What Is the Meaning of
Graft & Corruption?
Technically,corruptioncoversanentirehostof
abuses,ofwhichgraftisone.Graftandcorruptionare
chargesthataretypicallyleveledathighly-placed
governmentofficials,whoareabletousepublicfunds
toimprovetheirownfortunesduetoincreased
access,influence,knowledgeorpowerthatcomes
with an elevated position.

togainmoney,property,
etc.dishonesty
graft is committed by an
individual
associated with
dishonesty,lackof
integrityandbribery
involves the collusion of

Anti-Graft Laws

leadmodestlives.

Republic Act 6713

networthandfinancialconnections.Italsorequires
newpublicofficialstodivestownershipinanyprivate

Republic Act No. 7080 (Act
Defining and Penalizing the Crime
of Plunder)
Thisactpenalizesanypublicofficerwhobyhimselfor
inconnivancewithmembersofhisfamily,relativesby
affinityorconsanguinity,businessassociates,
accumulatesoracquiresill-gottenwealth,througha
combinationofseriesofeventcriminalacts,an
aggregateamounttototalvalueofatleastfiftymillion
pesos(P50,000,000).

has pending official business with him during the
pendency thereof or within one year after

Government,orgivinganyprivatepartyany
unwarrantedbenefits,advantageorpreferenceinthe
dischargeofhisofficial,administrativeorjudicial
functionsthroughmanifestpartiality,evidentbadfaith
orgrossinexcusablenegligence.Thisprovisionshall
applytoofficersandemployeesofofficesor
governmentcorporationschargedwiththegrantof
licensesorpermitsorotherconcessions.

degree,ofthePresidentofthePhilippines,theVice-
PresidentofthePhilippines,thePresidentofthe
Senate,ortheSpeakeroftheHouseof
Representatives,tointervene,directlyorindirectly,in
anybusiness,transaction,contractorapplication
withtheGovernment

Section 7.Statement of
Assets and Liabilities
Everypublicofficer,withinthirtydaysaftertheapprovalof
thisActorafterassumingoffice,andwithinthemonthof
Januaryofeveryotheryearthereafter,shallprepareand
filewiththeofficeofthecorrespondingDepartmentHead,
orinthecaseofaHeadofDepartmentorchiefofan
independentoffice,atruedetailedandswornstatement
ofassetsandliabilities,includingastatementofthe
amountsandsourcesofhisincome,theamountsofhis
personalandfamilyexpensesandtheamountofincome
taxespaidforthenextprecedingcalendaryear.

Section 8. Dismissal due to
Unexplained Wealth
Ifinaccordancewiththeprovisionsof
RepublicAct1379(ill-gottenwealth),a
publicofficialhasbeenfoundtohave
acquiredduringhisincumbency,whether
inhisnameorinthenameofother
persons,anamountofpropertyand/or
moneymanifestlyoutofproportionto
hissalaryandtohisotherlawfulincome,
thatfactshallbeagroundfordismissal
orremoval.

Section 9.Penalties for
Violations
(a)Anypublicofficerorprivatepersoncommittingany
oftheunlawfulactsoromissionsenumeratedin
Sections3,4,5and6ofthisActshallbepunishedwith
imprisonmentfornotlessthan1yearnormorethan10
years,perpetualdisqualificationfrompublicoffice,and
confiscationorforfeitureinfavoroftheGovernmentof
anyprohibitedinterestandunexplainedwealth.

(b)AnypublicofficerviolationanyoftheprovisionsofSection7
ofthisActshallbepunishedbyafineofnotlessthanone
hundredpesosnormorethanonethousandpesos,orby
imprisonmentnotexceeding1year,orbybothsuchfineand
imprisonment,atthediscretionoftheCourt.
**Theviolationofsaidsectionproveninaproperadministrative
proceedingshallbesufficientcauseforremovalordismissalof
apublicofficer,evenifnocriminalprosecutionisinstituted
againsthim.

Courts

TheSandiganbayanistheanti-graftcourtof
thePhilippines.Ithasjurisdictionoverciviland
criminalcasesinvolvinggraftandcorrupt
practicesandsuchotheroffensescommitted
bypublicofficersandemployees.Itisincharge
ofmaintainingmorality,integrityandefficiency
inthepublicservice.

Ombudsman (OMB)
CONSTITUTIONAL ANTI -
CORRUPTION BODIES
The Office of the Ombudsman (OMB)
TheOfficeoftheOmbudsmaninvestigates
andactsoncomplaintsfiledagainstpublic
officialsandemployees,andservesasthe
“people’swatchdog”ofthegovernment.

The Civil Service
Commission (CSC)
TheCSCbeingthecentralpersonnelagencyof
thegovernment,ithasjurisdictionover
administrativecasesincludinggraftand
corruptionbroughtbeforeitonappeal,in
accordancewithpublicaccountability.

The Commission on Audit
(COA)
The COA is the watchdog of the financial operations of the government. It is
empowered to examine, audit, and settle all accounts pertaining to the
revenue and receipts of, and expenditures or uses of funds and property
under the custody of government agencies and instrumentalities. It shall
promulgate accounting and auditing rules and regulations for the prevention
and disallowance of irregular, unnecessary, excessive, extravagant, or
unconscionable expenditures, or use of government funds and properties.

Section 11.Prescription
of Offenses
All offenses punishable under this Act
shall prescribe in ten years

Section 12.Termination of
Office
Nopublicofficershallbeallowed
toresignorretirependingan
investigation,criminalor
administrative,orpendinga
prosecutionagainsthim,forany
offenseunderthisActorunder
theprovisionsoftheRevised
PenalCodeonbribery.

Section 13.Suspension and loss
of benefits.
Anypublicofficeragainstwhomanycriminal
prosecutionunderavalidinformationunderthis
ActorundertheprovisionsoftheRevisedPenal
Codeonbriberyispendingincourt,shallbe
suspendedfromoffice.Shouldhebeconvictedby
finaljudgment,heshallloseallretirementor
gratuitybenefitsunderanylaw,butifheis
acquitted,heshallbeentitledtoreinstatement
andtothesalariesandbenefitswhichhefailedto
receiveduringsuspension,unlessinthe
meantimeadministrativeproceedingshavebeen
filedagainsthim.

Section 14.Exception
Unsolicitedgiftsorpresentsofsmallorinsignificant
valueofferedorgivenasamereordinarytokenof
gratitudeorfriendshipaccordingtolocalcustomsor
usage,shallbeexceptedfromtheprovisionsofthisAct.
