○The Industrial Disputes Act, 1947 is one of the laws governing
Industrial Relations in India. The Act came into force on 1" April,
1947andhasbeenamended severaltimessincethen.

employerand employers/employersand employees

5.Public Utility: Public utility services means railway or transport
services,postal,telegraphortelephoneservice.
6.Workmen: Any person employed in an industry for performing
manual,technicalorsupervisory work.

ObjectivesoftheAct

supremecourtareas follows
a)To promotemeasuresforsecuringand preservingamityand
good relationsbetweenthe employersand the employees.
b)Tominimizethedifferencesand togetthe dispute settled
through adjudicatoryauthorities.

settlementofindustrial disputes
d)To preventillegalstrikesand lockouts.
e)Toprovidereliefto workmeninmattersoflayoffs,
retrenchment,wrongfuldismissalsandvictimization.
f)Togivetheworkmentherightofcollectivebargainingand
promoteconciliation.

Provisions/PrinciplesoftheAct

TheIndustrialDisputesActis basedonthefollowingprinciples,
i.A permanentmachinery(Conciliation)has beensetupforthe
speedyand amicablesettlementofindustrialdisputes.
ii.Compulsoryarbitrationinpublic utilityservices,includingthe
enforcementofarbitrationawards,hasbeen recognized.
iii.Strikesand lockoutsduringpendencyofconciliationand
arbitrationproceedingsandthearbitrationawards,enforcedby
thegovernmentorderareprohibited

iv.Specifictimelimitsforvariousstagesofconciliationandarbitrationfor
eliminatingdelays.
v.Anobligationonemployerstorecognizeanddeal withrepresentativetrade
unionhasbeenimposed.
vi.Workscommitteestoprovide machineryformutualconsultationbetween
employersandemployeeshavebeensetup.
vii.Industrialdisputes maybereferredtoanindustrialtribunal whereboththe
partiestoanyindustrialdispute,applyforsuchreference wheretheappropriate
governmentconsidersitexpedienttodoso.
