The government also plays an important role in consumer protection. A consumer has rights mandated by law. These are privileges that an individual is guaranteed of health products and services.
The consume Act of the Philippines is a law that protects the interest of the consumer, promotes general welfare, and establishes standards of conduct for business and industry. There are 8 basic rights of a consumer according to the act.
8 Basic rights of a Consumer
1. The right to Basic Needs This right guarantees survival, adequate food, clothing, shelter, healthcare, education and sanitation
2. The Right to Safety This is the right to be protected against the marketing of good or the provision of services that are hazardous to health and life .
3. The right to Information This is the right to be protected against dishonest or misleading advertising or labeling and the right to be given the facts and information needed to make an informed choice.
4. The right to Choose This is the to choose the products at competitive prices with an assurance of satisfactory quality .
5. The right to Representation This is the right to express consumer interest in the making and execution of government policies.
6. The right to Redress This is the right to compensated for misrepresentation, shoddy goods of unsatisfactory services .
7. The right to Consumer Education This is the right to acquire the knowledge and skills necessary to be an informed consumer
8. The right to Healthy Environment This is the right to live and work in an environment that is neither threatening nor dangerous and, which permits a life of dignity and well-being.
Aside from consumer Act of 2009, there are also other international and national consumer advocacy groups that advocate for our health .
By knowing consumer rights, you have he power to report illegal and fraudulent health products and service. Here are some government firms that we can approach to report.
1. Department of Trade and Industry Philippines.
2. DEPARTMENT OF HEALTH Quality Culture and Continual Quality Paradigm- All service providers shall know and respond to their customers’ needs and expectations within the mandate of the office and to the extent allowed by available capacities and resources. Customer-first Policy- Service providers shall implement a customer-first, guest-first, disabled and elderly, pregnant-first, women and children-first policy in all queues/lines including food.
“ No-break” Policy- T h e DOH-CAR employees are expected to accept and respond to official calls and requests from internal and external customers after working hours, on week-ends and holidays, and even when they are on leave of absence. Public Assistance and Complaints Desk and Customer Satisfaction Surveys - guests may access information as to the proper service provider to approach for various needs or concerns. Questions and complaints are received through the desk, or through hotlines or “helplines”, or website established by the office.
“ Bilis-Aksyon ” Partner- The Bilis-Aksyon Partner is tasked to monitor and/or ensure quick action on reports received from the public, oversees the implementation of the Anti-Red Tape Act in the DOH CAR, and submits the necessary reports. Consumer Complaints Conciliation and Arbitration - he DOH has set procedures in the conduct of conciliation and arbitration of consumer complaints applicable to cases under DOH jurisdiction through an Administrative Order.
3. Food and Drugs Administrations The Food and Drug Administration is responsible for protecting the public health by ensuring the safety, efficacy, and security of human and veterinary drugs, biological products, and medical devices; and by ensuring the safety of our nation's food supply, cosmetics, and products that emit radiation.
FDA also has responsibility for regulating the manufacturing, marketing, and distribution of tobacco products to protect the public health and to reduce tobacco use by minors.
FDA is responsible for advancing the public health by helping to speed innovations that make medical products more effective, safer, and more affordable and by helping the public get the accurate, science-based information they need to use medical products and foods to maintain and improve their health
FDA also plays a significant role in the Nation's counterterrorism capability. FDA fulfills this responsibility by ensuring the security of the food supply and by fostering development of medical products to respond to deliberate and naturally emerging public health threats.
