Civil Services Rules 1973 An act to Regulate the appointment of persons to , and the term and conditions of services of persons in the service to Pakistan. Regularizations of Civil servants Code of Conduct Giving a proper procedure of recruitment, promotion, dismiss from services and probation Centralization of Pay , Promotion , Seniority and Recruitment.

An overview of Act Short title , Application and commencement. This act may be called a Civil Servant Act, 1973. It applies to all Civil Servants Wherever they may be. It shall come into force at once.

Chapter 4 : RULES Rules (1) The President or any Person authorized by the President in this behalf, may make such rules as appear to him to be necessary or expedient for carrying out the purposes of this act. (2) Any Rules, Order or instructions in respect of any term and conditions of Services of Civil Servants duly made or issued by Competent Authority to make them and inforce immediately before the commencement of this act shall, in so far as such rules , orders, or instructions are not inconsistent with the provision of this Act, be deemed to be rules made under this Act.

Initiations of Proceedings Provision of Documents Accused to be informed Reasonable opportunity for accused of Showing Cause within 10 to 14 Days. An opportunity of Personal Hearing to be provided to accused. After the Reply Authority should reply within 30 Days. Release the Accused in case of Victim. Impose Penalties if the Accused is guilty.

Rules of Inquiry Record of the Case and the list of witnesses may be provide to inquiry committee Charges should be communicated to accused with in 14 Days Direction of the Accused to submit his written defense within to Days Failure of Submitting accused Reply will be considered Ex-Parte. Witness Statement will be taken in presence of accused. Accused claim for Medical Ground/Leave will be recommended by Authorized Medical Officer during the Inquiry. Inquiry shall be completed within 60 Days Inquiry Reports must contain clearly findings charged or not charged.

Rules of Inquiry Accused can complete training if already joined training. Accused’s Leave shall be cancelled by the authority/ called back from the leave. Authority to ensure the proceeding Report from Inquiry Officer/Committee has been conducted according to the rule/facts, Order and take explanation from the Inquiry Officer Providing him reasonable opportunity for showing cause and can reconsider inquiry committee decision.

Power of Inquiry Officer Summoning and enforcing the attendance of any person or examining him. Requiring Production of Documents. Receiving evidences on Affidavit Issuing Commissions for the examination of Witnesses/Documents. The proceedings under these rules shall be deemed to be judicial proceedings with in the meaning of section 193 and 228 of the Pakistan Panel Code.

Responsibilities Render Full Assistance to the Inquiry Officer Fully Prepared with all the relevant Record. Cross examined the witnesses provided by the accused. Rebut (oppose a formal legal argument) the grounds of defense offered by the accused before the inquiry committee In case of Failure of Departmental Duties, may be liable for departmental proceedings.
