DEFINITION OF TERMS
•Amicable Settlement-is an agreement
reached during mediation and conciliation
proceedings.
•Arbitration -is a process wherein the third
party from outside the judicial system is
chosen by parties to hear and decide their
dispute.

•Arbitration Award is the decision reached
by either the lupon chairperson or pangkat
chairperson, as the case maybe, upon
prior agreement in writing by the parties to
a dispute for the adjudicators to resolve it.
•Conciliation is a process wherein the
Pangkat assist the parties to isolate issues
and options to reach a settlement by
consensus that jointly satisfies theirneeds.

•Execution is the process of exacting
satisfaction for on or both of the parties
through compulsory or coercive means. It
entails the enforcement of the amicable
settlement or arbitration award in so far as
this may enjoin or command any of the
parties to perform an act, give something
or refrain from doing some act.

•Katarungang Barangay (KP) is a system of
justice administered at the barangay level
for the purpose of amicable settling
disputes through mediation, conciliation, or
arbitration among the family or barangay
members without resorting to the courts.
•Lupong tagapamayapa is a body
organized in every barangay composed of
Punong barangay as the Chairperson and

•Mediation is the process wherein the
Lupon Chairperson or Barangay Captain
assists the disputing parties to reach a

IV.LEGAL BASIS OF THE
REMEDIES
•SECTION417.Theamicablesettlementandarbitrationawardmaybeenforcedby
executionbytheluponwithinsix(6)monthsfromthedateofsettlement.Afterthelapseof
suchtime,thesettlementmaybeenforcedbyactionintheappropriatecityormunicipal
court.
•Accordingly,youhavetheoptionofenforcingthesubjectsettlementbeforethebarangay,
butonlywithinsix(6)monthsfromreachingsuchsettlementorenforceitbyfilingan
appropriateactionbeforethepropercourt.
•IwishtofurtheremphasizethattheremediesmentionedunderSection417ofthesame
codedonotruleoutthepossibleavailmentofanotherremedymentionedunderourcivil
laws,whichistoregardtheamicablesettlementasrescindedandinsistuponhisoriginal
demandbycourtaction.AsstatedunderArticle2041oftheNewCivilCode:
•“Ifoneofthepartiesfailsorrefusestoabidebythecompromise,theotherpartymayeither
enforcethecompromiseorregarditasrescindedandinsistuponhisoriginaldemand.”
•OurSupremeCourtexplainedinthecaseofMiguelvs.Montanez(G.R.No.191336;
January25,2012;ponente,AssociateJusticeBienvenidoReyes):
“Thus,underSection417oftheLocalGovernmentCode,suchamicablesettlementor
arbitrationawardmaybeenforcedbyexecutionbytheBarangayLuponwithinsix(6)months
fromthedateofsettlement,orbyfilinganactiontoenforcesuchsettlementintheappropriate
cityormunicipalcourt,ifbeyondthesix-monthperiod.

IV.
Itmustbeemphasized,however,thatenforcementbyexecutionofthe
amicablesettlement,eitherunderthefirstorthesecondremedy,isonly
applicableifthecontractingpartieshavenotrepudiatedsuch
settlementwithinten(10)daysfromthedatethereofinaccordancewith
Section416oftheLocalGovernmentCode.Iftheamicablesettlement
isrepudiatedbyoneparty,eitherexpresslyor[impliedly],theother
partyhastwooptions,namely,toenforcethecompromisein
accordancewiththeLocalGovernmentCodeorRulesofCourtasthe
casemaybe,ortoconsideritrescindedandinsistuponhisoriginal
demand.ThisisinaccordwithArticle2041oftheCivilCode,which
qualifiesthebroadapplicationofArticle2037,viz:
•Ifoneofthepartiesfailsorrefusestoabidebythecompromise,the
otherpartymayeitherenforcethecompromiseorregarditas
rescindedandinsistuponhisoriginaldemand.

IV.
TheRevisedKatarungangPambarangayLawprovidesforatwo-tiered
modeofenforcementofanamicablesettlement,towit:(a)byexecution
bythePunongBarangaythatisquasi-judicialandsummaryinnature
onmeremotionofthepartyentitledthereto;and(b)anactioninregular
form,whichremedyisjudicial.However,themodeofenforcementdoes
notruleouttherightofrescissionunderArt.2041oftheCivilCode.
Theavailabilityoftherightofrescissionisapparentfromthewordingof
Sec.417itselfwhichprovidesthattheamicablesettlement“may”be
enforcedbyexecutionbytheluponwithinsix(6)monthsfromitsdate
orbyactionintheappropriatecityormunicipalcourt,ifbeyondthat
period.Theuseoftheword“may”clearlymakestheprocedure
providedintheRevisedKatarungangPambarangayLawdirectoryor
merelyoptionalinnature

•SEC.13.Formofsettlementandaward.—Allsettlements,
whetherbymediation,conciliationorarbitration,shallbein
writing,inalanguageordialectknowntotheparties.
Settlementsbymediationorconciliationshallbesignedby
thepartiesandattestedbythePunongBarangayorPangkat
Chairman,asthecasemaybe,thatsuchsettlementwas
agreeduponbythepartiesfreelyandvoluntarilyafterafull
understandingofitstermsandanintelligentawarenessofthe
legalconsequencesthereof.
•ThearbitrationawardshallbesignedbythePunong
BarangayorallthemembersofthePangkat,asthecasemay
be.

V. MANNER OF EXECUTION IN
BARANGAY LEVEL
(RULE VI.—Amicable Settlement of Disputes)
•SEC.14.Repudiationofsettlement.—Anypartytothedispute
may,withinten(10)daysfromthedateofthesettlement,
repudiatethesamebyfilingwiththePunongBarangaya
statementtothateffectsworntobeforehim,wherethe
consentisvitiatedbyfraud,violence,orintimidation.Such
repudiationshallbesufficientbasisfortheissuanceofthe
certificationforfilingacomplaintincourtoranygovernment
officeforadjudication.
•Failuretorepudiatethesettlementwithintheaforesaidtime
limitshallbedeemedawaiveroftherighttochallengeon
saidgrounds.

•SEC.15.Effectofsettlementbyarbitrationorconciliation.—
Theamicablesettlementandarbitrationawardshallhavethe
forceandeffectofafinaljudgmentofacourtuponthe
expirationoften(10)daysfromdateofthesettlementordate
ofreceiptoftheaward,unlessrepudiationofthesettlement
hasbeenmadeorapetitionfornullificationoftheaward’has
beenfiledbeforetheproperlocaltrialcourt.

•SEC.16.Transmittalofsettlementandawardtocourt—
ImmediatelyuponsigningthePunongBarangayorthe
PangkatChairman,asthecasemaybe,shallfurnishcopies
ofthesettlementorawardtothepartiesandsendsuch
settlementorawardtotheLuponSecretarywhoshalltransmit
thesametothelocalcityormunicipalcourtwithinfive(5)
daysfromdateoftheawardor,inthecaseofsettlement,not
earlierthantheeleventhnorlaterthanthefifteenthdayfrom
dateofsettlement.Theamicablesettlementreachedina
casereferredbythecourttotheLuponpursuanttoSection2
ofthisRuleshallbetransmittedtothesaidcourtwithinthe
sameperiodprovidedinthisSectionforthetransmittalof
settlementthelocaltrialcourt.

Executionshallissueonlyupontheexpirationoften

•SEC.4.Hearing—Onthedaythemotionforexecution
isfiled,thePunongBarangayshallsetthesamefor
hearingonadateagreedtobythemovant,which
shallnotbelaterthanfive(5)daysfromthedateofthe
filingofthemotion.ThePunongBarangayshallgive
immediatenoticeofhearingtotheotherparty.
•Duringthehearing,thePunongBarangayshall
ascertainthefactofnon-compliancewiththetermsof
thesettlementoraward.Uponsuchdeterminationof
non—compliance,thePunongBarangayshallstrongly
urgethepartyobligedtovoluntarilycomplywiththe
settlementoraward.

•SEC.5.Issuance,formandcontentsofthenoticeof
execution.—ThePunongBarangayshallwithinfive(5)
daysfromthedayofhearing,determinewhetheror
notvoluntarycompliancecanbesecured.Uponthe
lapseofsaidfive-dayperiod,therebeingnovoluntary
compliance,heshallissueanoticeofexecutioninthe
nameoftheLupongTaga-pamayapa.Thesaidnotice
mustintelligentlyrefertothesettlementorawardand
theamountactuallyduethereunderifitbeformoney,
orthetermsthereofwhichmustbecompliedwith.

•SEC. 6. Procedure for execution:
A.Iftheexecutionbeforthepaymentofmoney,thepartyobliged
isallowedaperiodoffive(5)daystomakeavoluntary
payment,failingwhich,thePunongBarangayshalltake
possessionofsufficientpersonalpropertylocatedinthe
barangay,ofthepartyobligedtosatisfythesettlementoraward
fromtheproceedsofthesalethereofwithlegalinterestsuch
saletobeconductedinaccordancewiththeprocedureherein
provided.Ifsufficientpersonalpropertyexists,thepartyobliged
isallowedtopointoutwhichofthemshallbetakenpossession
ofaheadoftheothers.Ifpersonalpropertyisnotsufficientto
satisfythesettlementoraward,thedeficiencyshallbesatisfied
inaccordancewiththeapplicableprovisionsoftheRulesof
Court.

B.Ifitbeforthedeliveryorrestitutionofpropertylocatedinthe
barangay,thePunongBarangayshallousttherefromtheperson
againstwhomthesettlementorawardisrenderedandplacetheparty
entitledtheretoinpossessionofsuchproperty.
C.Ifitbeforthedeliveryorrestitutionofpropertylocatedinanother
barangayofthesamecityormunicipality,thePunongBarangay
issuingthenoticeshallauthorizethePunongBarangayofthe
barangaywherethepropertyissituatedtotakepossessionofthe
propertyandtoactinaccordancewithparagraph(b)hereof.
D.Ifasettlementorawarddirectsapartytoexecuteaconveyanceof
land,ortodeliverdeedsorotherdocuments,ortoperformanyother
specificact,andthepartyfailstocomplywithinthetimespecified,the
PunongBarangaymaydirecttheLuponSecretarytoperformtheact
atthecostofthedisobedientpartyandtheactwhensodoneshall
hawlikeeffectsasifdonebytheparty.

(forthesupposedNovember11,2017Lupon)andtheundated
subpoena(fortheNovember25,2017Lupon),thesamebeingwithinthe
officialcapacitytohearissuesasbroughtbyone,MrDakila.

VI. INDIRECT CONTEMPT AT
BARANGAY LEVEL
•NOTABENE:
–ButiftheBarangayCouncilsubmitsonlyNOTICESasevidences,technically
thevalidationandperusalofsubstantialevidencesfailedbeforefilingofIndirect
ContempttotheMunicipalTrialCourt.AndthatwouldqualifytoGrossNegligenceof
publicoffice.Andthatisanadministrativeoffense.WhyisitGrossNegligence?
Rememberthatthebarangaycounciliscomposedofseven(7)kagawadsandthe
BarangayCaptainasthepresidingofficer.Ifitisaunanimouslysignedbarangay
resolution,therefore,allkagawadscouldhardlyidentifyanddifferentiateSubpoenafrom
whatwecallNOTICES.Amongtheseven(7)kagawadsincludingthepresidingofficer,
nobodyattemptstodisapprovesaidresolution.Thatmeanstosaythattheentire
barangay councildoes notknow thedifferencebetween the
terms“Subpoena”and“NoticeofHearings/Invitations”;anddoesnotvalidatethe
substantialevidencesforIndirectContempt.Incontradictory,itisveryeasytoidentify
whatcourtneedsbecauseeveryKatarungangPambarangay(KP)formmustbelabeled
withthecorrespondingtermslike,Complaint’sForm,NoticeofHearing,Summonsforthe
Respondent,Subpoenaetc.EventheGrade6pupilscaneasilyidentifythoseKPForms.
Ifthisisthecase,allkagawadsandthebarangaycaptainarenotmeticulousofcourt
proceedingsinthebarangaylevel,therefore,suchtechnicalerrorwouldqualifytoGross

submittedbeforetheMunicipalTrialCourtasattachment.

VI. INDIRECT CONTEMPT AT
BARANGAY LEVEL
•Herearemyhumblesuggestionstothebarangaycouncil:(1)The
barangayshouldserveSummonstotheRespondentwithan
attachmentoftheComplaint’sFormsignedbythecomplainantand
thebrgy.captainwhichisprovidedinSection1(b)
–(1),Rule3oftheRulesimplementingtheKatarungangPambarangay,the
punongbarangayshouldissuesummons,notnoticeofhearingorinvitationsfor
dialogue;
–(2)thebarangayshouldalsoserve“Subpoena”tothepersonconcernedand
saidformmustbeprintedwiththestatement:Sanctionswillbeimposedinthe
eventtheinvitedpartyfailstoappearduringthedatesettherein.Andthesaid
personmusthavethecopy-purnisheddocumentsofSubpoenaandComplaint’s
Form;
–(3)Thebarangayshouldgivetherespondentorthewitnessachancetoexplain
his/hernon-appearancebeforethebarangaymayimposelegalsanctionswhich
theRulesrequire;

VI. INDIRECT CONTEMPT AT
BARANGAY LEVEL
–(4)BeforethebarangayshallfileanIndirectContempttosomebody,under
Section3(f)ofRule71,RulesofCourt,thebarangayshouldfirst
implementSection8(a),Rule6oftheRulesimplementingtheKatarungang
Pambarangay,arespondent’srefusalorwillfultoappearshallbesufficientbasis
fortheissuanceofacertificationforfilingcomplainant’scauseofactionincourt
orwithpropergovernmentagencyoroffice.Suchissuanceofacertification
wouldstandasproofthatthebarangayofficialsconcernedhaddonetheirdutyto
assistthepartiesinsettlingtheirdisputesamicably;
–(5)Ifhonorablekagawadswouldpassaresolution,thereshouldalwaysbea
conductofparliamentaryproceduresincludingthedefinitionoftermsespecially
whenitcomestofilingaSpecialCourtProceedingsintheMunicipalTrialCourt
andtheymustvalidatetheirevidences;
–(6)Ifthebarangaymayhavetoinitiatelegalactionthebarangaycaptainshould
alwaysrefertoalawyer,nottoapoliceofficer;
–(7) The barangay should always label all KP forms and include the corresponding
sanctions/penalty in the Subpoena Form.
