Legal Bases of the School Health Program Shania Mae T. Vargas BSN-2B/Grp. 4 NCM 104-Community Health Nursing

In line with the Preamble of the 1986 Constitution of the Philippines promulgated in order to build a just and humane society, establish a government that shall embody our ideals and aspirations and promote the common good of the Filipino people, the School Health and Nutrition Program an integral part of the total school program with special focus on the health development of the child, anchors on the following legal bases: Introduction

01. PD 603 Child and Youth Welfare Code Article I- General Principles “The child is one of the most important assets of the nation. Every effort should be enacted to promote his welfare and enhance his happy opportunities for a useful happy life.” “Other institutions like the school, the church, the guild, and the community in general, should assist the home and the state in their endeavor to prepare the child for the responsibilities of adulthood”

The child’s character starts at home where every member of family should strive to make a wholesome and harmonious place to influence the child’s development. But this attachment to home and strong family ties should not be to the extent of making home isolated and exclusive and unconcerned with interest of community and country.

01. PD 603 Child and Youth Welfare Code Article II-Promotion of Health “It should be the responsibility of the health, welfare, and education entities to assist the parents in looking after health of the child”

Parents is not the only one responsible after the child’s health but is also the health, welfare, and education entities to guide the parent. Such that healthcare is collaborative, both healthcare workers and client unites to achieve a certain goal.

01. PD 603 Child and Youth Welfare Code Article III-The Rights of the Child “Every child has the right to a balanced diet, adequate clothing, sufficient shelter, proper medical attention, and the basic physical requirements of a healthy and vigorous life”

Every child has the right to be cared of. These are the basic things a human needed to survive and live a healthy life, regardless of their sex, social status, religion, and other factors.

02. 1986 Constitution of the Philippines Article VIII- Social Justice and Human Rights Section 11- “The State shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to the people at affordable cost. There shall be priority for the needs of the under-privileged, sick, elderly, disabled, women, and children. The State shall endeavor to provide for free medical care to paupers.”

PhilHealth ascertains that all Filipino citizens are entitled to free healthcare under Philippine Health Insurance. All public health institutions except regional hospitals/public medical center provide free health care services which comprises primary and secondary care. Hence, people supposed to be able to access basic health care free of charge.

02 . 1986 Constitution of the Philippines Section 12- “The State shall provide and maintain an effective food and drug regulatory system and undertake appropriate health, manpower, development and research responsibilities to the country’s health needs and problems.”

Food and Drug Administration is responsible for protecting the public health by assuring the safety, efficacy, and security of human and veterinary drugs, biological products, medical devices, nation’s food supply, cosmetics, and products that emit radiation.

02. 1986 Constitution of the Philippines Section 13- “The State shall establish a special agency for disabled persons for their rehabilitation, self-development, and self reliance and their integration into the mainstream of society.”

National Council on Disability Affairs(NCDA) is national government agency mandated to formulate policies and coordinate their activities concerning disability issues and concerns.

03. Executive Order No. 14 s.1946 Creation of the Medical and Dental Services granting authority for the voluntary contribution of 50 centavos per pupil for the maintenance of the service.

T he provision of medical and dental services in the schools is essential in the safeguarding of the health of school children. The Department of Instruction desires to resume the dental service and expand the medical service in the schools and the National and local governments are not at present in a position to support adequately such medical or dental service in the public schools. 

04. RA No. 951 s.1947 Medical inspection of school children enrolled in private schools, colleges and universities in the Philippines.

05. RA No. 847 s. 1953 Return of the Medical and Dental Services from the Department of Health to the Department of Education

The Medical and Dental Services in the Public Schools which is now functioning as a division of the Bureau of Health, since January first, nineteen hundred and fifty-one, is hereby transferred or returned back to the Department of Education as a division of that Department where it originally belonged from nineteen hundred and forty-six to nineteen hundred and fifty:  Provided , That the supervision of hygiene and sanitation shall be exercised by the Department of Health.

06. RA No. 1082 s. 1954 An act strengthening health and dental service in the rural areas and providing funds thereof.

There shall be in each province a Provincial Health Officer, and in each congressional district, a Public Health Dentist:  Provided, however,  That a congressional district having a population of over one hundred fifty thousand shall have an additional Public Health Dentist.  There shall be created rural health units of two classes: one of category one or senior rural health unit consisting of one municipal health officer as head of the unit, one public health nurse, one midwife, and one sanitary inspector; another of category two or junior rural health unit consisting of one physician or public health nurse as head of the unit and one midwife or sanitary inspector. 

07. RA No. 2620 s. 1961 Nationalization of the Medical and Dental Services of the Bureau of Public Schools, Department of Education.

T he salaries and wages of the personnel of the Medical and Dental Services of the Bureau of Public Schools and all other expenses for the maintenance and operation of these services shall be paid by the National Government. The collection of the contributions from pupils and students for the support and operation of the Medical and Dental Services as provided in Executive Order Numbered Fourteen, series of nineteen hundred forty-six, shall continue until government funds are made available for these services in accordance with the provisions of this Act.

08. Presidential Proclamation No. 255 s. 1967 Observance of National Health Education Week on October 10-16 of every year.

T he deterring factor in the achievement of the goal of promoting maximum health for all people is the lack of information and understanding regarding basic facts about health and social hygiene; and an organized program of health education which involves both government and voluntary agencies will go a long way towards the promotion of health consciousness among our people; NHEW activities increase awareness of major public health issues and promote a better understanding of the role of health education and health promotion.

09. Article V Sec.29 s.1972 Dangerous Drug Act-Integration of Drug Education concept in the School Curriculum

M andates the Dangerous Drugs Board (DDB) to be the policy-making and strategy-formulating body on drug prevention and control. It shall develop and adopt a comprehensive, integrated, unified and balanced national drug abuse prevention and control strategy.

10 . PD No. 491 s. 1974 Designated July as Nutrition Month for the purpose of creating greater awareness among the people on the importance of nutrition.

M alnutrition is seriously affecting millions of our people; tards mental and physical development of our children, weakens their resistance to infections resulting in unnecessary loss of human lives through high infant and child mortality rates; studies indicate that infants and young children, pregnant women and nursing mothers are most vulnerable to malnutrition;  there is a multiplicity of government agencies engaged in various aspects of nutrition activities; ,  there are various food programs in the country such as the Green Revolution, Masagana 99, Palayan ng Bayan, Masaganang Maisan and others which are aimed at providing for food sufficiency;
