When property is under some rights in re aliena it is said to be under an encumbrances. Right in re aliena –rights over someone else property The main categories of encumbrances are – Leases Servitudes Securities Trust Encumbrances

MODES OF ACQUISITION OF PROPERTY Possession Prescription Agreement Inheritance

1. possession Property acquired through possession(by Salmond) The possessor of the property enjoys good title until evicted by the real owner. Res nullius (a thing which belongs to no one) concept.

2. Prescription Positive prescription- right over property acquired by lapse of time (Indian Easement Act –using well located in someone else land continuously) Negative prescription-destroys the right on property with lapse of time( right to sue for the dept after 3 years)
