The truth prevails as Mpati Commission-ordered forensic probe vindicates Harith tshepo mahloele

Harith General Partners is satisfied that the truth has finally prevailed in the years-long, sustained and malicious campaign to taint it with allegations of malfeasance. This comes after the forensic investigation commissioned by the PIC concluded in its final report that there was no evidence to support the damaging allegations made more than 5 years ago by a Senior Member of Parliament.

has finally prevailed in the years-long, sustained
and malicious campaign to taint it with allegations
of malfeasance.
•HarithGeneralPartnersissatisfiedthatthetruthhasfinally
prevailedintheyears-long,sustainedandmaliciouscampaign
totaintitwithallegationsofmalfeasance.Thiscomesafter
theforensicinvestigationcommissionedbythePICconcluded
initsfinalreportthattherewasnoevidencetosupportthe
damagingallegationsmademorethan5yearsagobyaSenior
MemberofParliament.ThereportvindicatesHarithwhich
hashadtooperateunderahuman-madecloudofsuspicion,
pepperedwithsporadic,gratuitous,falseandunfairpolitical
attacksonitsbrandandreputation.Harithwelcomesthefact
thatthePublicInvestmentCorporationandGovernment
EmployeesPensionFundcommissionedinvestigationhas
madefindingsthatalignpreciselywitheveryaspectofwhat
wehaveconsistentlytoldSouthAfricansallalong;thatHarith
hasbeenscrupulousinallitsdealingswiththePICandthe
GEPF.

3. The forensic probe was
commissioned jointly by the
PIC and the GEPF
•TheforensicprobewascommissionedjointlybythePIC
andtheGEPF,infulfilmentofrecommendationsbythe
MpatiCommissionintotheaffairsofthePIC.Ithasnow
returnedwithfindingsthatresponddirectly,adequately
andfinallytoeachofthequestionstheMpati
Commissionfeltneededfurtherinvestigation,namely;
1.“ToexaminetheentirePAIDF[PanAfrican
InfrastructureDevelopmentFund]initiativeto
determinethatallmoniesduetobothparties[PICand
GEPF]havebeenpaidandproperlyaccountedfor”

2.“Todeterminewhetheranymoniesdueto
overchargingoranyothermalpracticeshouldbe
recovered”[Page435.Para66oftheCommission

3.“TheboardofthePICshouldexaminewhethertherole
playedbyeitherMrMoleketiandMrMahloele
breachedtheirfiduciarydutiesorthefitandproper
testrequiredofadirectorintermsoftheCompanies
Act”[Page435.Para67oftheCommissionreport]

4. Harith welcomes the forensic investigation findings
now considers the allegations of impropriety against it
SECTION 1
•In a letter summing up the report’s
findings on all these questions, the PIC and
GEPF have informed Harith that: “The
investigation found that there was no
evidence to support the allegations that
were made with regard to Harith General
Partners and Harith Fund Managers”.
SECTION 2
•Harithwelcomestheforensicinvestigation
findings,andnowconsiderstheallegations
ofimproprietyagainstit,intheirvarious
iterations,tobenowwellandtruly
ventilated.Thislatestprobeisthefifth
processthathaslookedintothesematters,
withHarith’sfullcooperation,andwith
noneofthemmakinganyfindingsof
wrong-doingagainstthecompany.Thefull
gambitofprocessesthathavelookedinto
anddisposedoftheseallegationsis;

Throughoutalltheseprocesses,Harith’sdetractorshavebeenabletowantonly,andwithno
consequence,continuetocastaspersionsonalawfullyestablishedandlegitimatelyoperating
corporateentity,exactinganincalculabletollonthecompany,itsbrand,credibilityinthemarket,
employees,shareholders,investors,aswellasbusinessandfinancialrelationships.Throughout
thissaga,thecallouscampaigntodestroyHarithandthereputationsofMessrsMahloeleand
Moleketiwasthinly-maskedasanexerciseofpoliticalorparliamentary“oversight”,andinsults
hurledatthembecamethetradingstockofapoliticianandhisentitywhowereseekingtoshore-
uptheirdimmingprospects.Thosepoliticiansandtheirfellow-travellerswhogavetheirlies
currencyandbuoyancynowcrawlbackintothewoodwork,whilethevictimsoftheirsustained
slanderarelefttorepairtheextensivedamagetheywroughtontheirreputationsandbrands.

TheMpatiCommission;whoseoutcomesraisedanumberof
unwarrantedquestionswithoutmakinganyfirmfindings
againstHarith,MrTshepoMahloele,andMrJabulaniMoleketi.
Insteadofmakingfirmfindings,thecommissionrecommended
ajoint-forensicprobebythePICandtheGEPF.
TheConstitutionalCourtcaseofUDMvLebasheandothers;
whichamongothersfoundthattheUDMandMrBantu
Holomisa“…didnotprovideanyshredofevidenceofactual
misconduct,corruptionandself-dealing”[UDMvLebashe
judgment,para59],and“Theapplicantswerenotentitledto
wantonlydefametherespondentsunderthepretextthatthey
wereexecutingaconstitutionalduty…itwasnotforthepublic
benefittopublishtheunverifieddefamatoryinformation”
