Lecture # 01: Introduction & Importance of mooting

What does mooting mean?
Mooting is an extra-curricular activity specifically
designed for law students to practically apply the
law and learn to present the case before a demo
court in order to be able to present the case before
an official court someday.
Moot Court Competitions:
Moot Court Competitions are a medium for
facilitating the students for mooting and adding an
essence of real court rooms by promoting healthy
competitions among the participants.
Format of Moot Courts
Theformat of a Moot Court Competition is divided into two
phases.
•Memorial Submission.
•Oral Rounds.
The teams are asked to draft memorial on the given moot
problem and upon submission to the Moot Court organizing
authority they move towards the final phase of oral rounds where
the teams display their advocacy skills coherent to their research
manifested in the memorial.
Court Room Environment
The environment of Moot Court room is
similar to the original one in the following
terms:
•Parties are replaced by the participants.
•Judges are replaced by the Moot Court
judges.
•Court readers are replaced by bailiffs.
Moot Problem
Moot problem is a fact sheet that marks the
starting point of any Moot Court
Competition. A Moot problem contains a
long story compiled by chain of incidents
that has happened and the students are
then assigned to formulate their arguments
in the favour or against of the issues given
in the moot problem.
How to effectively read a moot problem?
The reading of Moot problem is the pertinent in Moot Courts. It can be annoying for judges when the speakers has no
grip on the Fact sheet. Judges can compromise on law but not on facts! because facts are literally handed over
to you rather than laws which you need to search. Following steps should be considered while scrutinizing a MP.
•Note the subject Matter.
•Note the law used (Domestic/International)
•Note the Court and its Jurisdiction.
•Note the geography of countries/ cities mentioned.
•Note the timeline through out of the Moot Problem
•Note the difficult/new words sometimes they help a lot in solving the issue.
•Note the technical aspects of a Moot Problem such as, Artifacts in museum can be destroyed through
turning off the special setting of museum rather than firing a missile on the building or breaking in and
destroying everything by hand.
•Learn about the Acts that are mentioned in the Moot Problem first, read commentaries, caselaws
regarding them (Mostly Acts are mentioned in the domestic Moot Problems)
