What is
article370 ?
Article 370 of the Indian Constitution
states that all provision of the
Constitution, as amended from time to
time, apply to the State of Jammu &
Kashmir. The article also states that the
Constituent Assembly of Jammu &
Kashmir is empowered to recommend
which articles of the Indian Constitution
should apply to the state. It is added in
Part XXI of the Indian Constitution.

Past & background of article 370

the Instrument of Accession,
wherein a ruler of a princely
state could accede his kingdom
into the 'Federation of India'.

Abrogationof

After the Centre abrogated special status of Jammu and
Kashmir under Article 370 on August 5, 2019, restoration of
peace and developmental activities taking peace,
compared to the past, stands out as its most significant
achievements. It is after more than three decades, time that
public and social life in the erstwhile state, in general, and
the Valley in particular, are back to normal routine without
disruption
The August 5, 2019 momentous decision also marked a
drastic decline in terrorist activities and nepotism in the
Valley
. According to official data several infiltration attempts have
been foiled in 2023 and not more than 12 locals have
joined militancy till July end. It has brought down the
number of active militants to double digit.

One of the best things that happened in Kashmir after the abrogation of Article 370 sections is
the restoration of administrative control. Encouraged and assured by the safe environment in
J&K, investment projects worth nearly Rs 25 thousand crore are under execution in the UT while
proposals to the tune of over Rs 80 thousand crores are under process. Since Independence,
J&K had received private investments to the tune of Rs 14,000 crore only.
the UT has received investment proposals worth Rs 81,122 crore in the year of 2021 and 2022.
Nearly 18,000 kanals(2250 acres) of land, as against a total 39,022 kanals(4877 acres) sought
for setting up key units, has already been allotted across both Jammu and Kashmir divisions.
There are no takers for strike calls imposed by separatists and militants in Kashmir anymore as
the common man has started to reap the dividends of peace. Before the abrogation of Article
370, not only businesses, but the education sector in Kashmir suffered immensely due to
frequent strike calls, stone pelting incidents and violence in Kashmir.Itis also attracting more

On August 5th and 6th, 2019, the Union government repealed Article
370, revoking Jammu and Kashmir’s special status. This provision had
three main ingredients. First, India would not make laws in Jammu and
Kashmir except for three subjects included in the Instrument of
Accession. Second, no provisions of the Indian Constitution would be
applicable to Jammu and Kashmir except for Article 1, which declared
India as a ‘Union of States, Third, according to Article 370(3), the special
status of Jammu and Kashmir could not be amended or repealed, unless
the Constituent Assembly of Jammu & Kashmir recommended it.
“Disappointed but not disheartened,” Omar Abdullah, a former chief
minister and vice president of the Jammu & Kashmir National
Conference party, said. “The struggle will continue.
Mehbooba Mufti, another former chief minister and president of the
Jammu and Kashmir People’s Democratic Party, echoed those views.

Today, the Scheduled Tribe community has got political reservation in
Jammu and Kashmir.
For the first time, OBC community has been identified in Jammu and
Kashmir.
In Jammu and Kashmir, if a woman, whether Hindu, Muslim or Sikh,
married outside the state then all her rights were taken away.
Today women have got freedom in the true sense.
Education and Employment has also risen.

conclusion
In Conclusion, the debate over Article 370 of the Indian Constitution,
which granted special autonomy to Jammu and Kashmir, has been
contentious. Its abrogation in August 2019 led to both praise and
criticism. Legal challenges continue, focusing on the constitutionality of
the move and the reorganization of the region into two Union
Territories. The resolution of these issues will have significant
implications for the future of Jammu and Kashmir, requiring sensitive
dialogue and adherence to constitutional principles to achieve lasting
solutions
