Factories Act in India
•InIndia,theFirstfactoriesActwaspassedin1881.
•ThisActwasbasicallydesignedtoprotectchildrenandtoprovidefew
measuresforhealthandsafetyoftheworkers.
•Thislawwasapplicabletoonlythosefactories,whichemployed100or
moreworkers.
•In1891anotherFactoriesActwaspassedwhichextendedtothefactories
employee50ormoreworkers.

Factories Act in India
•Sincethen,theacthasbeenamendedonmanyoccasions.TheFactories
Act1934waspassedreplacingallthepreviouslegislationregarding
factories.
•ThisactwasdraftedinthelightoftherecommendationsoftheRoyal
CommissiononLabour.ThisActhasalsobeenamendedsuitablyfromtime
totime.
•TheexperienceofworkingoftheFactoriesAct,1934hadrevealeda
numberofdefectsandweaknesswhichhavehamperedeffective
administration of the Act.

Factories Act in India
•Thiscalledforrevisionoftheacttoextenditsprotectiveprovisionstothe
largenumberofsmallerindustrialestablishments.
•Therefore,theFactoriesAct,1948consolidatingandamendingthelaw
relatingtolabourinfactories,waspassedbytheConstituentAssemblyon
August28,1948.
•TheActreceivedtheassentofGovernorGeneralofIndiaon23September
1948andcameintoforceonApril1,1949.

Objective
•ToregulateworkingconditionsintheFactories
•Toensurethatthebasicminimumrequirementsforhealth,Safety,.Welfare
oftheFactoryWorkersareprovided
•Toregulatetheworkinghours,leave,holidays,Overtime,employmentof
childrenandwomenandyoungpersons.

Scope and Applicability
•TheActextendstowholeofIndia.
•ItappliestoallfactoriesincludingfactoriesbelongingtoCentralorany
StateGovernmentunlessotherwiseexcluded.
•ThebenefitsofthisActareavailabletopersonswhoareemployedinthe
factoryandbecoveredwithinthemeaningoftheterm"worker"asdefined
intheAct.

Definitions
FACTORY (Section2)
(i)anypremisesincludingtheprecinctsthereofwhereonfortyormore
workersareworking,orwereworkingonanydayoftheprecedingtwelve
months,andinanypartofwhichamanufacturingprocessisbeingcarriedon
(ii)anypremiseswhereuponmanufacturingprocessinvolvehazardous
processesandorhazardoussubstance,
(iii)anypremiseswhereuponmanufacturingprocessinvolvedangerous
operations,butdoesnotincludeaminesubjecttotheoperationoftheMines
Act,1952oramobileunitbelongingtothearmedforcesoftheCentral,a
railwayrunningshedorahotel,restaurantoreatingplace

Definitions
Worker(Section 2 (1))
•Who is employed (directly or through any agency);
•Who is employed in any manufacturing process, or in cleaning any part of
the machinery or premises used for a manufacturing process or in any other
kind of work incidental to, or connected with the manufacturing process or
the subject of the manufacturing process;

•Adultmeansapersonwhohascompletedhis18thyearofage.[Section2
(a)]
•Adolescentmeansapersonwhohascompletedhis15thyearofagebuthas
notcompletedhis18thyear.[Section2(b).]

Theoccupiershall,ineveryfactorywhereahazardousprocess
takesplace,orwhereactivityinvolvesdangerousoperations,set
upaSafetyCommitteeconsistingofequalnumberof

Wheretheworkersemployedinanyfactoryengagedinahazardousprocess

occupier,agent,manageroranyotherpersonwhoisin-chargeofthefactory

•hewillhaveaholidayforadayinthreedaysimmediatelybeforeorafterthe
saidday,and
•themanagerofthefactoryhas,beforethesaiddayorthesubstitutedday(i)
submitinthewebserviceportalhisintentiontorequiretheworkertowork
onthesaiddayandofthedaywhichistobesubstituted,and(ii)displaya
noticetothateffectinthefactory:Providedthatnosubstitutionshallbe
madewhichwillresultinanyworkerworkingformorethantendays
consecutivelywithoutaholidayforawholeday.

Annual Leave with Wages
•Section79oftheActdealswiththeprovisionsofannualleave
withwages.
•Thebasisofcalculationoftheannualleavetowhichaworker
wouldbeentitledinayearisthepreviouscalendaryearduring
whichhehadworkedinafactory.

Qualifying Period
•Theminimumnumberofdayswhichentitlesaworkertoearn
leaveis240duringacalendaryearwhichperiodshouldinclude:
(i)Thedaysoflayoffwhichmaybebecauseofcontractor
agreementoraspermissibleunderStandingOrders;
ii)Theleaveearnedintheyearpriortothatinwhichleaveis
appliedfor

Qualifying Period
•Incaseoffemaleworker,maternityleaveforanynumberofdaysnot
exceeding26weeks.
•Ifaccordingtoabovecomputation,thetotalperiodcomesto240daysor
more,thentheworkerinafactorywouldbeentitledtoleavewithwagesin
thesubsequentcalendaryearforanumberofdayscalculated.

Rate of Leave
Inthecaseofanadult,onedayforeverytwentydaysofwork
performedbyhimduringthepreviouscalendaryear.

Unavailed Leave
•Ifaworkerhasnotavailedportionofhisleaveinonecalendaryear,such
leaveshallbecarriedoverandaddedtotheleavesallowedtohiminthe
succeedingcalendaryear.
•Subjecttotheconditionthatthetotalnumberofdaystobecarriedforward
wouldnotexceed-
✓Inthecaseofadult30days
✓Inthecaseofchild40days

Procedure for availing Leave
•Aworkerwhowantstoavailleaveisrequiredtomakeanapplicationtothe
managerofthefactoryatleast15daysinadvance.
•Exceptinthecaseofpublicutilityconcernwheretheapplicationforleave
canbeavailedofin3instalmentsinyearatthemost.

Procedure for availing Leave
•Iftheworkerwantsleavewithwagesduetohimtocoveraperiodofillness,
theworkerneednotapplyinadvance.
•Insuchcase,thewageadmissibletohimarerequiredtobepaidinadvance
within15days.
•Andincaseofpublicutilityconcern(electricity,water,gas,power,transport)
within30daysfromthedateofapplicationrequestingforgrantofleave.

Mode of recovery of unpaid wages
•Anysumrequiredtobepaidbyanemployerbutnotpaidcanberecovered
bytheworkerundertheprovisionsofPaymentofWagesAct,1936.(Section
82).
•Wherewagesareduetoaworkerforannualleaveandtheemployermakes
adefaultinmakingpayment,theycanberecoveredundertheact.

Power of the State Government
TheStateGovernmentisempoweredtomakerulesdirectingthemanagersof
factoriestokeepregisterscontainingsuchparticularsasmaybeprescribed
byitandsuchregisterstobemadeavailabletoInspectorsforexamination
(Section 83)

Shops and Establishment Act
•Shops&CommercialEstablishmentsAct,1962isanactthat
providesfortheregulationofconditionsofworkand
employmentinshopsandcommercialestablishments
•Thisactisapplicabletoanyshops,commercialestablishments,
residentialhotels,restaurants,eatinghouses,theatresandother
placesofpublicamusementorentertainmentsaremainly
protectedbytheprovisionsofthisact.

Exemptions:
Thisactisnotapplicabletothefollowinginstitutions:
•Officesunderthecentralorstategovernment
•Anypublicutilityservices
•Establishmentforthetreatmentorcareofthesickormentally
unfit
•EstablishmentsofFoodCorporationofIndia
•Officesofthelegalpractitionersemployingmorethan3

Registration of the Establishments
•Within30daysfromthereceiptofthestatementwithdetailsof
theestablishmentandfees
•FormA:Employerhastosendthedetailswithin30daysof
commencement.
•FormB:Toberenewedbefore90daysofExpirythroughFORM
AAtotheLabourdepartment
•FormE:Anychangesinexistingmanpowerstatusshouldbe
intimatedtotheassistantLabourinspectorwithin15days.

shallbeinKanadda(incaseofKarnataka)andifanyother

prohibitedunderSection24oftheAct.Youngpersonsand
womanshallnotbeemployedduringnight,between8pmto6
am.

appointmentorderinwritingindicatingthename,designation,

beallowedtoworkformorethan9hoursonanydayandforty-

preparationofaccounts.
•Noyoungpersonshallbeallowedtoworkinanyestablishmentfor
morethan5hoursinaday(Youngpersonmeansapersonwhois
notachildandhasnotcompletedhisseventeenthyear.)

•AnystartupsorcompaniesregisteredundertheShopsand
CommercialEstablishmentAct,thefollowingreportsarerequired
tobemaintained.
1.RegisterofLeavewithWages:Amandatoryregistertobe
maintainedbytheemployerwhichwillcoverEarnedLeavein
PartIandSickLeaveinPartII

2.LeavewithWagesBook:AllEmployersshallprovideeach
employeewhohasbecomeentitledtoleaveduringaleaveyear,
withabookinthegivenformat.
3.CombinedMusterRollcumRegisterofWages:Acombined
registerwhichcontainsattendanceparticularsincludingovertime
particulars.Wagedetails,componentwiseshallalsoberecorded.
Thishastoberecordedandstoredmonthwise,yearwiseforall
employees.

4.AppointmentOrdersofallemployees:Everyemployer,employingany
personinorinconnectionwithhisestablishment,shallissueanappointment
orderinwritingindicatingthename,designation,wagescaleofsuchperson
andtermsandconditionsofhisemployment
5.Permissiontoallowwomentoworkafter8PM:Anyemployerhavingwomen
staffworkingafter8PMhastosubmittheforminformationofthedetailsto
concernedDeputyLabourCommissionerforconsiderationandapproval.
Employerhastonotifyanychangeinrespectofanyinformationfurnishedin
FormRwithin15days.

6.CombinedAnnualReturn:Thisisamandatoryfilingrequirement
foranyestablishmentandincludesestablishmentdetails,
employment particularssuchasemployeesworkingand
employeesseparated,leavewithwageparticulars,welfare
measures,maternitybenefitsprovided,andcontractlabour
information.

Extrawagesforovertimework:Whereanemployeeworksinany
establishmentformorethan9hoursinanydayorformorethan
forty-eighthoursinanyweekheshallinrespectofsuchovertime
workbeentitledtowagesattwicetherateofnormalwages.
Intervalforrest:Noemployeeshallworkformorethanfivehours
beforehehashadanintervalofrestofatleastonehour.

Openingandclosinghours:Noestablishmentshallonanyday,be
openedearlierthanandclosedlaterthansuchhoursasmaybe
fixedbyanotificationissuedbytheStateGovernment
WeeklyHoliday:Everyestablishmentshallremainclosedforone
dayoftheweek.Theemployershallfixsuchdateatthebeginning
oftheyear.

Annualleavewithwages:Everyemployeeshallbeentitledtoleave
withwagesandshallbeallowedtoavailsuchleaveofonedayfor

CasualLeaveandSickLeaveof12Dayscannotbeen-cashed.

Introduction
•Intheinitialstagesofindustrialisation,workershadtosuffer
fromexhorbitantdelaysinpaymentofwages,arbitrary
deductions.
•Delayinthepaymentofwages,deductionsoftwodayswages-
foroneday'sabsence,heavyfinesforsmallomissionsand
commissions,werequitecommon.
•Irregularitiescommittedbyemployerswerebroughttothe
noticeoftheRoyalCommissionofLabourinIndia.

Introduction
•Inthereportsubmittedin1931,theCommissionpointedout
wideprevalenceofsuchunfairpracticesinregardtothe
paymentsofwagesduetoworkerssuchasnon-paymentof
wages,shortpayment,irregularpayment.,paymentinkind
ratherthanincash,shortmeasurementofworkofpiecerate
workers,andexcessivefinesanddeductions.
•TheCommissionstressedtheneedforprotectingtheearned
wagesofworkersbyeliminationofthesepractices.

Introduction
•TheCommissionalsoobservedthatthepurposeoflayingdown
amachineryforevolvingaproperandequitablewagestructure
isdefeatedifmalpracticesinregardtopaymentofwagesare
notchecked.
•InpursuanceoftherecommendationsoftheCommission,the
PaymentofWagesAct,waspassedin1936,anditcomeinto
forceon28thMarch,1937.

•TheActisaprotectivepieceoflegislation.
•Toregulatethepaymentofwagesofcertainclassofworkers
employedinindustry.
•Toensuretoworkerpaymentoftheirearnedwagesonduedate
withoutunauthoriseddeduction.
•Itlaysdownpermissibledeductionstoprotecttheemployees
againstarbitraryorunauthoriseddeductionsbeingmadefrom
theirwages.

•TheActappliestothewholeofIndia.
•TheActappliestopersonsemployedinanyfactoryandtoperson
employed(otherwisethaninafactory)uponanyrailwaybyarailway
administration.Inthelattercase,italsoappliestopersonsemployedeither
directlyorthroughacontractorbyapersonfulfillingacontractwitha
railwayadministration.
•TheStateGovernmentmayaftergivingthreemonthsnoticeextendthe
provisionsoftheActtoanyclassofpersonsemployedinanyindustrial
establishmentspecifiedbytheCentralGovernment andState

•TheActisalsoapplicabletopersonsemployedincoalminesand
plantations,aswellasestablishmentsinwhichworkrelatingtothe
construction,developmentormaintenanceofbuilding,roads,bridges,
supplyofwater,orrelatingtooperationsconnectedwith-navigation,
irrigationorthesupplyofwater,orrelatingtogeneration,transmissionand
distributionofelectricity,orotherformofpoweriscarriedon.

•EmployedPerson:Employedpersonincludesthelegal
representativeofadeceasedemployedperson.
•Employer:Employerincludesthelegalrepresentativeof
deceasedemployer.

Responsibility for payment of wages
•Everyemployershallberesponsibletopaywagestopersonsemployeeby
him.
•Thefollowingpersonsshallberesponsibleforpaymentofwages:-
✓infactories,thepersonnamedasmanager;
✓inindustrialestablishments,thepersonwhoisresponsibletotheemployer
forthesupervisionandcontroloftheindustrialestablishment;
✓Uponrailwaysthepersonnominatedbytherailwayadministrationinthis
behalfforthelocalareaconcerned.

Rules regarding payment of wages
•Fixationofwage-period:Everypersonresponsibleforthe
paymentofwagesunderSec.3shallfixperiods,knownas
WagesPeriodsinrespectofwhichsuchwagesshallbepayable.
•Awageperiodshallnotexceedonemonth.(Section4)

Rules regarding payment of wages
Timeofpaymentofwages:
•Ifthenumberofpersonsemployedinafactory,anindustrial
establishment,orrailwayincludingdailyratedworkers,islessthan1000,
wagesmustbepaidbeforetheexpiryoftheseventhdayafterthelastday
ofthewageperiod.
•Inothercases,wagesmustbepaidbeforetheexpiryofthetenthdayafter
theexpiryofthewageperiod.
•Inthecaseofpersonsemployedondock,mine,wharforjetty,thebalance
ofwagesfounddueoncompletionofthefinaltonnageaccountoftheship
orwagonsloadedorunloaded,shallbepaidbeforetheexpiryofthe
seventhdayaftersuchcompletion.

•Wheretheemploymentofanypersonisterminatedbytheemployer,the
wagesearnedbyhimshallbepaidbeforetheexpiryofthesecondworking
dayfromthedayonwhichemploymentisterminated
•Iftheemploymentisterminatedduetotheclosureofestablishmentforany
reasonotherthanweeklyorotherrecongnisedholiday,wageswillbepaid
beforetheexpiryofsecondworkingdayfromthedayonwhich
employmentisbeingterminated.
•TheStateGovernmentmay,byageneralorspecialorder,exemptthe
personresponsibleforthepaymentofwagesfromtheoperationofthe
aboveprovisionsincertaincases.
•Allpaymentofwagesshallbemadeonaworkingday.(Section5)

Medium of payment of wages
Allwagesshallbepaidincurrentcoinorcurrencynotesorboth.
Theemployermayafterobtainingthewritten'permissionofthe

Fines(Sec.8):
•Nofineshallbeimposedonanyemployedpersonexceptinrespectof
suchactsomissionsonhispartastheemployer,withtheprevious
approvaloftheStateGovernmentoroftheprescribedauthority,may
havebeenspecifiedbyanotice.
•Thenoticespecifyingtheactsandomissionsforwhichfinesmaybe
imposedshallbeexhibitedintheprescribedmanneronthepremisesor
theplaceinwhichtheemploymentiscarriedon.
•Nofineshallbeimposedonanemployedpersonuntilhehasgivenan
opportunityofshowingcauseagainstthefine.

Permissible deductions from wages
•Thetotalamountoffineinanyonewageperiodshallnotexceedthree
percentoftherupeewagespayabletohiminrespectofthatwages
period.
•Nofineshallbeimposedonapersonwhoisbelowtheageoffifteen
years.
•Nofineshallberecoveredbyinstalmentsoraftertheexpiryofsixtydays
fromthedayonwhichitwasimposed.
•Everyfineshallbedeemedtohavebeenimposedonthedayoftheactor
omission.
•Allfinesandrealisationsthereofshallberecordedinaregistertobekept
bythepersonresponsibleforthepaymentofwagesinsuchformasmay
beprescribed.
•Allrealisationoffinesshallbeappliedonlytosuchpurposesasre
beneficialtothepersonsemployedinthefactory.

Permissible deductions from wages
DeductionsforAbsencefromDuty(Sec.9)
•Anemployedpersonshallbedeemedtobeabsentfromdutyif,though
presentattheplaceofwork,herefusestocarryouthiswork,inpursuance
ofastay-instrikeorforanyothercausewhichisnotreasonable.
•Theratiobetweentheamountofdeductionsforabsencefromdutyandthe
wagespayableshallnotexceedtheratiobetweentheperiodofabsenceand
totalperiodwithinsuchwageperiod.
•If,however,tenormorepersons,actinginconcert,absentthemselves
withoutduenoticeandwithoutreasonablecause,thedeductionforabsence
fromdutyfromanysuchpersonmayincludesuchamountnotexceedinghis
wagesforeightdaysasmaybeduetotheemployerinlieuofnotice.

Permissible deductions from wages
DeductionsforDamageofLoss(Sec.10)
•Adeductionfordamagetoorlossorgoodsexpresslyentrustedtothe
employedpersonforcustody,orforlossofmoneywhichheisrequiredto
accountcanbemadewheresuchlossisdirectlyattributabletohisneglect
ordefault.
•Adeductionfordamageorlossshallnotexceedtheamountofdamageor
losscausedtotheemployerbyhisneglectordefault.
•Adeductionfordamageorlossshallnotbemadeuntiltheemployed
personhasbeengivenanopportunityofshowingcauseagainstthe
deduction.
•Alldeductionsandrealisationsinrespectofdamageorlossshallbe
recordedinaregistertobekeptbythepersonresponsibleforthepayment
ofwages.

Permissible deductions from wages
DeductionsforAccommodationandService(Sec.11)
•Deductionscannotbemadeunlesssuchserviceshavebeenacceptedby
theemployedpersonasatermofhisemployment.
•Servicesdonotincludethesupplyoftoolsandrawmaterialsrequiredfor
thepurposeoftheemploymentandnodeductioncanbemade;inthat
respect.
•Theamountofdeductioncannotexceedanamountequivalenttothe
valueofhouseaccommodation,amenityorservicesupplied.
•TheamenitiesandservicesmustbeauthorisedbytheStateGovernment
byageneralorspecialorder.StateGovernmentsareempoweredtomake
rulesgoverningdeductionsforamenitiesandservices.

Permissible deductions from wages
DeductionsforRecoveryofAdvance(Sec.12).
•Recoveryofanadvanceofmoneygivenbeforeemploymentshallbemade
fromthefirstpaymentofwagesinrespectofcompletewageperiod,but
norecoverycanbemadeofsuchadvancegivenfortravellingexpenses.
•Recoveryofanadvancegivenafteremploymentbeganshallbesubjectto
suchconditionsastheStateGovernmentmayimpose,
•Recoveryofadvancesofwagesnotalreadyearnedshallbesubjecttoany
rulesmadebytheStateGovernmentinthisregard.TheStateGovernment
mayregulatetheextenttowhichsuchadvancesmaybegiven,the
instalmentsbywhichtheymayberecoveredandtherateofinterestthat
maybechargedonsuchadvance.

Permissible deductions from wages
DeductionsforRecoveryofLoans(Sec.12-A)
•Deductionforrecoveryofloansmadefromanyfundconstitutedforthe
welfareoflabourandtheinterestdueinrespectthereofcanbemade
providedthefundisconstitutedinaccordancewiththerulesapprovedby
theStateGovernment.
•Deductionscanbemadeforrecoveryofloansgrantedforhousebuilding
orotherpurposesapprovedbytheStateGovernmentandtheinterestdue
inrespectthereof.

OtherPermissible deductions from wages
•Deductionsofincome-taxpayablebytheemployedperson;
•Deductionsrequiredtobemadebyorderofacourt
•Deductionsforsubscriptionsto,andforrepaymentsofadvancesfromany
providentfundtowhichtheProvidentFundsAct.1925appliesorany
recognisedprovidentfundoranyprovidentfundapprovedinthisbehalf
bytheStateGovernment.

OtherPermissible deductions from wages
•Deductionsmade,withthewrittenauthorisationoftheemployedpersons
forpaymentofthefeespayablebyhimforthemembershipofanytrade
unionregisteredundertheTradeUnionsAct,1926.
•Deductionsmadewiththewrittenauthorisationoftheemployedperson
forcontributiontothePrimeMinister'sNationalReliefFundortosuch
otherfundsastheCentralGovernmentmaybenotificationintheofficial
Gazettespecify;
•Deductionsforcontributiontoanyinsuranceschemeframedbythe
CentralGovernmentforthebenefitofitsemployees.

IllegalDeductions.Anydeductionsotherthanthose
authorisedunderSection7oftheActwouldconstitute
illegaldeductions.

Maintenance of registers and records (Sec. 13-A)
Everyemployermustmaintainregisterswithfollowing
particulars:
✓theworkperformedbythepersonemployed;
✓thewagespaidtohim;
✓thedeductionsmadefromhiswages;
✓thereceiptsgivenbyhim.
•Theregistersandrecordsshallbeinsuchformasmaybe
prescribed.Theyshallbepreservedforaperiodofthreeyears
afterthedateofthelastentrymadetherein.

Inspectors and their Power
•AnInspectorofFactoriesappointedundertheFactoriesAct,1948shallbe
aninspectorforthepurposesofthePaymentofWagesAct.
•Moreover,theStateGovernmentmaybynotification'intheOfficialGazette
appointsuchotherpersonsasitthinksfittobeInspectorsforthepurposes
oftheAct.
•Itmaydefinethelocallimitswithinwhichandtheclassoffactoriesand
industrialorotherestablishmentsinrespectofwhichtheyshallexercise
theirfunctions.
•ItmayalsoappointInspectorsforthepurposeoftheActinrespectof
personsemployeduponarailwaytowhomtheActapplies.

Power ofInspectors
•makesuchexaminationandinquiryashethinksfittoascertain
iftheprovisionsoftheActarebeingobserved;
•enter,inspectandsearchanypremisesofanyrailway,factory
orindustrialorotherestablishmentatanyreasonabletimefor
thepurposeofcarryingouttheobjectsoftheAct;
•supervisethepaymentofwagestopersonsemployeduponany
railwayorinanyfactoryorindustrialorotherestablishments.

theActandtakestatementsofanypersonswhichheconsiders
necessaryforcarryingoutthepurposesoftheAct;
•Seize-ortakecopiesofregistersordocumentswhichmaybe
relevantinrespectofanoffencecommittedbyanemployer;
•Exercisesuchotherpowersasmaybeprescribed.

Appointment of Competent Authority
•TheStateGovernmentmaybynotificationintheOfficialGazette
appointapersonastheAuthoritytohearanddecideforany
specifiedareaallclaimsarisingoutofdeductionsfromthe
wages,ordelayinpaymentofthewagesofpersonsemployed
orpaidinthatarea,includingallmattersincidentaltosuch
claims.

onwhichthedeductionfromwageswasmade,orfromthedate
onwhichthepaymentofthewageswasduetobemade.
•Anapplicationmayalsobeadmittedafter12monthsifthe
applicantsatisfiedtheAuthoritythattherewasasufficient
causefornotmakingtheapplicationwithintwelvemonths.But
sufficiencyofthecauseistobedecidedbyproperlegal
principles.

•BeforeadmittinganysuchapplicationtheAuthoritymustgive
noticetoandhear,theoppositepartyandadmissionshouldbe
conscientious.
•ThediscretionarypowerconferredontheAuthorityto
acceptdelayinfilinganapplicationisnotexcessivebecause
theaggrievedpartycanseekredressagainstabuseofthis

Payment of wages in case of death
•Incaseofdeathofanemployedpersonorincaseofhiswhereaboutnot
beingknown,allamountspayabletohimaswages,shall
a)bepaidtothepersonsnominatedbyhiminthisbehalf
b)bedepositedwiththeprescribedauthority;
✓wherenonominationhasbeenmade,or
✓whereforanyreasonssuchamountscannotbepaidtotheperson

•TheStateGovernmentmaybynotificationintheofficialGazette,make

•InmakinganyruleunderSec.26,theStateGovernmentmayprovidethata
contraventionoftheruleshallbepunishablewithfinewhichmayextendto
twohundredrupees.

•EveryrulemadebytheCentralGovernmentunderthisActshallbelaidas
soonas,maybeafteritismade,beforeeachHouseoftheParliament.
•IfbothHouseagreeinmakinganymodificationintherule,theruleshall

revision,asthecasemaybe.
(b)Oritshall,bynotificationintheOfficialGazette,publishitsproposalfor
theinformationofthepersonslikelytobeaffectedthereby,andspecifya
date,notlessthantwomonthsfromthedateofnotification,whichthe
proposalwillbetakenintoconsideration.

Composition of Committees and Advisory Board (Sec. 9)
•EachoftheCommittee,Sub-Committee,andtheAdvisoryBoardshall
consistofpersonstobenominatedbytheappropriateGovernment
representingemployersandemployeesinthescheduledemployments,
whoshallbeequalinnumber,andindependentpersonsnotexceedingone

Wages in Kind
•MinimumwagespayableundertheActshallbepaidincash.
•Butwhereithasbeenthecustomtopaywageswhollyorpartlyinkind,the
appropriateGovernmentmay,bynotificationintheOfficialGazette,
authorisethepaymentofminimumwageseitherwhollyorpartlyinkind.

•TheAppropriateGovernmentmayalsoby,notificationintheOfficial
Gazetteauthorisetheprovisionofthesupplyofessentialcommoditiesat
concessionalrates(Sec.11(3).

Fixing Working Hours
Whereminimumratesofwageshavebeenfixedforanyscheduled
employment,theappropriateGovernmentmay;
•Fixthenumberofhoursofworkwhichconstituteanormalworkingday,
inclusiveofoneormorespecifiedintervals.
•Provideforadayofrestineveryperiodofsevendaysandforpaymentof
remunerationinrespectofsuchdaysofrest.
•Provideforpaymentforworkonadayofrestataratenotlesstheovertime
rate.

Inrelationtothefollowingclassofemployees,theaboveprovisionsshall
applytosuchextentandsubjecttosuchconditionsasmaybeprescribed.

•Where,anemployeedoestwoormoreclassesofworktoeachof
whichadifferentminimumrateofwagesisapplicable,the
employershallpaytosuchemployeeinrespectoftime

workshoporplaceasmaybeusedforgivingoutworktothem.
•TheappropriateGovernmentmay,providefortheissueofwage
booksorwageslipstoemployeesemployedinanyscheduled
employment.

Authority for hearing and deciding claims
•anycommissionerforworkmen'sCompensation.
•anyofficeroftheCentralGovernmentexercisingfunctionsas
LabourCommissionerforanyregion;
•anyofficeroftheStateGovernmentnotbelowtherankofa
LabourCommissioner;or
•anyotherofficerwithaexperienceasajudgeofaCivilCourtor
asastipendaryMagistrate(Sec.20(I)).

TheAppropriategovernmentmay:
•directthattheprovisionsofthisActshallnotapplyinrelationto
thewagespayabletodisabledemployees;
•exemptbynotificationintheofficialGazettesomespecified
scheduledemploymentsfromtheapplicationofsomeofallorthe
provisionsoftheAct;
•directthattheprovisionsoftheActshallnotapplytothewages
payablebyanemployertoormemberofhisfamilywhoisliving
withhimandisdependentonhim.

TheappropriateGovernmentaftergivingbynotificationintheofficialGazette
notlessthanthreemonths'noticeofitsintentionsotodo,bynotificationadd
totheScheduleanyemploymentinrespectofwhichitisofopinionthat
minimumratesofwagesshouldbefixedunderthisAct.

TheCentralGovernmentmaygivedirectionstoaStateGovernmentregarding
executionofthisActintheState.

Obligation of Employer
•paytoevery,employeetheminimumratesofwagesincasefixedby
theGovernmentwithoutanydeductionexcept
•observealldirectionswhichmaybeissuedundertheActinregardto
normalworkinghours,weeklydayofrestwithwagesandovertime
rates;
•maintainregistersandrecords
•issuewagebooksorslipstoemployeesinrespectofminimumrates
ofwagesandmakeauthenticatedentriesinsuchwagebooksor
wagesslips.

Rights of a worker
•receiveminimumwagesincludingovertimewagesasfixedand
notifiedbytheGovernment,and
•fileclaimforshortpaymentswithinsixmonthsfromthedatethe
minimumwagesbecomepayable.Delayinfilingtheclaimmay
becondonedifthereissufficientcause.
