5 The 2008 Constitution of Ecuador Subtopic # 1: Constitution 2008, PND 2017-2021 The approval of the Ecuadorian 2008 Constitution through popular referendum was a transformative event (Brodsky, 2015). This constitution was the result of a prolonged process which began with the indigenous uprising in 1997 and the election of Rafael Correa as president in 2006 (Almeida, 2013). The uprising occurred in reaction to the implementation of neoliberal policies that excluded marginalized populations from the country's political and economic life (Becker & Clark, 2012). 8 The 2008 Constitution of Ecuador recognizes education as a fundamental right and emphasizes its importance for individual and societal development. The constitution mandates intercultural, plurinational , and bilingual education and recognizes Spanish and other native languages as official languages. The State is responsible for providing free and compulsory education up to the end of basic general education, including primary and secondary education. 9 The constitution guarantees the right to higher education and the State's responsibility to promote its democratization and quality improvement. The constitution recognizes the right to education for people with disabilities and the obligation of the State to provide education in inclusive environments. The constitution recognizes the right to lifelong learning and the obligation of the State to provide adult education programs and continuing education opportunities. The plan aims to achieve "good living" for all Ecuadorians. 17 History Subtopic #2: LOEI The LOEI was promulgated by the Ecuadorian National Assembly on June 10, 2011, and became law on June 28, 2011. It aimed to overcome the historical exclusion and discrimination that indigenous and Afro-Ecuadorian peoples had suffered in the education system.
