InasuitbyoragainsttheGovernment,theauthoritytobenamed
asplaintiffordefendant,asthecasemaybe,shallbe:
a.InthecaseofasuitbyoragainsttheCentral
Government,the‘UnionofIndia’,and
b.InthecaseofasuitbyoragainstaState
‘Government,theState’.

1.1Notice
Undersection80oftheCode,twomonthnoticeis
mandatorybeforeinstitutionofsuitagainstGovernment.Notieis
givenintheofficeof-
(a)InthecaseofasuitagainsttheCentralGovernment,except
whereitrelatestoarailway,aSecretarytothatGovernment;
(b)InthecaseofasuitagainsttheCentralGovernmentwhereit
relatestorailway,theGeneralManagerofthatrailway;
(bb)InthecaseofasuitagainsttheGovernmentoftheStateof
JammuandKashmirtheChiefSecretarytothatGovernmentor
anyotherofficerauthorisedbythatGovernmentinthisbehalf;
(c)InthecaseofasuitagainstanyotherStateGovernment,a
SecretarytothatGovernmentortheCollectorofthedistrict;
and,inthecaseofapublicofficer,deliveredtohimorleftatthis
office.
Noticeshallstatethecauseofaction,thename,
descriptionandplaceofresidenceoftheplaintiffandtherelief
whichheclaims;andtheplaintshallcontainastatementthat
suchnoticehasbeensodeliveredorleft.

Inasuitinstitutedagainstapublicofficerinrespectofanyact

purportingtobedonebyhiminhisofficialcapacity,heshallnot
beliabletoarrestofhispropertytoattachmentinexecutionof
decree.
1.3Executionofdecree:
AdecreeagainstGovernmentorpublicofficershallnot
beexecutedunlessitremainsunsatisfiedfortheperiodofthree
monthsfromthedateofsuchdecree.
2 PUBLICNUISANCESANDOTHERWRONGFULACTS
AFFECTINGTHEPUBLIC[section91]
inthecaseofapublicnuisanceorotherwrongfulactaffecting,
orlikelytoaffect,thepublic,asuitforadeclarationand
injunctionorforsuchotherreliefasmaybeappropriateinthe
circumstancesofthecase,maybeinstituted-
b.bytheAdvocateGeneral,or
c.withtheleaveoftheCourt,bytwoormorepersons,even
thoughnospecialdamagehasbeencausedtosuch
personsbyreasonofsuchpublicnuisanceorother
wrongfulact.
Nothinginthissectionshallbedeemedtolimitorotherwise
affectanyrightofsuitwhichmayexistindependently
ofitsprovisions.
3 SUITSBYINDIGENTPERSONS[OrderXXXIII]
Generallyatthetimeofinstitutionofsuitplaintiffhastopay
requisiteCourtfees.Ifheisunabletopayhecansueasapoor
personwithoutCourtfees.Forthishehastomakeapplicationto
theCourttoallowhimtosueinformapauperis.
3.1Whoispauper/indigentperson:
Apersonisanindigentperson,
i.Ifheisnotpossessedofsufficientmeans(otherthan
propertyexemptfromattachmentinexecutionofa
decreeandthesubject-matterofthesuit)toenablehim
topaythefeeprescribedbylawfortheplaintinsuch
suit,or
ii.Wherenosuchfeeisprescribed,ifheisnotentitledto
propertyworthonethousandrupeesotherthanthe
propertyexemptfromattachmentinexecutionofa
decree,andthesubject-matterofthesuit.
3.2Contentsofapplication
Everyapplicationforpermissiontosueasanindigentperson
shallcontaintheparticularsrequiredinregardtoplaintsinsuits,

ascheduleofanymovableorimmovablepropertybelongingto
theapplicant,withtheestimatedvaluethereof.
3.3Examinationofapplicant:
Wheretheapplicationisinproperformanddulypresented,
theCourtmay,ifitthinksfit,examinetheapplicantorhisagent.
3.4Rejectionofapplication:
TheCourtshallrejectanapplicationforpermissiontosue
asanindigentperson:
a.Whereitisnotframedandpresentedinthemanner
prescribed,or
b.Wheretheapplicantisnotanindigentpersons,or
c.Wherehehas,withintwomonthsnextbeforethe
presentationoftheapplicationdisposedofany
propertyfraudulentlyorinordertobeabletoapplyfor
permissiontosueasanindigentperson:
3.5Procedureathearing:
Onthedaysofixedorassoonthereafterasmaybe
convenienttheCourtshallexaminethewitnesses(ifany)
producedbyeitherparty,andmayexaminetheapplicantorhis
agent,andshallmakeafullrecordoftheirevidence.
3.6Procedureifapplicationadmitted:
Wheretheapplicationisgranted,itshallbenumberedand
registered,andshallbedeemedtheplaintinthesuit,andthesuit
proceedinallotherrespectsasasuitinstitutedintheordinary
manner,exceptthattheplaintiffshallnotbeliabletopayany
Court-fee.
3.7Procedurewhereindigentpersonfails:
Wheretheplaintifffailsinthesuitorthepermission
grantedtohimtosueasanindigentpersonhasbeenwithdrawn,
orwherethesuitiswithdrawnordismissed:
a.becausethesummonsforthedefendanttoappearand
answerhasnotbeenserveduponhiminconsequence
ofthefailureoftheplaintifftopaytheCourt-feeor
postalcharges(ifany)chargeableforsuch
serviceortopresentcopiesoftheplaintorconcise
statement],or
b.becausetheplaintiffdoesnotappearwhenthesuitis
calledonforhearing,
theCourtshallordertheplaintiff,oranypersonaddedasa
co-plaintifftothesuit,topaytheCourt-feeswhichwouldhave

beenpaidbytheplaintiffifhehadnotbeenpermittedtosueas
anindigentperson.
4 INTERPLEADER[OrderXXXV]
Wheretwoormorepersonsclaimadverselytoone
anotherthesamedebts,sumofmoneyorotherproperty,movable
orimmovable,fromanotherperson,whoclaimsnointerest
thereinotherthanforchargesorcostsandwhoisreadytopayor
deliverittotherightfulclaimantsuchotherpersonmayinstitute
asuitofinterpleaderagainstalltheclaimantsforthepurposeof
obtainingadecisionastothepersontowhomthepaymentor
deliveryshallbemadeandofobtainingindemnityforhimself.
4.1Conditionsforinterpleadersuit:
i.Theplaintiffhasnointerestinthesubjectmatterexcept
chargesorcosts;
ii.Theclaimismadebydefendantsseverally,
iii.Thereisnocollusionbetweenplaintiffandanyofdefendants.
Thesethingsmustbestatedintheplaint.

4.2Procedureatfirsthearing:
AtthefirsthearingtheCourtmay:
a.Declarethattheplaintiffisdischargedfromallliability
tothedefendantsinrespectofthethingclaimed,award
himhiscosts,anddismisshimfromthesuit;or
b.Ifitthinksthatjusticeorconveniencesorequire,retain
allpartiesuntilthefinaldisposalofthesuit.
Wheretheadmissionsofthepartiesdonotenablethe
Courtsotoadjudicate,itmaydirect:
a.Thatanissueorissuesbetweenthepartiesbeframed
andtried,and
b.Thatanyclaimantbemadeaplaintiffinlieuoforin
additiontotheoriginalplaintiff,
andshallproceedtotrythesuitintheordinarymanner.
