INTRODUCTION

Nursing Practice Act : Defines nursing practice and establishes standards for nurses Involves basic standards which are standard in most states Is in compliance with state regulations for health care

CONT.... Includes the following content Definition of nursing Definition of LPN Elements of unprofessional conduct Functions of the state board of nursing

State Board of Nursing Regulates the practice of nursing Functions : Licensing and certifying Setting fees Establishes standards for educational programs Determine duration and renewal of licenses Carries out disciplinary actions for violators Develops programs for impaired nurses Suspends and revokes licenses and appeals

Disciplinary Process Complaint review by state board Finding of guild and innocence Suspended license Place on probation Non-renewal of license Revoke drug rehab Court review if necessary

Some Special Laws

The Suppression Immoral Traffic Act (SITA) (1956): To prevent trafficking for commercial sexual exploitation and deal with the status of sex workers According to this act , prostitutes can practice their trade privately but cannot solicit customers in public ,but organized prostitution means of living is illegal

This act protects women at their workplace either public or private ,school or college students ,patients in hospitals from sexual exploitation .

Provisions in the Maternity Benefit (Amendment ) Bill 2016 Increase M aternity Benefit from : 12 weeks to 26 weeks for two surviving children 12 weeks for more than two children 12 weeks Maternity Benefit to a ‘commissioning’ mothers and ‘adopting’ mothers Facilitate ‘work from home’ Mandatory provision of creche in establishments having 50 or more employees

PCPNDT Act (2003) This act forbid e pre-birth demonstrative procedures for assurance of the sex of the unborn child, prompting female foeticide.

Listed below are the few exceptions where pre-natal diagnostic techniques shall be conducted for detection of the following abnormalities: chromosomal abnormalities genetic metabolic diseases Family history of diseases sex-linked genetic diseases congenital anomalies any other abnormalities or diseases as may be specified by the Central supervisory board

Drugs and Cosmetic Act(1940 and 2005)and Drug and Cosmetic Rules, 1993: According to this Act - it is compulsory to test blood and blood products for transfusion for HIV

Immoral Trafficking Prevention Act (1986) There is a compulsory medical examination for detection of HIV / AIDS and provisions for compulsory testing of sex workers under this act

Dealing in specific Conditions

Use of Dangerous Drugs : Misuse of Drug Act ,1971 and Dangerous Drug Act ,1965 and 1967 – these two acts control the use of poisons in medicine.

Deaths and Dying Law identifies that death occurs when there is a greatly diminished brain function , despite the function of any other body organ .

Autopsy and Organ Donation Legally competent persons are free to donate their bodies for medical use . Consent forms are available for the purpose . Nurses must be aware of policies and procedures of institutions and laws in the state where they ask to serve as a witness for a person who wishes to give consent for a donation

Living Wills and Healthcare Surrogates These are the documents instructing the physician to hold or withdraw life –sustaining procedures whose death is imminent . For this 2 witnesses are needed The nurse should be aware of institutional policies with the patient’s self determination Act

Medicolegal cases (MLC)

MLC Cases- The persons who met a roadside accident ,factory accidents ,unnatural mishaps or any other disaster All burn cases of any cause Suspected or evident homicides ,suicides All type of poisoning cases ,sexual offences and criminal abortions Injury cases where there is likelihood of death shortly

CONT.... Any suspected foul play ,unnatural deaths ,brought as “ death on arrival ” ,found dead ,an unconscious patient without any proper history . A patient who dies immediately after admission Death in OT during MTP , delivery Alcohol or drug –related deaths Patient absconded from the ward

CONT.... Domestic violence and child abuse An admitted patient who had fall or trauma during stay and treatment in the hospital Cases referred by the court or otherwise requiring age certificate

Guidelines for dealing MLCs and Issues Availability of well –defined guidelines in each department Well equipped with functional monitors ,life –saving drugs and resuscitation equipment in emergency OPD Send the information to the civil police in writing immediately ,on admission and discharge ,the death of MLC

CONT... 4 . An duplicate copy of record with marking of “ Medicolegal Case ” should be handed over to the security officer on duty . 5. Take consent for any medical examination from the patient or legal guardian 6. All clothing worn by injured ,bloodstains ,gastric lavage ,vomits material ,bullets should be preserved ,sealed properly and handed over to police on request

CONT.... 7. All X –rays of MLCs should be taken care of ,which are of vital importance . Mark “MLC” in each & every reports All reports and and information should be kept confidential All MLC reports have to be kept under safe custody

CONT... 10. An up –to –date chart of the treatment and antidotes of all types of poisoning cases should be kept 11.Make the availability of essential investigation facilities 12.Give due care with all the precautions while administering IV fluids and transfusing bloods
