What does the OSHA 1994 say? 30. Establishment of safety and health committee at place of work. Every employer shall establish a safety and health committee at the place of work in accordance with this section if- there are forty or more persons employed at the place of work;or the Director General directs the establishment of such a committee at the place of work. 31. Functions of safety and health committee. The safety and health committee established at a place of work pursuant to section 30. shall keep under review the measures taken to ensure the safety and health of persons at the place of work; shall investigate any matter at the place of work- which a member of the committee or a person employer thereat consider is not safe or is a risk to health ; and which has bbeen brought to the attention of the employer, c) Shall attempt to resolve any matter referred to in paragraph(b) and if it is unable to do so, shall request the Director General to undertake an inspection of the place of work for that purpose ; and d) Shall have such other function as may be prescribed.

Unable or incapable of discharging his duties as a members.
PART III: FUNCTION OF SAFETY AND HEALTH COMMITTEE Assist in development of safety and health rules and safe systems of work. Review the effectiveness of safety and health programmes. Carry out studies on the trends of workplace incidents. Shall report to the employer of any unsafe or unhealthy condition or practices at the place or work together with recommendations for corrective actions. Review the safety and health policies at the place of work and make recommendations to the employer for any revision of such policies.

How to Handle Safety Complaints?
Handling Complaint – 16& 17 If the committee does not agree with any of the reasons given by the employer or his, the committee shall make a request to DOSH to undertake an inspection of the place of work and to resolve the matter. An employer implement every recommendation If for any reason he or his authorised manager is unable to implement any of the recommendations, he shall convey his reason to the safety and health committee The SH Committee investigate the matter & make a report & recommendation If employer / authorised manager unable to take immediate measures, the affected employee or the manager may refer the matter to the SH Committee
Part IV: Provisions of training and information An employer to ensure that members of the Safety and Health Committee have a basic understanding and knowledge of the functions of the committee under the Act. An employer to provide the members of a safety and health committee with adequate traning in OSH so as to enable them to perform the function of the committee effectively. Duty to make available relevant document and information by employer. The Act and all subsidiary legislation make under the Act. Applicable industry codes of practice and guidelines relating to OSH. Information about safety plans and their implementation, and any proposed changes to the safety plan affecting the safety and health of employees; Technical information about safety and health hazards and precautions. Part II – Registration of Safety and Health Officer No person shall act as a safety and health officer unless he is registered with Director General. The Director General shall issue certificate of registration. It valid for a period of three years from the date of registration. A person who is registered as a SHO shall attend any continuous education programme (CEP) at least once in a year for the purpose of renewal registration. Cancellation of registration : Has ceased to became a safety and health officer. Has been convicted of any offence under the Act or any regulations made under the Act. Has not met any requirements stipulated under these Regulation or any order made by the Minister under subsection 29(4) of theAct ; or Has obtained registration by misrepresentation or fraud.
Part III – NOTIFICATION OF SAFETY AND HEALTH OFFICER An employer shall notify in writing to the Director General within one month of any- Appoiment of a safety and health officer Termination or resignation of a safety and health officer. Note: In a case of death, sickness or absence from work of safety and health officer, the Director General may, notwithstanding the provisions of these Regulation, authorised the employer, by certificate in writing, allow work to be carried out for a period not exceeding three calender month without the safety and health officer (Reg.21).
Part IV – DUTIES OF AN EMPLOYER To advice the employer or any person in charge of a place of work on the measures to be taken in the interests of safety and health of the person employed in the place of work. To inpect the place of work, is of such nature liable to cause bodily injury to any person working in the place of work. To investigate any incident which has happened in the place of work. To assist the employer or the safety and health committee. To become secretary to the safety and health committee & perform all function of a secretary as specified in that Regulation.
(Cont.) Part IV : Duties of SHO 6. To assist the safety and health committee in any workplace inspection for the purpose of checking the effectiveness and efficacy of any measures taken in compliance with OSHA. 7. To collect, analyse and maintain statistics on any incident. 8.To assist DOSH officer in carrying out his duty under the Act or any regulations made under the Act; and 9. To carry out any other instruction made by the employer or any other person in charge of the place of work on any matters pertaining to safety and health of the place of work. 10. Before the tenth of a preceding month, submit a report pertaining to his activities to the employer – An employer or any person in charge of a place of work after receiving the report shall not later than two week after the receipt discuss the report with the safety and health officer.

What does the law say ? A safety and health committee shall meet as often as may be necessary commensurate with the risks attendant on the nature of work at the place of work but shall not meet less than once in three months . A meeting shall be called immediately in the event of an accident which results in loss of life or serious bodily injury to any person, a near-miss accident, a dangerous occurrence or any other situation which calls for immediate attention in order to ensure the safety and health of employees at the place of work.
