About This Presentation

PREVENTION OF CRUELTY TO
ANIMALS ACT-1960

1.ThisActmaybecalledthepreventionofCrueltytoAnimalsAct,
1960.
2.ItextendstothewholeofIndiaalongwithJammuandKashmir
afterremovalofarticle370in2019.
3.ItshallcomeintoforceonsuchdateasthecentralGovernment
may,bynotificationintheOfficialGazette,appoint,anddifferent
datesmaybeappointedfordifferentStatesandforthedifferent
provisioncontainedinthisAct.
Short title extent and commencement

Definitions:-
(a)Animal means any living creature other than a human being.
(b) Board means the Animal Welfare Board established under section 4.
(c) Captive Animal means any animal (not being a domestic animal) which
is in captivity or confinement, whether permanent or temporary, or which is
subjected to any appliance or contrivance for the purpose of hindering or
preventing its escape from captivity or confinement or which is pinioned or
which is or appears to be maimed.

DomesticAnimalmeansanyanimalwhichistamedorwhichhas
beenorisbeingsufficientlytamedtoservesomepurposefortheuse
ofmanorwhich,althoughitneitherhasbeennorisbeingnoris
intendedtobesotamed,isorhisbecomeinfactwhollyorpartly
tamed.

BreedermeansPersonincludinginstitution,whichbreedsanimalsfor
thepurposeoftransfertotheauthorizedinstitutionforperforming
experiments.

Experiment-Anyprogram/projectinvolvingexperimentsonanimal/animals
forthepurposeofadvancementbynewdiscoveryofphysiological
knowledgewhichwillbeusefulforsavingorprolonginglifeoralleviating
sufferingorforcombatinganydiseasewhetheronhumanbeingsoranimals.

Committee-Anyindividual,company,firm,corporation,institutionother
thanschoolsuptohighersecondarylevel,whichperformsexperimentson
animals.
InstitutionalAnimalEthicsCommittee-Abodycomprisingofagroupof
personsrecognizedandregisteredbythecommitteeforthepurposeof
controlandsupervisionofexperimentsonanimalperformedinan
establishmentwhichisconstitutedandoperatedinaccordancewith
proceduresspecifiedforthepurposebythecommittee.

Objective :-
1.Inmoderndayresearchanimalsareimportantexperimentalsubjects
becauseofphysiologicalsimilaritytohumanbeings.
2.Toestablishsafetyandefficacyofdrugsexperimentsonanimal
unavoidable.
3.ClinicaltrialsunderD&Cactprecededbydatagenerationonanimal
toxicologyandpharmacology.
4.Impliesthatanimalsmaybesubjectedtopain/injuryisunethical.
5.Thepreventionofcrueltytoanimals’act1960hasbeenenactedto
preventunnecessarypainonsufferingonanimals.
6.“Breedingofandexperimentsonanimals’rules,1998”havebeen
incorporatedinthisact.

Cruelty to animals includes:-
1.Subjectinganyanimaltounnecessarypainorsufferingortreatment,or
2.Employinganyunfitanimalforworkorlabour,orWillfullyand
unreasonablyadministeringanyinjuriousdrugorsubstancetoany
domesticorcaptiveanimal,or
3.Keepingorconfininganyanimalinanycageofinsufficientsizenot
permittingitreasonablemovement,or
4.Failuretoprovideanyanimalwithsufficientfood,drinkorshelterby
itsowner,or
5.Needlesslyorkillinganyanimalinanunnecessarilycruelmanner.

INSTITUTIONAL ANIMAL ETHICS
COMMITTEE
EveryInstitutionalAnimalEthicsCommitteeshallinclude:-
1.Abiologicalscientist,
2.Twoscientistsfromdifferentbiologicaldisciplines,
3.Aveterinarianinvitedinthecaseofanimals,
4.Thescientistinchargeofanimal’sfacilityoftheestablishment
concerned,
5.Ascientistfromoutsidetheinstitution,
6.Anon-scientistsociallyawaremember,and
7.AnomineeofCPCSEA
Aspecialistmaybeco-optedwhilereviewingspecialprojectsusing
hazardousagentssuchasradioactivesubstancesanddeadly
microorganisms

IAEC has been designed to secure the following objectives:-
1.Experimentsshallbeperformedineverycasebyorunderthe
supervisionofapersondulyqualifiedinthatbehalf,thatis,Degreeor
DiplomaholdersinVeterinaryScienceorMedicineorLaboratory
AnimalScienceofaUniversityoranInstitutionrecognizedbythe
Governmentforthepurposeandundertheresponsibilityoftheperson
performingtheexperiment;
2.Thatexperimentsareperformedwithduecareandhumanityandthatas
faraspossibleexperimentsinvolvingoperationsareperformedunder
theinfluenceofsomeanestheticofsufficientpowertopreventthe
animalsfeelingpain;
3.Thatanimalswhich,inthecourseofexperimentsundertheinfluenceof
anesthetics,aresoinjuredthattheirrecoverywouldinvolveserious
suffering,areordinarilydestroyedwhilestillinsensible;

4.Thatexperimentsonanimalsareavoidedwhereveritispossibletodoso;
asforexample;inmedicalschools,hospitals,collegesandthelike,if
otherteachingdevicessuchasbooks,models,filmsandthelike,may
equallysuffice;
5.Thatexperimentsonlargeranimalsareavoidedwhenitispossibleto
achievethesameresultsbyexperimentsuponsmalllaboratoryanimals
likeguinea-'pigs,rabbits,mice,ratsetc;
6.that,asfaraspossible,experimentsarenotperformedmerelyforthe
purposeofacquiringmanualskill;
7.thatanimalsintendedfortheperformanceofexperimentsareproperly
lookedafterbothbeforeandafterexperiments;
8.thatsuitablerecordsaremaintainedwithrespecttoexperiments
performedonanimals.

TheprimarydutyofIAECistoworkforachievementoftheobjectives
asmentionedabove:-
a)IAECwillreviewandapprovealltypesofresearchproposalsinvolving
smallanimalexperimentationbeforethestartofthestudy.
b)Forexperimentationonlargeanimals,thecaseisrequiredtobe
forwardedtoCPCSEAinprescribedmannerwithrecommendationof
IAEC.
c)IAECisrequiredtomonitortheresearchthroughoutthestudyandafter
completionofstudythroughperiodicreportsandvisittoanimalhouse
andlaboratorywheretheexperimentsareconducted.
d)Thecommitteehastoensurecompliancewithallregulatory
requirements,applicablerules,guidelinesandlaws.
