What is Probation? The Industrial Court has stated that it is ‘ a period of assessment by both parties as a suitability of the worker for the job, and the job for the worker.’ (TD 76/1995) It is a period of guidance, training and supervision with adequate opportunity to correct shortcomings.
Characteristics of the probationary period :- Should be stated in writing Generally used for newly hired workers or workers who have experienced fundamental changes in job positions/functions Usually for a period of three (3) months in general and up to six (6) months for professional job positions, but would depend on the nature of the job, level of expertise and degree of skill required to achieve job targets .
May be extended (in writing ) where the probationer has demonstrated the potential but requires further training and guidance The probationer is to be treated fairly and in accordance with the principles and practices of good industrial relations
Probation, like every other element of the employment relationship must be managed in keeping with the principles and practice of good industrial relations. A worker who is informed of his/her duties and responsibilities will know exactly what he/she is required to achieve and the targets/standards and the targets/ standards by which his/her performance will be measured.
The Employer should:- Inform the worker on/before the start of employment that he/she is on probation and for how long and there may be the possibility of an extension if certain standards are not met. Provide a job description and standards of performance in written form. Conduct fair and documented appraisals with the worker during the period.
Notify the probationer of his/her shortcomings, consider and mitigating factors and allow sufficient opportunity for improvement within the probationary period . Offer support and guidance as necessary. Ensure regular communication and encourage feedback.
Warn the worker of possible disciplinary action and/ or an extension of the probationary period if there no satisfactory improvement . Confirm employment or extend the probationary period in writing, at least two (2) weeks before the end of probation
The Employee/Probationer should:- Request details of the probation and a job description in writing. Prove his/her suitability for the job. Attend to the employer’s business in a timely manner. Adhere to all company rules, policies, procedures and standards.
Seek clarification and explanation on any areas of difficulty. Request support and guidance as necessary. Provide feedbacks, especially during assessments. Request written confirmation of employment or extension of the probationary period in writing .
