Violence encompasses

What is Domestic violence?
SEC-3.ForthepurposesofthisAct,anyact,omissionor
commissionorconductoftherespondent(person)shall
constitutedomesticviolenceIncaseit-----
•harmsorinjuresorendangersthehealth,safety,life,limborwellbeing,
•whethermentalorphysical,oftheaggrievedpersonortendstodosoand
includes
•causingphysicalabuse,sexualabuse,verbalandemotionalabuseand
economicabuse;or

explanation
1.“Physical abuse" means any act or conduct which is of such a
nature as to cause bodily pain, harm. or danger to life, limb, or
health or impair the health or development of the aggrieved
person and includes assault criminal intimidation and criminal
force;
2.“Sexual abuse" include, any conduct of a sexual nature that
abuses, humiliates, degrades or otherwise violates the dignity
of woman;
3. “Verbal and Emotional abuse" Includes-
(a) insults, ridicule, humiliation, name calling and insults or
ridicule specially with regard to not having a child or a male
child; and
(b) repeated threats to cause physical pain to any person in whom
theaggrieved person is interested.

4.“Economic abuse" Includes-
1.Deprivationofalloranyeconomicorfinancialresourcestowhichthe
aggrievedpersonisentitledunderanylaworcustomwhetherpayableunder
anorderofacourtorotherwiseorwhichtheaggrievedpersonrequiresoutof
necessityincluding,butnotlimitedto,householdnecessitiesfortheaggrieved
personandherchildren,ifany,stridhan,property,jointlyorseparatelyowned
bytheaggrievedperson,paymentofrentalrelatedtothesharedhousehold
andmaintenance;
(b)disposalofhouseholdeffects,anyalienationofassetswhethermovableor
immovable,valuables,shares,securities,bondsandthelikeorotherproperty
inwhichtheaggrievedpersonhasaninterestorisentitledtousebyvirtueof
thedomesticrelationshiporwhichmaybereasonablyrequiredbythe
aggrievedpersonorherchildrenorherstridhanoranyotherpropertyjointly
orseparatelyheldbytheaggrievedperson;and
(c)prohibitionorrestrictiontocontinuedaccesstoresourcesorfacilities
whichtheaggrievedpersonisentitledtouseorenjoybyvirtueofthe
domesticrelationshipincludingaccesstothesharedhousehold.

Important inserted sections in criminal law
Section 326A –Voluntarily causing grievous hurt by use of
acid etc
Whoever causes permanent or partial damage or deformity to, or
burn or maims or disfigure or disable, any part of the body of a
person or cause grievous hurt by throwing acid on or by
administering acid to that person, or using any other means with the
intention of causing or with the knowledge that he is likely to cause
such injury or hurt, shall be punished with imprisonment for
life, and with fine.

Section 326 B –Voluntarily throwing or attempting to
throw acid
•Whoeverthrowsorattemptstothrowacidonanypersonorattempts
toadministeracidtoanyperson,orattemptstouseanyother
means,withtheintentionofcausingpermanentorpartialdamageor
deformityorburnsormaimingordisfigurementordisabilityor
grievoushurttothatperson,shallbepunishedwithimprisonmentof
eitherdescriptionforatermwhichshallnotbelessthanfiveyears
butwhichmayextendtosevenyears,andshallalsobeliabletofine

Section -354A -Sexual Harassment
Definition of Sexual Harassment –
•(i) physical contact and advances involving unwelcome and explicit sexual
overtures; or
•(ii) a demand or request for sexual favors; or
(iii) making sexually colored remarks; or
•(iv) forcibly showing pornography; or
•(v) any other unwelcome physical, verbal or non-verbal conduct of sexual
nature.
Punishment-Rigorous imprisonment up to five years, or with fine, or
with both in case of offence described in clauses
•(i) & (ii)Imprisonment up to one year, or with fine, or with both in other
cases

Section -354B Public disrobing of Woman
Anymanwhoassaultsorusescriminalforcetoanywomenorabets
suchactwiththeintentionofdisrobingorcompellinghertobe
naked,shallbepunishedwithimprisonmentofeitherdescription
foratermwhichshallnotbelessthanthreeyearsbutwhichmay
extendtosevenyears,andshallalsobeliabletofine.

Anymanwhowatches,orcapturestheimageofawomenengageina
privateactincircumstanceswhereshewouldusuallyhavethe
expectationofnotbeingobservedeitherperpetratororbyanyother
personatthebehestoftheperpetratorordisseminatessuchimageshall
bepunishedonfirstconvictionwithimprisonmentofeitherdescription
foratermwhichshallnotbelessthanoneyear,butwhichmayextend
tothreeyears,andshallalsobeliabletofine,andbepunishedona
secondsubsequentconviction,withimprisonmentoneitherdescription
foratermwhichshallnotbelessthanthreeyears,butwhichmayextend
tosevenyears,andshallalsobeliabletofine.
Section 354C –Voyeurism

Whoeverfollowsapersonandcontacts,orattemptstocontactsuch
persontofosterpersonalinteractionrepeatedly,despiteaclear
indicationofdisinterestbysuchperson,orwhoevermonitorsthe
usebyapersonoftheinternet,emailoranyotherformofelectronic
communication,orwatchesorspiesonapersoninamannerthat
resultsinafearofviolenceorseriousalarmordistressinthemind
ofsuchperson,orinterfereswiththementalpeaceofsuch
person,commitstheoffenceofstalking
Section 354D –Stalking

WHAT WE CAN DO ?
• Recognizeabuse,Domesticabuse,asperthedomesticviolenceAct,
includesactualabuseorthreatofabusethatisphysical,sexual,verbal,
emotionalandeconomicalabuse.
•Say No. Speak up. Or it will become pattern. You have to raise your voice
instantly
•Understandthatyouhaverightsalongwithresponsibilitiesandduties.The
Actassuresyoutherighttosecurehousinginthesharedhouseholds,
whetherornotyouhaveanytitlerightstoit.
•UndertheAct,thecourtcanpassprotectionordersthatpreventtheabuser
fromcommittingorthreateninganyviolence.
•Raiseyourvoiceagainstdomesticabusenotjustinyourownhouse,but
alsothatofyourneighbors,friendsandevenstrangers.

• Increase women’s participation at all levels:
social, economic and political.
• Awareness of women’s rights –by the State, civil society
organizations, as well as the public at large.
• Gender budgeting and gender mainstreaming within State
agencies and civil society organizations
