Prison Population (O vercrowding) There are 83,107 inmates against a maximum holding capacity of 42,459 in the 68 jails in Bangladesh, according to the Department of Prisons’ statistics for the month of March. Who are they ? BDR mutiny, narcotics, mobile courts, NI Act, death row inmates. Eight out of every 10 prisoners in Bangladesh are in jail either as pre-trial detainees or on remand, jail statistics show. This makes Bangladesh one of the top three countries of the world with the highest proportion of detainees followed by Libya (90%) and San Marino (83%). The prison population is overflowing as the country’s 68 jails are housing inmates twice their capacity.
there are over 71,000 people in pre-trial/remand imprisonment in Bangladesh, constituting 81.3% of total prisoners. Two decades ago, the number of pre-trial and remand imprisoned people was 44,368, amounting to 74.6% of the total jail population. In neighbouring India, pre-trial detainees account for 69% of the country’s total number of imprisoned people. The rate is 62% in Pakistan and 55% in Nepal.
In the overflowing jails of Bangladesh, where every two people have to share facilities meant for one, inmates seldom receive adequate medical attention. As many as 29 out of 141 posts of jail physicians are lying vacant while half the posts of nurses and pharmacists remain unoccupied as well. They hardly have any gym, proper nutrition, sanitation, entertainment, rehab program, skill development, counselling, therapy , reintegration project How is the life in prison ? What are the rights of the prisoners ? Conjugal right?

Death Row Convicts / Condemned cell A t present ( untill november 2022- bangladesh have a total of 2162 death row inmates of which 2099 are males ad 63 are females. I n india, the number is only 539. I n 2015 this number was 918 A ccording to law a death referrence to the High Court Division is a must, no matter the convicts prefer an appeal or not. T he death referrence bench of the HCD is hearing referrences of 2016 now. P eople convicted this year will be heard at the end of 2032 A rule is pending as to the legality of keeping death row inmates in condemned cell untill their death referrence is allowed.
D eath row inmates and execution statistics worldwide In 2022, four countries including Kazakhstan, Papua New Guinea, Sierra Leone and the Central African Republic abolished the death penalty for all crimes, bringing the total number of abolitionist countries up to 112. In practice, the total number of countries that don’t executes is 148 In 2021 total number of executions are 579 of which around 90% consisted of by Iran, Egypt, Saudi Arabia and Syria. P rison worldwide Countries with the largest number of prisoners per 100000 people- El Salvador 605, Rwanda 580, Turkmenistan 576, Samoa 538, USA 505, Russia 304, China 119, India 40, Bangladesh 46. According to the latest available data at the World Prison Brief on May 7, 2023, the United States has the sixth highest incarceration rate in the world, at 531 people per 100,000. A lternatives to jail C ommunity sentencing F ine P robation Periodic detention - Periodic detention is a type of custodial sentence under which the offender is held in prison periodically, for example between Friday and Sunday evenings each week, but is at liberty at other times. Promoted by prison reformers as an alternative to imprisonment, periodic detention drew praise for allowing offenders to continue working, maintain family relationships, and avoid associating with more dangerous criminals in traditional prisons. It was also considerably less expensive to administer. Juvenile detention Alternatives for minors restorative justice in the forms boot camps and military programs adopted into public education options is starting to be considered. A variety of programs for anger management, self esteem boosting etc. have been developed Sex offending , a public health issue? P robation T he probation of offenders Act 1960 The following courts shall be the courts empowered to exercise powers under this Ordinance, namely:- the High Court Division, A Court of Sessions; a District Magistrate; a Magistrate of the 1st Class; and any other magistrate especially empowered in this behalf. A Court may exercise powers under this Ordinance, whether the case comes before it for original hearing or on appeal or in revision.
P robation continued Where a Court by which a person, not proved to have been previously convicted, is convicted of an offence punishable with imprisonment for not more than two years is of opinion, having regard to:-the age, character, antecedents or physical or mental condition of the offender, and the nature of the offence or any extenuating circumstances attending the commission of the offence, that it is inexpedient to inflict punishment and that a probation order is not appropriate, the court may, after recording its reasons in writing, make an order discharging him after its admonition, or, if the court thinks fit, it may likewise make an order discharging him subject to the condition that he enters into a bond, with or without sureties, for committing no offence and being of good behaviour during such period not exceeding one year from the date of the order as may be specified therein. If the accused fails to follow the condition , he will be tried for the original charge.
