Hindrance from Km 12+180 to 12+240: Landowner not allowing clearance of landslide & excavation works for want of construction of RCC retaining wall in the stretch. Issues raised with District Admin. for resolution on 04.02.2025 and 17.02.2025. However, PMU has also directed the EPC Contractor vide letter dated 30.12.2024 for immediate commencement of protection works for resolution of the hindrances. AE approved Construction Methodology & Restoration Plan already submitted by contractor on 14.10.2024. As per directions of Hon’ble Minister, RT&H during meeting dated 21.10.2024, Shri . Harpal Singh, from Zojilla Tunnel visited the Tunnel for valued inputs on the restoration plan. Inputs shared on 02.12.2024 was incorporated by Contractor in restoration plan and submitted on 10.12.2024. Tunnel expert committee has visited the site on 04.01.2025 and report has been submitted on 20.01.2025 & the same has been forwarded to AE & contractor for incorporation of the recommendations in the revised restoration plan which is yet to be submitted by contractor. Meanwhile, after meeting chaired by Dir-T(I) on 06.02.2025 at HQ, NHIDCL, EPC Contractor summited tentative cost for COS without any basis for restoration works of tunnel, additional COS for balance length of tunnel and for micro piling at the portals. AE informed that for cost optimization, Contractor needs to submit detailed cost with item-wise break up proposed to be used in the tunnel substantiated with designs and proper justification. 3. Issues with Contractor – The works at site does not commensurate with required progress. EPC Contractor has initiated Arbitration Petition under section 11(6) of Arbitration and Conciliation Act on 24.08.2023 for resolution of disputes. SOC is filed by the claimant on 15.03.2024. SOD & Counter Claim filed by NHIDCL on 31.05.2024. Affidavit for admission / denial has been submitted by both the parties. The arbitration hearing was held on 05.12.2024 and both parties to file affidavits for witness examination within 06 weeks. Witness examination of claimant is scheduled on 21.02.2025 & 22.02.2025. Other Issues: NOC is received from DC, Kohima for 11.454 Km on 19.02.2024 with remarks- 1.920 Km is sub-judice. However, Writ Petition (Civil) No. 50/2022 involving the land acquisition issues filed by the land owners at Hon’ble Gauhati High Court, Kohima Bench was heard for final hearing on 18.11.2024 and it has been disposed off on 29.11.2024 with a direction to the respondents to take steps for payment of fair & just compensation to the landowners. Approval of Annulment of Realignment stretch affecting 1.15 Km has been approved by HQ NHIDCL on 08.04.2024 and the same has been conveyed to Contractor on 13.04.2024. P & P in accordance with the scope as per CA is yet to be submitted by contractor till date and therefore, is yet to be got approved by the AE for Km 40+580 to Km 43+454. Moreover, a meeting was convened on 18.12.2024 and 12.02.2025 with AE, contractor, PMU & RO for last 3 km to discuss the EPC Contractor ‘s Claim of COS for 2 nos. of Bridges and 1 Nos. Viaduct, however, any clear-cut response in this regard is still awaited. During site visit of the Hon’ble Chief Secretary, GON on 18.01.2025, it has been directed to complete the road stretch from Km 32+000 to Km 35+000 for vehicular movement. 4. Issues with Contractor: The Contractor has filed the Petition of Arbitration Claim under Section 17 on 15.09.2023, for seeking interim measures of protection. Last hearing regarding arguments on Section 17 was held on 04.03.2024 and the same has been disposed off on 04.03.2024. The proceedings for recording of evidences has been conducted on 31.07.2024 and next date of recording of evidences has been scheduled on 11.03.2025. Despite repeated reminders, the Damaged PMGSY Road (Ch. 40+300) affected in a length of 0.060 Km is not yet taken up by EPC Contractor for restoration. Despite repeated reminders, Contractor yet to start Landslide Mitigation measures at the landslide prone stretches. At Ch. 33+900, a minor bridge ( COS) is required at site instead of culvert as per CA. The separate proposal is initiated by contractor and currently with the AE. The progress of the Contractor was being monitored as agreed during meeting held on 21.10.2024 under the chairmanship of the Hon’ble Minister, RT&H for next two months. Accordingly, in failing to achieve any substantial progress, the EPC Contractor has been served Notice for Intention to Terminate the Contract on 18.01.2025.
