TYPES OF WILLS
The Spanish law prescribes 3 types of
wills:
open;
closed;
holographic.

WHO CAN SIGN A WILL?
A will in Spain can be signed by
Spanish citizens and foreigners.

However, foreigners can sign a will
in Spain only when they own
assets located in this country.

LEGISLATION
Spanish wills can be drafted and signed in
accordance with the rules of the European
Union's Regulation 650/2012.

WITNESSES
When drafting a will, it is necessary to have 2 or 3
witnesses, depending on the type of will signed.

HOLOGRAPHIC WILL
However, in the case of a
holographic will the individual
does not need to have any
witnesses.

INHERITANCE
Individuals can inherit various assets of the
person who signed a will, in accordance with
the provisions mentioned in the document.

INHERITANCE TAX
Depending on the nature
of the inheritance, heirs
may need to pay
inheritance tax (for assets
such as real estate).

This tax must be paid by heirs who are
Spanish residents. They also need to pay it as
foreigners, as long as the assets are located
in Spain.
