State Board For The Prevention And Control Of Air Pollution Powers And Function

State Pollution Control Board: The State Board for the Prevention and Control of Air Pollution, often referred to as the State Pollution Control Board (SPCB), is a regulatory authority responsible for implementing and enforcing air pollution control measures within a specific state or region. Its primary objectives include monitoring air quality, issuing permits for industries and vehicles, setting emission standards, and taking corrective actions to mitigate air pollution.SPCBs typically operate under the guidance of national environmental protection laws and regulations, such as the Air (Prevention and Control of Pollution) Act, 1981 in India. They play a crucial role in ensuring compliance with these laws to safeguard public health and the environment from the adverse effects of air pollution.

State Board Prevention And Control Of Air Pollution: Monitoring and Assessment: SPCBs monitor ambient air quality through a network of monitoring stations to assess pollution levels and identify areas of concern. They analyze data on pollutants like particulate matter (PM), sulfur dioxide (SO2), nitrogen dioxide (NO2), carbon monoxide (CO), and ozone (O3). Regulation and Permitting: SPCBs regulate industries, power plants, vehicles, and other sources of air pollution by issuing permits, setting emission standards, and enforcing compliance with pollution control measures. They conduct inspections and audits to ensure adherence to regulations.

Emission Standards: SPCBs establish emission standards for different industries and sectors to limit the release of harmful pollutants into the atmosphere. These standards help in reducing pollution levels and protecting public health. Public Awareness and Outreach: SPCBs engage in public awareness campaigns, educational programs, and community outreach initiatives to raise awareness about air pollution, its health impacts, and the importance of pollution control measures. They collaborate with stakeholders, including industries, government agencies, NGOs, and the public, to promote environmental stewardship.

Research and Development: SPCBs conduct research and development activities to improve air quality monitoring techniques, develop innovative pollution control technologies, and enhance regulatory frameworks for better pollution management. Collaboration with Government Agencies and NGOs: SPCBs collaborate with other government agencies, non-governmental organizations (NGOs), and stakeholders to address environmental concerns and promote sustainable development.

Environmental Impact Assessment (EIA): T hey conduct assessments to evaluate the potential environmental impacts of proposed projects and developments. Enforcement of Environmental Laws: SPCBs enforce laws related to pollution control, waste management, and environmental protection. Issuing Permits and Licenses: They grant permits for the establishment and operation of industries, ensuring compliance with environmental standards. Emergency Response: SPCBs are often involved in responding to environmental emergencies such as chemical spills or industrial accidents, coordinating cleanup efforts and mitigating impacts on the environment and public health.

POWERS AND FUNCTIONS

Powers: 1. No person shall without the previous consent of the State Board, establish or operate any industrial plant in an Air Pollution Control Area[5]. 2. State Board may make inquiry in respect of application for consent referred above[6]. 3. State Board may grant or refuse the application referred above[7]. 4. State Board shall have right to enter, at all reasonable times with such assistance as it considers necessary to any place[8].

5. State Board is empowered to call for any information from the occupier or any person carrying on any industry or operating any control equipment or industrial plant[9].
6. State Board shall have right to inspect the premises where industry, control equipment or industrial plant is being carried on or operated[10].
7. State Board has right to take, for the purposes of analysis, samples of air or emission from any chimney, flue or duct or any other outlet[11].

Functions: A. To plan a comprehensive programme for the prevention, control or abatement of air pollution and to secure the execution thereof. B. To advise the State Government on any matter concerning the prevention, control or abatement of air pollution. C. To collect and disseminate information relating to air pollution. D. To collaborate with Central Board in organizing the training of persons engaged or to be engaged in programmes relating to prevention, control or abatement of air pollution and to organize mass education programme relating thereto.

E. To inspect, at all reasonable times, any control equipment, industrial plant or manufacturing and to give, by order, such directions to such persons as it may consider necessary to take steps for the prevention, control or abatement of air pollution.
F. To inspect Air Pollution Control Areas at such intervals as it may think necessary, access the quality of air therein and take steps for the prevention, control or abatement of air pollution in such areas.
G. To lay down, in consultation with the Central Board and having regard to the standards of the quality of air laid down by the Central Board, standards for emission of air pollutants into the atmosphere from industrial plants and automobiles or for the discharge of any air pollutant into the atmosphere from any other source whatsoever not being a ship or an aircraft. Provided that different standards for emission may be laid down under this clause for different industrial plants having regard to the quantity and composition of emission of air pollutants into the atmosphere form such industrial plants.

H. To advise State Government with respect to the suitability of any premises or location for on any industry which is likely to cause air pollution I. To perform such other functions as may be prescribed or as may from time to time be entrusted to it by the Central Board or the State Government.
J. To do such other things and to perform such other acts as it may think necessary for the proper discharge of its functions and generally for the purpose of carrying into effect the purposes of the Act. A State Board may establish or recognize a laboratories to enable the State Board to perform its functions under this Section efficiently.
