Payment of Wages Act -1936
➢ObjectiveoftheAct:-
•The“PaymentofWagesAct1936”regulates
paymentofwagestoEmployees(Direct&Indirect).
•TheActisintendedtobearemedyagainst
unauthorizeddeductionsmadebythe“Employer”or
unjustifieddelayinpaymentofwages.
•AllEmployeesarecoveredunder
theAct,thosearedrawingAverage
wagesRs:-10,000/-permonth.

➢ApplicabilityoftheAct:-
•The“PaymentofWagesAct1936”isapplicabletoall
Factories,IndustrialEstablishment,TramwayService,
orMotorTransportServiceengagedincarrying
PassengersorGoodsbothbyroadforhireorreward.
•AirTransportService,Dock,Wharf,InlandVessel,
Mechanicallypropelled,Mines,QuarryorOil-Field,
Plantation,Workshoporotherestablishment,etc.

➢MeaningofWages:-
•“Wages”meansallRemunerationexpressedinterms
ofMoneyandincludeRemunerationpayableunder
anyAwardorSettlement,OvertimeWages,Wages
forHoliday&anysumpayableonTerminationof
Employment.
•However,itdoesnotinclude“Bonus”whichdoesnot
formpartofRemunerationpayable,valueofHouse
Accommodation,ContributiontoPF&ESI,Traveling
Allowance,orPaymentofGratuity.

➢Objective:
•Todeterminetheminimumwagesinindustryand
tradewherelabourorganizationsarenon-existentor
ineffective.
➢ScopeandCoverage:
•Applicabletoallemployeesengagedtodoanywork,
skilled,unskilledmanualorclerical,inascheduled
employment,includingout-workers.

The Workmen’s Compensation Act, 1923
➢ACT:-
✓Itaimstoprovideworkmenand/ortheirdependents
somereliefincaseofaccidentsarisingoutofandin
thecourseofemployment&causingeitherdeathor
disablementofworkmen.

✓Toprovidecompensationtoworkmenincapacitated
byaninjuryfromaccidentsarisingoutofandinthe
courseofemployment.
✓Theobjectiveofthisactisthatinthecaseofan

injuredworkmenandincaseofhisdeathtohis
dependents.

workabroadfortheOrganization.
