This act may be called the “Tamil Nadu Professional Civil Engineers Act 2023 ” It extends to the whole of the state of Tamil Nadu. KEY POINTS IN GUJARAT COUNCIL (GCPCE) Certificate of Practice Preparation and maintenance of register (c) on whom a diploma in civil engineering is conferred by a recognized engineering institution and who possesses experience of working as a civil engineer for a period of not less than six years after such conferment, or ( d) who possesses such other qualification as is recognized as being equivalent to the qualification mentioned in clause (a) or (b) and experience of working as a civil engineer for such period as may be prescribed byregulations , shall be eligible to appear for such examination as may be prescribed by regulations, on payment of such fees as may be prescribed by rules, and held by the Council and on passing such examination, such person shall be entitled to have his name entered in the register . FINANCIAL COMMITMENTS Every person entitled under sub-section (1) or (2) to have his name entered in the register shall have his name entered in the register on application being made and granted in such manner as may be prescribed by regulations and on payment of such fees shall be Rs. 15000 fees as may be prescribed by rules. Every such person shall pay annual fee Three thousand rupees as may be prescribed by rules and such fee shall be payable on or before the 1st day of April in each year.
KEY POINTS IN GUJARAT COUNCIL (GCPCE) Removal from register Surrender of Certificate The Council may, by order, remove from the register the name of any professional civil engineer-- a) from whom a request has been received to that effect, or b) who has died since the last publication of the register, or c) who has failed to pay annual fee for three consecutive years. Subject to the provisions of this section, the Council may order that the name of any professional civil engineer shall be removed from the register where it is satisfied, after giving him a reasonable opportunity of being heardand after such further inquiry, if any, as it may think fit to make-- a) that his name has been entered in the register by error or on account of misrepresentation or suppression of a material fact; or b ) that he has been convicted of any offence which, in the opinion of the Council, involves moral turpitude or has been guilty of any infamous conduct in any professional respect or has violated standards of professional conduct and etiquette or the code of ethics which, in the opinion of the Council , renders him unfit to be kept in the register; c) that he is an undercharged insolvent; or d) that he has been adjudged by a competent Court to be of un sound mind.
KEY POINTS IN GUJARAT COUNCIL (GCPCE) Fund of Council There shall be established a Fund under the management and control of the Council, consist of all moneys received by the Council and out of which shall be met all expenses and liabilities properly incurred by the Council. The Council may invest any money for the time being standing to the credit of the Fund in any Government security or in any other security approved by the State Government. The Council shall keep proper accounts of the Fund distinguishing capital from revenue . The annual accounts of the Council shall be subject to audit by an auditor to be appointed annually by the Council. As soon as may be practicable at the end of each financial year, but not later than the thirtieth day of September of the year next following, the Council shall cause to be published in the Official Gazette, a copy of the audited accounts and the report of the Council for that year and copies of the said accounts and report shall be forwarded to the State Government. The Fund shall consist of- ( a) all moneys received from the State Government by way of grant; ( b) any sums received under this Act whether by way of fee or otherwise. Notwithstanding anything contained in any law for the lime being in force, after the expiry of two years from the commencement of this Act, no person shall certify an engineering design of- a building the plinth area of which exceeds one hundred and forty square meters; or a building the height of which exceeds the normal height of a building having the ground floor and first floor; or a building which does not have load bearing type masonry structure; or a building which is a part of a larger housing project comprising not less than three buildings, notwithstanding the plinth area of such building is one hundred and forty square meters, or less than one hundred and forty square meters; unless he is a professional civil engineer. Any person contravening the provisions of sub-section shall , without prejudice to any other proceedings which may be taken against him, be punishable with fine which may extend on first conviction to five thousand rupees and on any subsequent conviction with imprisonment which may extend to six months or with fine not exceeding ten thousand rupees or with both.

Ex-Officio members( Rtd Engineer) shall be appointed by the State Government Two board members to be co-opted by the board of Council from amongst Professional civil engineers. POWERS AND DUTIES OF THE PRESIDENT AND VICE-PRESIDENT 1. The President shall exercise general control and supervision over the affairs of the Council. 2. The President have power to pass interim orders in revisional and other matters arising out of the supervisory jurisdiction of the Council. 3. The President have power to punish any employee of the Council by way of censure or reprimand and may initiate proceedings for suspension, removal or dismissal . 4. The President is the authority to sanction the disbursement of salaries of the staff and to order payment of any bill outstanding against the Council. 5. The Vice-President shall exercise all the powers and discharge all the functions of the President in his absence and under his direction. 6. On a motion of "No Confidence" brought by, not less than 3/4th Members of the Tamilnadu Council of Professional Civil Engineers (TCPCE). And in voting such "No Confidence Motion" will passed when majority is more than 2/3rd of the total number of members, the President or Vice-President or any other office bearer against whom the motion is passed shall cease to hold office forthwith. 7. Notwithstanding anything contained in the Act or the rules made thereunder, the President or Vice-President shall not preside over the meeting in which motion of "No Confidence " is discussed against him and such meeting shall be convened on a notice of at least one month. The President or the Vice-President shall have the right to vote, speak or take part in the proceeding of the meeting. Establishment and composition of Council
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) ELECTION OF BOARD MEMBERS OF THE COUNCIL The election of a Board member of the Council shall be conducted by the Secretary of the Council who shall act as the Returning Officer. Existing President can form an election committee of five amongst existing board member of Council. The name of each candidate for the election shall be proposed by one member and seconded by another member of the Council at the meeting. No member shall propose or second more than one name. If the number of candidates duly nominated is more than one, there shall bean election by secret ballot or postal voting. A copy of the Order of the existing board of Council or the election Committee may be sent to the State Government. The State Government concerned shall cause such fresh election to be held as may be ordered under sub-rule (3) of this rule. ELECTION OF PRESIDENT AND VICE-PRESIDENT The election of the President and Vice-President shall be held at a meeting of the Council . EXPIRY AND TERM OF OFFICE FOR PRESIDENT, VICE-PRESIDENT AND MEMBERS OF COMMITTEES The President or the Vice- President shall hold office for a period of two years, or until his term of office as member of the Tamilnadu Council of Professional Civil Engineers (TCPCE)ceases, whichever is earlier. Election and Term of office

The President, the Vice-President and other Board members of the Council shall be entitled to such fees and allowances as the Council may, with the previous sanction of the State Government, fix in this behalf All the persons appointed under this section shall be the employees of the Council. There shall be a Fund established under the management and control of the Council by the payments received by the Council and out of which shall be met all expenses and liabilities properly incurred by the Council. The Council shall prepare and maintain the accounts of the Fund in such form and manner as may be prescribed by regulations . The annual accounts of the Council shall be subject to audit by an auditor who is a Chartered Accountant within the meaning of the Chartered Accountants Act, 1949, to be appointed annually by the Council As soon as may be practicable at the end of each financial year, but not later than the thirtieth day of September of the following year, the Council shall publish in the Official Gazette, a copy of the audited accounts and the report of the Council for that year and copies of the said accounts and report shall be forwarded to the State Government. The Fund shall consist of— all Funds received from the State Government by way of grant or gift; any sums received under this Act whether by way of fee or otherwise. All Funds standing at the Council which cannot be used immediately shall be deposited in any scheduled bank specified in the Second Schedule to the Reserve Bank of India Act, 1934. KEY POINTS IN PROPOSED COUNCIL ( TCPCE) PROFESSIONAL SENIOR ENGINEER(PSE ): Registration based on their academic qualifications and experience, Engineers shall be "Registered" in “Professional Senior Engineer Grade”. The eligibility criteria for registration and the “Scope of Work” which can be entrusted to the Engineer are given below. Scope of Work: To prepare Plans, Designs, and Drawings for any type of buildings and Construction developments including High rise buildings and any type of Infrastructures developments and layout developments without any limit; Eligibility and Experience: (a) M.E. in Civil Engineering or equivalent Civil Engineering degree with a minimum of 10-year experience (b) B. E. Civil Engineering or A.M.I.E. Civil Engineering with a minimum of 15-year experience (after obtaining the degree) in professional work . 2. PROFESSIONAL ENGINEER (P.E.): Registration based on their academic qualifications and experience, Engineers shall be "Registered" in “Professional Engineer Grade”. The eligibility criteria for registration and the “Scope of Work” which can be entrusted to the Engineer are given below. Scope of work: To prepare Plans, Designs, and Drawings for Non-High rise buildings and Construction developments (i.e. up to 18.30m. in height) and Up to 10 Crore worth Infrastructures developments and layout developments on lands up to 25 Acre. in extent. Eligibilityand Experience: (a) M.E., Civil Engineering or equivalent civil engineering degree with a minimum of 5-year experience (b) B.E. Civil or equivalent degree or A.M.I.E. with a minimum of 10 year experience (after obtaining the degree) in professional work. (c) Diploma in Civil Engineering with 20-year experience (after obtaining the diploma) in professional work, or Registrations
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) PRACTICING ENGINEER (PR.E.) Registration based on their academic qualifications and experience, Engineers shall be "Registered" in “Practicing Engineer Grade”. The eligibility criteria for registration and the “Scope of Work” which can be entrusted to the Engineer are given below. Scope of work: To prepare plans, designs and drawings for small Construction Developments Maximum Height – 12 M up to 16 dwellings or up to 300 square meters of commercial use and excluding the above-mentioned structures for Professional Senior Engineers and Professional Engineers and layout developments on lands up to 10 Acres in extent . KEY POINTS IN PROPOSED COUNCIL ( TCPCE) ATTENDING REGIONAL SEMINAR/WORKSHOP ATTENDANCE IS IMPORTANT FOR RETAINING THE MEMBERSHIP . For renewal of council membership, every member should obtained twenty four points per annum Attending Live seminar or Workshop – two points per hour, Attending Online Seminar – one point per hour Presenting a Research Paper or Publishing a Research paper in reputed journal – twelve Points Submitting a dissertation on Own Construction Project (with evidence) – twelve Points Experience Certificate is not required for the First two Years. Beyond two years’ Experience certificate is Compulsory from the Registered Council Member. The Live seminar points should be minimum fifty percent of total points per annum. When training civil engineers, teaching can be done at any educational institution affiliated with a university. The purpose of the University Grants Commission Act, 1956 (3 in 1956), and the All India Council for Technical Education (AICTE) Act, No. 52 of 1987, is that he may engage in teaching up to three hours a day in civil engineering technical education. Do not engage for more than three hours. If any professional civil engineer is employed in such educational institution to teach civil engineering technical education, such employment, if the time he engages in teaching does not exceed three hours, shall be deemed subject to Council law. The salary payable by a civil engineer (either on a fixed amount or on the basis of part-time pay or any other form) should be part-time employment. PERFORMANCE APPRAISAL FOR PROFESSIONAL CIVIL ENGINEERS
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) CIVIL ENGINEERS CONFERENCE SHALL BE ORGANIZED REGULARLY FOR THE COUNCIL MEMBERS FOR UPDATING KNOWLEDGE AT REGULAR INTERVALS, WHERE THE SUITABLE PLACE AND TIME AS DECIDED BY THE COUNCIL. The expense of the State Conference shall be borne completely by the Organizing body. The Council shall not be responsible for any part of the expense. The Conference is open to all Members of TCPCE . There shall be an Organizing Committee which may be formed by the Organizing body to conduct the Annual General Body and Conferences. The Organizing body of the Conference shall appoint Office Bearers and Sub- Committees for conducting the Conference. They shall be the members of the member associations affiliated under professional affiliates or members of the associations affiliated with federations registered under professional affiliates. The Organizing body shall decide the rate of Fees to be levied on the Organizing Committee members also the delegate Fees to be collected from the members attending the Conference. The State President, State Secretary, Finance Secretary, and Past State Presidents shall not be charged any Fee. They shall be provided free accommodation and food. Any expenses incurred by the Principle Office bearers of the Council towards the Conference shall be met by the branch holding the Conference. The Council shall not be liable for any loss incurred by the Host association affiliated under professional affiliates or association affiliated with federations registered under professional affiliates. The Organizing Committee shall submit a Statement of Accounts relating to the Annual Conference to the State Council within 90 days from the Conference Date. The Council shall render every possible assistance to the Organizing Committee of the Conference. The Council Vice President shall render all possible assistance to the host association affiliated under professional affiliates or association affiliated with federations registered under professional affiliates holding the Conference and he shall be in constant touch with them. Civil Engineering Dept. Professors, Lecturers, Scholars, and Final Year Students may be permitted to the Conference at a concessional delegate fee viz., not more than 50% of the Delegate fees Fixed for the regular members. KEY POINTS IN PROPOSED COUNCIL ( TCPCE) The Council may impose regulations to prescribe the standards of professional conduct and etiquette and a code of ethics for professional civil engineers. Regulations made by the Council, may specify which violations thereof shall constitute infamous conduct in any professional respect, that is to say, professional misconduct, and such provisions shall affect anything contained in any law for the time being in force. When on receipt of a complaint made to it, the Council is prima facie of the opinion that any professional civil engineer has been guilty of professional misconduct which, if proved, will render him unfit to practice as a professional civil engineer, and the Council may hold an inquiry in such manner as may be prescribed by rules. If , after conducting an inquiry into a professional civil engineer under the Council, may, by order, reprimand a professional engineer if he believes that the professional civil engineer is guilty of professional malpractice, or suspend him from practice as a professional engineer You can delete the name, or send other orders that you think are appropriate. KEY POINTS IN PROPOSED COUNCIL ( TCPCE) The Council may at any time approval Professional Society as a Professional Affiliate, provided that the TCPCE is satisfied that: It has been stable for at least ten years and possible in all cases, and has been consistent with the unionization of professional associations for at least ten years. It prescribes such standards of conduct for its members (if any),as are acceptable to the Council; It is not a trade association and is not, in the opinion of the Council, engaged (as a principal part of its activities) in activities carried on by trade unions or employee's organisations Its principal object or, if the Council should so determine, one of its principal objects is the advancement of engineering, technology or applied science or of the better utilization of engineers in industry and commerce (which may include education and training thereof); In nature it consists of academic and social activities, and should keep engineers in its specific engineering field in development activities (if any); It has under taken that it will not seek to change its governing document, or any related requirements in matters relating to qualification, registration or any other relevant matters required of it by the Council without prior consultation with the Council. APPROVAL OF PROFESSIONAL AFFILIATES
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) Every building above 100 Square meters should be maintained with the interval of 5 years. The council member should issue the maintenance certificate in the interval of Five years. The fees structure for the maintenance certificate should be fixed by the council. The fees structure for the maintenance certificate is not more than Rupees Ten per square Meter for residential Buildings at the maximum of Rupees Two Thousands for each dwelling unit and Rupees Fifteen per square meter for Commercial buildings at the maximum of Rupees Five thousands for each block or building after the commencement of this act. The council may revise the fees structure at regular interval MAINTANANCE AND REGULATION OF EXISTING BUILDINGS
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) The activities of the PCEPA shall be confined to the State of Tamilnadu only. Only members of TCPCE are eligible to become members of this Act. Only an individual Engineer can be admitted to this act and no Firm or Company can be a member of this Act. Even if an engineer heads such an administration, the act of failing to renew members does not protect the individual engineer. To protect from any incident that occurs during Professional duty, the concerned member must be a member of Professional Civil Engineers Protection Act of TCPCE For the renewal of membership of any member, who has been penalized by any competent authority, shall be at the sole discretion of the Council. The concerned member shall inform the President and the Board members of the act with in ten days of the occurrence of the incident. The member shall obey instructions given by the Council of the act regarding the case. In Any Dispute and Incident related with council members, nobody should take action against members without the knowledge of Council. PROFESSIONAL CIVIL ENGINEERS PROTECTION ACT (PCEPA) of TCPCE
KEY POINTS IN PROPOSED COUNCIL ( TCPCE) Subject to the provisions of this Act, the Council shall perform the following functions namely:- (a) to manage the property of the Council; (b) to manage and control the fund established under sub-section (5) of section (5); (c) to keep proper accounts of the fund; (d) to hold examinations prescribed by regulations; (e) to prepare and maintain a register of professional civil engineers; (f) to grant or refuse certificate of practice; (g) to levy fees from civil engineers applying for registration of professional civil engineers and others; (h) to remove from the register the names of professional civil engineers and to restore to the register the names of professional civil engineers which have been removed ; ( i ) to prescribe standards of professional conduct and etiquette and codes of ethics for professional civil engineers. (j) to exercise disciplinary powers conferred by this Act and (k) to perform such other functions as are laid down in this Act and in the rules and regulations . FUNCTION OF COUNCIL.

Only members of the TCPCE are eligible to become the members of this Scheme. The Scheme covers reimbursement of Hospitalization Expenses for illness/diseases or injury sustained the member, spouse, or children below twenty one years. The scheme shall reimburse rupees Five Lakhs for the Hospitalization expenses incurred in that year for the member and spouse . Also shall reimburse rupees Two Lakhs for the Hospitalization expenses incurred in that year for the two children below twenty one years. (Renewal of Subscription without break is essential) The Scheme shall not be liable to make any payments for the following. Any hospitalization expenses incurred in the first one hundred and eighty days from the date of joining in TCPCE Family insurance scheme. . Cost of spectacles and contact lenses, hearing aids. Dental treatment or surgery of any kind unless requiring hospitalization. Charges incurred at Hospital or Nursing Home primarily for diagnostic .
