CHILDRENINSCHOOLFROMABUSE,VIOLENCE,
EXPLOITATION,DISCRIMINATION,BULLYINGAND
OTHERFORMSOFABUSE”

DepEDChildProtectionPolicy
Thepolicyaimtoprotectthechildfromallforms
ofviolencethatmaybeinflictedbyadults,persons
inauthorityaswellastheirfellowstudents,
includingbullying.
Toprovidespecialprotectiontochildrenwhoare
gravelythreatenedorendangeredby
circumstanceswhichaffecttheirnormal
developmentandoverwhichtheyhavenocontrol,
andtoassisttheconcernedagenciesintheir
rehabilitation.

Toensurethatsuchspecialprotectionfromall
formsofabuseandexploitationandcareasis
necessaryforthechild'swell-being,takinginto
accounttheprimaryrightsanddutiesofparents,
legalguardians,orotherindividualswhoare
legallyresponsibleandexercisecustodyoverthe
child.
Zerotoleranceforanyactofchildabuse,
exploitation,violence,discrimination,bullyingand
otherformsofabuse.

Thepolicyguidelineshavelisteddownthespecific
actsthatconstitutechildabuseandviolence
whichpublicandprivateschoolscasesusedas
aguideinaddressingthissocialproblem.

Section3(2)ArticleXVofthe1987Constitution
*thestateshalldefendtherightofchildrentoassistance,
includingpropercareandnutrition,andspecialprotection
fromallformsofneglect,abuse,cruelty,exploitationand
otherconditionsprejudicialtotheirdevelopment.
ConventionontheRightsoftheChild(CRC)
*aimstoprotectchildrenfromallformsofphysicalor
mentalviolence,injuryandabuse,neglectornegligent
treatmentmaltreatmentandexploitation,includingsexual
abuse.

CHILD
–referstoanypersonbeloweighteen(18)yearsof
ageorthoseoverbutareunabletofullytakecare
ofthemselvesorprotectthemselvesfromabuse,
neglect,cruelty,exploitationordiscriminationof
physicalormentaldisabilityorcondition(RA7610).
--includespupilsorstudentswhomaybeeighteen
(18)yearsofageorolderbutareinschool.

CHILDRENINSCHOOL
--referstobonafidepupils,studentsorlearners
whoareenrolledinthebasiceducationsystem,
whetherregular,irregular,transfereeorrepeater,
includingthosewhohavebeentemporarilyoutof
school,whoareintheschoolorlearningcenters
premisesorparticipatinginschoolsanctioned
activities.

--meansachildwhoregularlyattendsclassesin

PROHIBITEDACT:
CHILDABUSE–referstothemaltreatmentofa
childwhetherhabitualornot,whichincludesthe
following:
1)Psychologicalorphysicalabuse,neglect,cruelty,
sexualabuseandemotionalmaltreatment.
2)Anyactordeedsorwordswhichdebases,
degradesordemeanstheintrinsicworthdignityof
achildasahumanbeing.

PROHIBITEDACT:
CHILDABUSE
3)Unreasonabledeprivationofthechild'sbasic
needsforsurvivalsuchasfoodandshelter;or
4)Failuretoimmediatelygivemedicaltreatmentto
aninjuredchildresultinginseriousimpairmentof
hisorhergrowthanddevelopmentorinthechild's
permanentincapacityordeath.

PROHIBITEDACT:
DISCRIMINATIONAGAINSTCHILDREN
-referstoanactofexclusion,distinction,restrictionor
preferencewhichisbasedonanygroundsuchasage,
ethnicity,sex,sexualorientationandgenderidentity,
language,religion,politicalorotheropinion,nationalor
socialorigin,property,birth,beinginflictedbyAIDS,being
pregnant,beingachildinconflictwiththelaw,beinga
childwithdisabilityorotherstatusorcondition,andwhich
hasthepurposeoraffectofnullifyingorimpairingthe
recognition,enjoymentorexercisebyallpersonsonan
equalfooting,ofallrightsandfreedom.

CORPORALPUNISHMENT
-Referstoakindofpunishmentorpenalty
imposedforanallegedoractualoffense,whichis
carriedoutorinflicted,forthepurposeof
discipline,trainingorcontrol,byateacher,school
administrator,anadult,oranyotherchildwho
hasbeengivenorhasassumedauthorityor
discipline.Itresponsibilityforpunishmentor
includesphysical,humiliatingordegrading
punishment,includingbutnot
following:

1)Blowssuchas,butnotlimitedto,beating,
kicking,hitting,slapping,orlashing,ofany
partofachild’sbody,withorwithoutthe
useofaninstrumentsuchas,butnotlimited
toacane,broom,stick,whiporbelt;
2)Strikingofachild’sfaceorhead,suchbeing
declaredasa“nocontractzone”;
3)Pullinghair,shaking,twistingjoints,cutting
orpiercingskin,dragging,pushingorthrowing
ofachild;

4)Forcingachildtoperformphysicallypainfulor
damagingactssuchas,butnotlimitedto,holdinga
weightorweightsforanextendedperiodandkneeling
onstones,salt,pebblesorotherobjects;
5)Deprivationofachild’sphysicalneedsasaformof
punishment;
6)Deliberateexposuretofire,icewater,smoke,
sunlight,rain,pepper,alcohol,orforcingthechildto
swallowsubstances,dangerouschemicals,andother
materialsthatcancausediscomfortorthreaten
thechild’shealth,safetyandsenseofsecuritysuch
as,butnotlimitedtoinsecticides,excrementorurine;

libertyofachild;
9)Verbalabuseorassaults,includingintimidationor

ordisrobe,orputonanythingthatwillmakea
childlookorfeelfoolish,whichbelittlesor
humiliatesthechildinfrontofothers;

forsomeoneelse'sadvantage,gratificationor
profitresultinginanunjust,cruelandharmful
treatmentofthechild.
Twoforms:
1)Sexualexploitation–abuseofpositionof
vulnerability,differentialpower,ortrust,forsexual
purposes.
2)Economicexploitation–useofthechildinwork
orotheractivitiesforthebenefitofothers.

BULLYINGORPEERABUSE
iscommittedwhenastudentcommitsanact
oraseriesofactsdirectedtowardsanother
student,oraseriesofsingleactsdirected
towardsseveralstudentsinaschoolsettingor
aplaceoflearning,whichresultsinphysicaland
mentalabuse,harassment,intimidation,or
humiliation.

a)Threatstoinflictawronguponaperson,honoror
propertyofthepersonoronhisorherfamily;
b)Stalkingorconstantlyfollowingorpursuingaperson
inhisorherdailyactivities,withunwantedandobsessive
attention;
c)Takingofproperty;
d)Publichumiliation,orpublicandmalicious
imputationofacrimeorofaviceordefect,whetherreal
orimaginary,oranyact,omission,condition,status,or
circumstancetendingtocausedishonor,discreditor
exposeapersontocontempt;

BULLYING
e)Deliberatedestructionordefacementof,ordamageto
thechild'sproperty;
f)Physicalviolencecommitteduponastudent,whichmay
ormaynotresulttoharmorinjury,withorwithouttheact
ofweapon.Suchviolencemaybeintheformofmauling,
hitting,punching,kicking,throwingthingsatthestudent,
pinching,spanking,orothersimilaracts;
g)Demandingorrequiringsexualormonetaryfavorsor
exactingmoneyorpropertyfromapupilorstudent;and
h)Restrainingthelibertyandfreedomofapupilorstudent.

CYBER-BULYING
---isanyconductwhichresultstoharassment,
intimidation,orhumiliation,throughelectronic
meansorothertechnology,suchas,butnotlimited
totexting,email,instantmessaging,chatting,
websitesorotherinternet,socialnetworking
platformsorformats.

PROCEDURESINHANDLINGBULLYING

*itshallbeacteduponbytheSchoolHeadwho
shallinformtheparentsorguardiansofthe
victimandoffendingchild;

complaintinwriting;
2)Thechildshallbegiventheopportunitytoanswerthecomplaint

3)Thedecisionoftheschoolheadmustbewriting,statingthe
factsandthereasonsforthedecisions;
4)Thedecisionoftheschoolheadmaybeappealedasprovidedin
existingrulesoftheDepartment.

Ifthebullyingorpeerabuseresultedinserious
physicalinjuriesordeath,wheneverappropriate,the
caseshallbedealthwithinaccordancewiththe
provisionsofRepublicActNo.7610andits
ImplementingRulesandRegulations.

IMPLEMENTATIONOFNON-DISCIPLINARY
MEASURES
Dependingonthegravityofthebullying
committedbyanypupil,studentorlearner,the
schoolmayimposeothernon-disciplinary
measures.

PrivateSchools:
Complaintagainstschoolpersonnelorofficial
Acomplaintforchildabuse,violence,exploitationor
discriminationinaprivateschoolshallbefiledwiththe
SchoolHead/ChiefExecutiveOfficerandshallbeacted
uponpursuanttotheschool'srulesofprocedureson
administrativecases.Thepenaltyshallbethatwhichis
providedbytherulesoftheschool,subjecttothe
requirementsofdueprocess.
Theadministrativecasesshallbewithoutprejudiceto
anycivilorcriminalcasesthatmaybefiled.

Theinvestigationshallbeinaccordancewiththe
RevisedRulesofProcedureoftheDepartmentof
