Establishment of High Courts
High Courts Act of 1861: Cause:- Dual Judiciary i.e. crown (SC ) and company courts (Adalat system). Conflict of Jurisdiction Objective:- To abolish dual judiciary. New judicial system. Chief Justice and Puinse Judges Qualification:- Barristers to practise (5 yrs exp.) and passed the Civil Convented Service or a Zila Judge with 10 yrs of exp.
Jurisdiction of HC: Civil, Criminal Admiralty, Testamentary, Instate, Matrimonial Original and Appellate and appeals from HC to go to Privy Council…. Demerits:- Biased Only English… Only in presidency towns.
HIGH COURTS ACT OF 1911 Increase in the number of Judges Additional Powers Governor general in Council had more authority HIGH COURTS During the Independence period:- Punjab after the partition. Assam:- established by provisional constitution Orissa and Rajasthan Kerela established by an ordinance J and K by a patent letter.
