Plantiff : Party who initiates the lawsuit. Defendant : Party against whom the lawsuit is initiated by plantiff . Summon or Subpoena : Document compelling the attendance of a witness in the court of law under penalty . Oath : Solemn affirmation substituted by law or any declaration authorized by law to be made in court touching the matter that the evidence put by witness infront of court shall be the truth, the whole truth, nothing but truth . Evidence : All the statements and documents which court permits to be made before it by witness in relation to the matter of fact under enquiry. Two types of Evidences Oral Evidence : Statements Documentary evidences includes certificates, veterolegal reports, examination of exhibits and veterolegal reports. Witness : Person who gives sworn testimony or evidence in the court of law in relation to matter of fact under the inquiry . Two types of witness Common witness is one who testify/gives evidence to the fact observed, herd or perceived. They can not made inferences and opinions . Expert witness: ( Sxn 45) is one who by virtue of his professional training is capable of forming opinion or draw conclusions from the facts observed or noticed by him. Example Doctor, Veterinarian, finger expert etc. Terminologies of Courtroom Procedures
1. Examination in chief/Direct examination Examination of witness by the counsel of party who calls him 2. Cross examination Examination of witness by the counsel of accused who tries to elicit the facts. Leading questions (Questions suggesting the answer) are allowed Test the veracity, position in life, shake the credit and injure the character of witness to expose him 3. Re-examination: Counsel which performs examination in chief has right to reexamine the witness and clear the misunderstanding occurring during cross examination. 4. Question put by judges: Judge may ask any question to disclose the fact. Sequential Procedure of Recording Evidences
Always put the facts before going to court from your original notes . Prepare the answers of possible questions you may be asked. Speak slowly and distinctly and avoid technical terms\ Answer in yes or no as far as possible If unable to anser say “I cannot answer”. Donot loose your temper Avoid quotations from book. Draw opinion from your knowledge and experience Hints of recording of evidence in court
