This Act may be called The Prevention of Cruelty to Animals Act, 1960. It extends to the whole of India except the State of Jammu and Kashmir. It shall come into force on such date as the Central Government may by notification in the Official Gazette, appoint, and different dates may be appointed for different States and for the different provisions contained in this Act. The first law, according to Matthew Piper , was passed in 1933, not long after the Nazis rose to power. Under the Animal Protection Act , it was forbidden to mistreat or handle animals in any way that would harm them. Force-feeding fowl was banned, and the law also provided protection to animals in circuses and zoos. Introduction
To prevent the infliction of unnecessary pain or suffering on animals and for that purpose to amend the law relating to this Act. 1. “Animals” means any living creature other than a human beings; 2. “Board” means the Animals Welfare Board established under Section 4; 3. “Captive animals” means Animals that are held by humans and prevented from escaping are said to be in captivity. 4. “Breeder” means a person including an institution , which breeds animals for purpose of transfer to other authorised institution for performing experiments. 5. “Experiment” means any programme/projects involving use of an animal/animals for the acquisition of knowledge of a biological, psychological, ethological, physical and chemical nature. Definitions: In this Act, unless the context otherwise requires:
6. “Domestic animal” means any animal which is tamed or which has been or is being sufficiently tamed to serve some purpose for the use of man or which although it neither has been nor is being nor is intended to be so tamed, is or has become in fact wholly or partly tamed; 7. “Local authority” means a Municipal Committee, District Board or other authority for the time being invested by law with the control and administration of any matters within a specified local area; 8. “Owner”, used with reference to an animal, includes not only the owner but also any other person for the time being in possession or custody of the animal , whether with or without the consent of the owner;
9. “ Phooka ” or “Doom dev” includes any process of introducing air or any substance into the female organ of a milch animal with the object of drawing off from the animal any secretion of milk; 10. “Prescribed” means prescribed by rules made under this Act; 11. “Street” includes any way, road, lane, square, court, alley passage or open space , whether a thoroughfare or not, to which the public have access.

The Central Govt. has constituted a committee with the following members. Nominated members: Two members each from ICMR, ICAR & CSIR. Two members representing medical and veterinary universities or universities issuing such degree. Elected members: One M.P from Lok Sabha and one M.P from Rajya Sabha . Five persons representing those who are actively engaged in the promotion of animal welfare. COMMITTEE FOR CONTROL AND SUPERVISSION OF EXPERIMENTS ON ANIMALS
1. Advice central govt. regarding amendments 2. Advice central govt regarding rules to prevent unnecessary pain with transporting, performing experiments or in captivity 3. Suggest govt. design of transport vehicle. 4. Take steps for amelioration (ACT OF MAKING SOMETHING BETTER) of animals by shed, water troughs, etc along with veterinary assistant. 5. Encourage financial assistant, formation of rescue home, animal shelter for old animals. 6. To advice govt. on medical care/attention provided in animal hospital. 7. To cooperate with association established for the same. 8. Impart the education to human relating to treatment 9. Advice to govt. matter related to animal welfare FUNCTIONS OF THE COMMITTEE
INSTITUTIONAL ANIMALS ETHIC COMMITTEE
Breeding and Stocking of animals:
Establishment shall apply and get prior permission from the committee or from the institutional animals ethics committee, for acquiring animal and or for conducting experiment on animals. Permission for Experiments:
Performance of Experiments
The committee or any of its officers are authorised to inspect any place or institute or establishment where experiments on animals are being performance and inspect and verify the records maintained about the experiment on animals. Entry and inspection
Records
If the committee is satisfied that any person or institute or establishment is not carrying out the experiments on animals in accordance with rules, it may prohibit such experiments on animals by such individual/institute/establishment for a definite period of time or indefinitely Prohibition of experiments
(a) The training of animals for bona fide military or police purposes or the exhibition of any animals so trained; or (b) Any animals kept in any zoological garden or by any society or association which has for its principal object the exhibition of animals for educational or scientific purposes. Exemptions
Under section 22 of the Act, Exhibition and training of animals-Bears, Monkeys, Tigers, panthers and lions are prohibited by the notification in 1998. Section 22 of the Act
Any person who contravenes any provision of the Act/Rules or condition imposed by the committee shall be punishable with fine. PENALTIES
