStatePharmacyCouncilconstitutedundersection19and
alsoincludesJointStatePharmacyCouncilconstitutedinaccordancewithan
agreementundersection20.
6.UniversityGrantsCommission:
•ItmeanstheUniversityGrantsCommissionestablishedundersection4ofthe
UniversityGrantsCommissionAct,1956.
7.Repatriate:
•RepatriatemeansanypersonofIndianoriginwhoonaccountofcivil
disturbancesorforthefearofsuchdisturbancesnowformingthepartofSri
lanka,Burma,Ugandaoranyothersuchcountryhasonorafter14thApril1957
leftorhasbeendisplacedfromhisplaceofresidenceandwhohassincethen
beenresidinginIndia.

8. Displaced Person:
•Displaced Person means,
•a) Person who on account of setting up the dominions of India and Pakistan or on
account of civil disturbances or for the fear of such disturbances now forming the
part of Pakistan has on or after 1st March 1947 left or has been displaced from
his place of residence and who has since then been residing in India; or
•b) Person who on account of civil disturbances or for the fear of such
disturbances now forming the part of Bangladesh has on or after 14th April 1957
but before 25th March 1971 left or has been displaced from his place of
residence and who has since then been residing in India.
9. Registered Medical Practitioner:
•Registered Medical Practitioner means
a) Person holding qualification granted by an authority specified or notified under
section 3 of the Indian Medical Degrees Act, 1916 or as may be specified in the
Schedules to the Indian Medical Council Act, 1956; or

b)PersonwhoisregisteredoreligiblefortheregistrationinamedicalregisterforaStatemeantfor
theregistrationofperson,practicingthemodernscientificsystemsofmedicine;or
c)PersonwhoisregisteredoreligiblefortheregistrationinamedicalregisterforaStatewho
althoughnotfallingwithinsubclauses(i)or(ii),isdeclaredbygeneralorspecialordermadebythe
StateGovernment,inthisbehalfasapersonpracticingmodernscientificsystemsofmedicines;or
d)Personwhoisengagedinthepracticeofveterinarymedicineandwhopossessthequalification
approvedbytheStateGovernment;or
e)PersonwhosenameisenteredintheregisterofDentistunderDentistsAct,1948.
•The Pharmacy Act is covered under 5 chapters consisting of 46 sections. The major amendment
to the Act was made in 1976 to Section 42 of the Act wherein the drug stores in the country
would be run under the supervision of registered pharmacists only after 1st November, 1983.

PHARMACY COUNCIL OF INDIA
•The Pharmacy Council of India is the statutory body of government of
India also called as central council constituted under the Pharmacy
Act, 1948. The Council was first constituted on 4 March 1948. The
Pharmacy Council of India is constituted by central government every
five years.

PHARMACY COUNCIL OF INDIA (PCI)
•Pharmacy Council of India was constituted by Central Government on 9th March 1949 to fulfill
the objectives of the Pharmacy Act, 1948.

fiveyearsandnotextendingbeyondtheexpiryofhistermasmemberofthe
CentralCouncilbutsubjecttobeingamemberoftheCentralCouncil,heshallbe
eligibleforre-election,providedthat,ifhistermofofficeasamemberofthe
CentralCouncilexpiresbeforetheexpiryofthefulltermforwhichheiselected

•TheExecutiveCommittee:
•TheCentralCouncilshall,assoonasmaybe,constituteanExecutiveCommitteeconsistingofthe
President(whoshallbeChairmanoftheExecutiveCommittee)andVice-President,ex-officio,and
fiveothermemberselectedbytheCentralCouncilfromamongstitsmembers.
•AmemberoftheExecutiveCommitteeshallholdofficeassuchuntiltheexpiryofhistermof
officeasmemberoftheCentralCouncilbutsubjecttohisbeingamemberoftheCentralCouncil,
heshallbeeligibleforre-election.
•InadditiontothepowersanddutiesconferredandimposedonitbythisAct,theExecutive
Committeeshallexerciseanddischargesuchpowersanddutiesasmaybeprescribed.

1.Toprescribetheminimumstandardsofeducationrequiredforqualificationasapharmacistby
makingandgoverningtheEducationRegulationsthroughoutthecountry.
2.Toensureuniformimplementationoftheeducationalstandardsthroughoutthecountry
byappointingpharmacyinspectorstoinspectthepharmacyinstitutions.
3.Tograntapprovalorwithdrawtheapprovalofinstitutionswhichconductthecourseofstudyor
holdsanexaminationforpharmacists

4.ToapprovethequalificationsgrantedoutsidetheterritoriestowhichthePharmacyAct1948
extendsi.e.theapprovaltoforeignqualification.

STATE AND JOINT PHARMACY COUNCILS
•PharmacyActunderChapterIIIprovidesfortheconstitutionofStatePharmacyCouncilbyState
Government.Itisreconstitutedaftereveryfiveyears.
•WithanamendmenttoSection42ofthePharmacyAct,nopersonotherthanregistered
pharmacistscancompound,dispenseordotheretailbusinesspertainingtomedicines.Itconsists
ofthefollowingMembers.
1.ElectedMembers
a)SixpersonsareelectedfromamongstthemselvesbytheregisteredpharmacistsoftheState.
b)OnememberiselectedfromamongstthemselvesbythemembersofMedicalCouncilofthe
State.
2.NominatedMembers
•FivemembersarenominatedbyStateGovernmentofwhomatleastthreeshallpossessdegree
ordiplomainpharmacyorpharmaceuticalchemistryorberegisteredpharmacistofState.
3.Ex-officioMembers
a)ChiefAdministrativeMedicalOfficeroftheState.
b)Theofficer-in-chargeofdrugcontrolorganizationoftheState.
c)GovernmentAnalystappointedunderDrugsandCosmeticsAct,1940.

•PresidentandVice-PresidentofStatePharmacyCouncil:
•ThePresidentandVice-PresidentofStateCouncilshallbeelectedbythe
membersoftheCouncilfromamongstthemselves.Providedthat,forfiveyears
fromthefirstconstitutionofStateCouncilthePresidentshallbeaperson
nominatedbyStateGovernmentwhoshallholdofficeatthepleasureofState
Governmentandwhereheisnotalreadyamember,shallbeamemberofState
Councilinadditiontothemembersreferredtoinsection19or21,asthecase
maybe.
•ThePresidentorVice-Presidentshallholdofficeassuchforatermnotexceeding
fiveyearsandnotextendingbeyondtheexpiryofhistermasamemberofState
Council,butsubjecttohisbeingamemberofStateCouncil,heshallbeeligible
forre-election.Providedthat,ifhistermofofficeasamemberofStateCouncil
expiresbeforetheexpiryofthefulltermforwhichheiselectedasPresidentor
Vice-President,andifheisRe-electedorre-nominatedasamemberofState
Council,continuetoholdofficeforthefulltermforwhichheiselectedas
PresidentorVice-President.

•Functions of State Pharmacy Council:
1. Preparation and maintenance of register
•State Pharmacy Council of each State shall prepare and maintain the register of
pharmacists as per the provisions of the Pharmacy Act, 1948.
2. Entry and removal of name from register
•Registrar of each State Council shall enter the names of such persons qualified by
Registration Tribunal appointed by State Council. Under certain circumstances
State Pharmacy Council may remove the name of registered pharmacist from the
register.

•Joint-StatePharmacyCouncil:
TwoormoreStateGovernmentsmaycometogethertoconstituteJointStatePharmacyCouncil
underSection20.Itconsistoffollowingmembers.
1.ElectedMembers
a)ThreetoFivemembersareelectedfromamongstthemselvesbytheregisteredpharmacistof
eachparticipatingState.
b)OnememberiselectedfromamongstthemselvesbythemembersofMedicalCouncilofeach
participatingState.
2.NominatedMembers
TwotofourmembersarenominatedbyeachStateGovernmentofwhomatleasthalfshallpossess
degreeordiplomainpharmacyorpharmaceuticalchemistryorshallbearegisteredpharmacistof
eachparticipatingState.
3.Ex-officioMembers
a)ChiefAdministrativeMedicalofficerofeachparticipatingState.
b)TheOfficer-in-chargeofdrugcontrolorganizationofeachparticipatingState.
c)GovernmentAnalystappointedunderDrugsandCosmeticAct,1940ofeachparticipatingState.

EDUCATION REGULATIONS
•EducationRegulations(ER):
•AspertheSection10ofthePharmacyAct1948,PharmacyCouncilofIndiawiththeprior
approvaloftheCentralGovernmentmaymakecertainregulationsprescribingthequalification
requiredfortheregistrationofpersonasapharmacist.Theseregulationsareknownas
educationregulations.Itprescribes:
a)Theminimumqualificationrequiredforthecourse.
b)Thenatureandperiodoftrainingwhichisgiventothestudentbeforeappearingtothe
examination.
c)Thenatureandperiodoftrainingwhichistobegiventothestudentsaftercompletionofthe
academictrainingbutbeforegettingdiplomaordegreecertificate.
d)Thefacilitiestobeprovidedbyinstitutionsforthestudentsundergoingtheapprovedcourseof
study.
e)Thefacilitiestobeprovidedbytheinstitutionsforthestudentsundergoingpracticaltraining.
f)Thesubjectsofexaminationsandstandardstobeattainedtherein.
g)Anyotherconditionsforexamination.

•Copiesofdraftsofeducationregulationsandallsubsequentamendmentsthereofshallbe
furnishedbyCentralCounciltoalltheStateGovernments.CentralCouncilbeforesubmittingthe
copiesofeducationregulationstotheCentralGovernmentfortheapprovalshallconsiderthe
commentsofStateGovernments.ThecommentsofStateGovernmentshallbereceivedwithin
threemonthsfromfurnishingthecopiesofeducationregulationsandtakenintoconsideration.
•EducationregulationsarethenpublishedintheOfficialGazetteofIndia.ExecutiveCommittee
fromtimetotimereportstotheCentralCouncilontheefficacyofeducationregulationsandmay
recommendanyamendments.ThefirstERasapprovedbytheMinistryofHealthandFamily
Welfarewasnotifiedon11thJuly1953,thesecondERin1972,thirdERin1981whilefourthERin
1991.
•Approval of Institutions or Authority which conducts course of study or holds
an Examination:
1.Application:
An institution or authority which conducts the course of study or holds an examination for the
pharmacist has to make an application to the Central Council for the approval of the course or
examination.
2. Inspection
Central Council, on the receipt of such application, deputes its inspector to visit that institution or
authority and ascertain that whether those institutions are having the prescribed facilities for the
conduct of course of study or hold an examination. Inspectors then reports to the Central Council on
the facilities available in the institute for the conduct of course or examination.

3.Approval
Onthereceiptofreportofinspectors,iftheCentralCouncilissatisfiedthattheinstitutionor
authoritywhichconductsthecourseofstudyorholdsanexaminationisinconformitywiththe
educationregulations,itmayaccordtheapprovalandthesaidcourseisdeemedtobeapproved.
4.Declaration
DeclarationofapprovalmadebyresolutionsispassedatthemeetingofCentralCouncilandis
publishedintheOfficialGazette.
WithdrawalofApproval:
IftheExecutiveCommitteereportstotheCentralCouncilthattheinstitutionorauthoritywhich
conductsthecourseofstudyorholdsanexaminationdoesnotcontinuetobeinconformitywith
theeducationregulation,CentralCouncilmaygiveanoticetothatinstitutionorauthoritywiththe
intentionofwithdrawingofapproval.Suchinstitutionshouldmakearepresentationwithinthree
monthsfromthedateofreceiptofsuchnoticethroughtheStateGovernment.IftheCentralCouncil
issatisfiedwiththerepresentationofinstitutionitmayrestoretheapprovalandifnotsatisfiedit
maywithdrawtheapprovaloftheinstitution.Theinstitutionwhichisde-recognisedbyPCIcan
applyafreshforgettingtheapprovalafterfulfillingtheconditionsrequiredasperER.

REGISTRATION OF PHARMACIST
•Registrationofpharmacistisrequiredtomaintainthestandardsofpharmacyprofession.
1.FirstRegister-WhenthePharmacyAct,1948isenforcedinaState,registrationofpersonis
carriedoutbytheRegistrationTribunal;theregistersopreparedbytheRegistrationTribunalis
calledasfirstregister.
Preparationandmaintenanceoffirstregister:
a).ConstitutionofRegistrationTribunal
•Forthepurposeofpreparingthefirstregister,StateGovernmentshallbynotificationinthe
OfficialGazetteconstituteaRegistrationTribunalconsistingofthreepersonsandshallappointa
registrarwhoshallactasSecretaryofRegistrationTribunal.
b).Appointmentofdatefortheapplication
•StateGovernmentshallbysameorsimilarnotificationappointadateonorbeforewhichthe
applicationforregistrationaccompaniedwiththeprescribedfeesshallbemadetothe
RegistrationTribunal

c).Scrutiny
•RegistrationTribunalshallexamineeachandeveryapplicationreceivedonorbeforethe
appointeddate.Ifitissatisfied,theapplicantisqualifiedandhisnamewillbedirectlyenteredin
thefirstregister.
d).Appeal
•FirstregistersopreparedshallbepublishedinsuchmannerastheStateGovernmentmaydirect
andifanypersonwhoisaggrievedwiththedecisionsofRegistrationTribunalmayappealwithin
60daysofsuchpublicationtotheauthorityappointedthereuponabove.
e).Issueofacertificateofregistration
•RegistrarofStateCouncilshallkeeptheregisterinaccordancewiththeordersmadeby
RegistrationTribunalandshallthereupon,issuetoeverypersonacertificateofregistrationinthe
prescribedform.
•UpontheconstitutionofStateCouncil,theregistershallbegivenintoitscustodyandthe
registrationfeesshallbepaidtothecreditofStatePharmacyCouncil.

Qualificationsforentryonthefirstregister:
•Aperson,whohasattainedhis18yearsofage,residesorcarriesonhisprofessionorbusiness
ofpharmacyandhasbeenpaidtheprescribedfeesfortheregistration,shallbeentitledtohave
his/hernametobeenteredonthefirstregisterandifhe/she
a)holdsadegreeordiplomainpharmacyorpharmaceuticalchemistryor'ChemistsandDruggists'
diplomaofanIndianUniversityoranyotherprescribedqualificationgrantedbyanauthority
outsideIndia.
b)holdsadegreeotherthandegreeinpharmacyorpharmaceuticalchemistryofarecognized
Universitywithnotlessthanthreeyearsexperienceincompoundingofdrugsinahospitaloratany
otherplacewheredrugsaredispensedontheprescriptionofRegisteredMedicalPractitioner.
c)haspassedanexaminationrecognizedasanadequatebyStateGovernmentforthe
CompoundersandDispensers.
d)isengagedincompoundinganddispensingofdrugsforatotalperiodofnotlessthanfiveyearsin
ahospitalordispensarywheredrugsaredispensedregularlyontheprescriptionofRegistered
MedicalPractitioner.

2.SubsequentRegister:Whentheexpirydateforfirstregisterisfixedforreceivingtheapplication
andeitherbeforeoraftertheeducationregulationcameintoeffect,theregisterofaqualified
personisprepared,suchregisteriscalledasasubsequentregister.
QualificationsforentryontheSubsequentregister:
A)Beforetheeducationregulationtakenintoeffect
Aperson,whohasattainedhis18yearsofage,residesorcarriesonhisprofession
orbusinessofpharmacyandhasbeenpaidtheprescribedfeesfortheregistrationshallbeentitled
tohavehis/hernametobeenteredonthesubsequentandifhe/she:
a)satisfiestheconditionsprescribedwiththepriorapprovalofPharmacyCouncilofIndiaand
wherenosuchconditionshavebeenprescribed,satisfiesthoseconditionswhicharerequiredfor
registrationonthefirstregisterandhaspassedmatriculationoritsequivalentexamination.
b)isaregisteredpharmacistofanotherState.
c)holdsanyotherprescribedqualificationgrantedbyanauthorityoutsideIndia.

B)Aftertheeducationregulationtakenintoeffect:
•Aperson,whohasattainedhis18yearsofage,residesorcarriesonhisprofessionorbusinessof
pharmacyandhasbeenpaidtheprescribedfeesfortheregistrationshallbeentitledtohavehis/
hernametobeenteredonthesubsequentregisterandifhe/she
a)haspassedmatriculationoritsequivalentexamination.
b)isaregisteredpharmacistofanotherState.
c)holdsanyotherprescribedqualificationgrantedbyanauthorityoutsideIndia.
AfterEducationRegulationscameintoforce,onlyadiplomainpharmacyholderof
aninstitutionapprovedbyPCIwhohasundergone500hoursofpracticaltrainingaftercompletion
ofD.Pharmcourseisonlyeligibleforregistrationaspharmacist.

3.Specialprovisionsforregistrationofcertainpersons
•ThePharmacyAmendmentAct,1959providedthatStatePharmacyCouncilmaypermittoenter
onthesubsequentregisterthenamesofthefollowingclassesofpersons:
a)Displacedpersonwhohasbeencarryingonhisprofessionorbusinessofpharmacyfromadate
priorto4thMarch1948andwhosatisfiesthenecessaryconditionsfortheregistrationonthefirst
registerofState.
b)CitizenofIndiawhohasbeencarryingonhisprofessionorbusinessofpharmacyinanycountry
outsideIndiaandwhosatisfiesthenecessaryconditionsfortheregistrationonthefirstregister.
c)Displacedpersonwhohasresidedorcarriedonhisprofessionorbusinessofpharmacyandwho
satisfiesthenecessaryconditionsfortheregistrationonthefirstregisterofpharmacistforaState.
d)Personwhoresidesorcarriesonhisprofessionorbusinessofpharmacyandsatisfiesthe
necessaryconditionsfortheregistrationonthefirstregisterofpharmacistforaStateandhad
appliedfortheregistrationbutdidnotgetregisteredduetosomereason

4.SpecialprovisionsforregistrationofDisplacedpersons,Repatriatesandotherpersons
•ThePharmacyAmendmentAct,1976providesthatStatePharmacyCouncilmaypermittoenteronthe
subsequentregisterthenamesofthefollowingclassesofpersons-
1.Apersonwho,
a)holdsadegreeordiplomainpharmacyorpharmaceuticalchemistry;or
b)'ChemistsandDruggists'diplomaofanIndianUniversity;or
c)anyotherprescribedqualificationgrantedbyanauthorityoutsideIndia;or
d)haspassedanexaminationrecognizedasanadequatebyStateGovernmentforthe
CompoundersandDispensers;or
e)wereeligiblefortheregistrationbetweenthecloseoffirstregisterandthedatewheneducation
regulationscameintoeffect.
2.Apersonwhoisapprovedasa“QualifiedPerson”onorbefore31stDecember1969for
compoundinganddispensingofdrugs.
3.Displacedpersonswhowerecarryingontheprofessionorbusinessofpharmacyastheir
principalmeansoflivelihoodandhasappliedfortheregistrationonorbeforetheappointeddate
priortothedateofapplicationforregistration.

RemovalofNamefromRegister:
SubjecttoprovisionsofSection36oftheAct,theExecutiveCommitteemayorderforremovalof
nameofapersonfromRegister,aftergivingreasonableopportunitytopersonconcerned,on
followinggrounds:
1)ApersonwhosenamehasbeenenteredintheRegisterbyerrororanaccountof
misrepresentationorsuppressionoffact,
2)Apersonwhogivesfalseinformationabouthimself/herself,
3)Apersonwhosubmitsfalsecertificateorfalsedocumentinsupportofhis/herregistration,
4)Apersonwhoisconvictedofanoffenceinconnectionwithhis/herprofession,
5)Apersonwhowasindirectlyinvolvedincommitmentofprofessionaloffenceandifitisproved
thattheoffencewasinstigatedorconnivedatbytheregisteredpharmacist.
•A person aggrieved by order of State Pharmacy Council for removal of name from Register may
appeal to the State Government within one month and the order of the State Government upon
such appeal shall be final.
•A person whose name has been removed from the Register shall surrender forthwith his/her
certificate of registration to the Registrar of SPC and the name so removed shall be published in
the Official Gazette.

SUMMARY
ThemajorobjectiveofthisActistoregulatetheprofessionandbusinessof
pharmacy.ThisActprovidesfortheconstitutionofCentralCouncilandState
PharmacyCouncils.TheStatePharmacyCouncilsshallberesponsibleforpreparing
andmaintainingtheregisterofpharmacistsforStateandshallexercisesuchother
controlsoverthepersonspracticingpharmacy.ThisActextendstothewholeof
IndiaexcepttheStateofJammuandKashmirandhasbeenamendedincertain
aspectsbythePharmacyAmendmentAct,1959andPharmacyAmendmentAct,
1976.
