PRINCIPLES OF GRANTING
EXTENSION IN TIME
Onlywhenthereisgoodcauseshownbythepetitioner
Whenapplicantactsingoodfaith
Whenthedoingofprescribedactwasbeyondcontrolof
applicant
Whetherapplicantisactingvigilantly
ORDER OF GRANTING EXTENSION
OF TIME MUST BE WITH REASONS
Section 24-a of general clauses act, 1897 speaks as under
24A.Exerciseofpowerunderenactments.–(1)Where,byorunderanyenactment,a
powertomakeanyorderorgiveanydirectionisconferredonanyauthority,officeor
personsuchpowershallbeexercisedreasonably,fairly,justlyandfortheadvancement
ofthepurposesoftheenactment.
(2)Theauthority,officeorpersonmakinganyorderorissuinganydirectionunderthe
powersconferredbyorunderanyenactmentshallsofarasnecessaryorappropriate,
givereasonsformakingtheorderorasthecasemaybeforissuingthedirection
andshallprovideacopyoftheorderorasthecasemaybethedirectiontotheperson
affectedprejudicially

I.WhentimeisfixedbyanyotherLAW.E.g.pre-emptionactsection
24i.e.timeof30daysfordepositofzar-e-soem,financial
institution(recoveryoffinances)ordinance2001etc.
II.Whendecreehasbeenpassedandcourtbecomesfunctusofficio
III.Courtcannotextendtimewhenitisfixedbydecree
IV.Whencourtlacksjurisdiction
V.Whenapplicantdoesnotactwithbonafide
VI.Whensufficientopportunitieshavebeenalreadygivenbycourt
VII.Whentimeisfixedbyorderofasuperiorcourt
