FOREST LAND USE PLAN 2020-2029

Public lands as part of the LGU’s territory – includes both protection and conservation and production and uses Biodiversity conservation areas include those in NIPAS and non-NIPAS areas (may be in located in forest lands, ancestral domains, A&D, foreshore, mangroves, coastal/marine areas) The regulation and management of public lands and biodiversity conservation areas in NIPAS and non-NIPAS areas become the joint responsibility of DENR and LGU FLUP is part of the LGU’s CLUP

FOREST LAND USE PLAN 2020-2029

1987 Philippine Constitution (Art. XII, sect. 2)…. “All lands of the public domain, waters, minerals, coal, petroleum, and other mineral oils, all forces of potential energy, fisheries, forests or timber, wildlife, flora and fauna, and other natural resources are owned by the State.” Legal Bases of Forest Land Use Plan (FLUP)

1987 Philippine Constitution ( Art. XII, sect. 2 ) “The exploration, development, and utilization of natural resources shall be under the full control and supervision of the State. The State may directly undertake such activities, or it may enter into co-production, joint venture, or production-sharing agreements with Filipino citizens, or corporations or associations at least sixty per centum of whose capital is owned by such citizens.” Legal Bases of Forest Land Use Plan (FLUP)

E.O. 192 (s. 1987) Section 4: “The Department shall be the primary government agency responsible for the conservation, management, protection, proper use and sustainable development of the country's environment and natural resources...” Legal Bases of Forest Land Use Plan (FLUP)

R.A. 7160 ( Chapter 1, sect. 3, i ), 1991 “Local government units shall share with the national government the responsibility in the management and maintenance of ecological balance within their territorial jurisdiction, subject to the provisions of this Code and national policies” Legal Bases of Forest Land Use Plan (FLUP)

DENR-DILG JMC 98-01 ( Sect. 1.3 ) Comprehensive land use and forest land use plans are important tools in the holistic and efficient management of forest resources. Toward this end, the DENR and the LGUs together with other government agencies shall undertake forest land use planning as an integral activity of comprehensive land use planning to determine the optimum and balanced use of natural resources to support local, regional and national growth and development. JMC 98-01 ( Sect. 9.1 - a) a) DENR Central Office shall issue an order directing the REDs to organize within sixty (60) days from issuance thereof, Forest Land Use Planning (FLUP) teams at the provincial, city and municipal levels in coordination with the concerned local chief executives. Corollary, the concerned local chief executives shall issue the appropriate orders for their LGUs participation in the FLUP; Legal Bases of Forest Land Use Plan (FLUP)

JMC 98-01 ( Sect. 9.1 - a) b) The FLUP Teams shall organize their work and undertake FLUP within twelve (12) months from their organization; c) The FLUPs thus formulated shall be submitted to the LGU's Sanggunian for endorsement/approval and incorporation of the same to the LGU's comprehensive land use plan; Legal Bases of Forest Land Use Plan (FLUP)

DENR-DILG JMC 2003-01 ( Sect. 3 ) “The following shall be the primary concerns of the partnership: 3.1 Technical b)The undertaking of transparent, accountable and participatory forest land use planning for each LGU (or collection of contiguous LGUs) in which the roles and responsibilities of national and local agencies and other sectors are clearly specified” Legal Bases of Forest Land Use Plan (FLUP)

JMC 2003-01 ( Sect. 5 ) All FLUPs of LGUs shall be approved by their respective city/ municipal development councils and need to be enacted as ordinances by their respective Sangguniang Panglungsod / Bayan as part of their comprehensive land use plans. DENR approval of the FLUP shall follow its enactment as an ordinance and such approval shall be manifested through a MOA between DENR and the LGU. The DENR Regional Executive Director shall sign all MOAs on approved FLUPs on behalf of DENR with the DILG as witness. Legal Bases of Forest Land Use Plan (FLUP)

CHAPTER 1 – BACKGROUND CHAPTER 2 – CONDITION OF FORESTLAND CHAPTER 3- MEDIUM-TERM PLAN FLUP CHAPTERS

The overall strategy is to have a combined, inclusive and collaborative effort of the Local Government Unit (LGU), the Department of Environment and Natural Resources (DENR), other NGAs and all other stakeholders to attain the Vision-Mission-Goals of this first FLUP of the Municipality of San Jose. FLUP OVERALL STRATEGY

The overall strategy is to have a combined, inclusive and collaborative effort of the Local Government Unit (LGU), the Department of Environment and Natural Resources (DENR), other NGAs and all other stakeholders to attain the Vision-Mission-Goals of this first FLUP of the Municipality of San Jose. FLUP OVERALL STRATEGY

Objectives: a) To optimize utilization of land and water resources through strict implementation and enforcement of zoning Ordinance, CFRM Ord. and other related laws; b) To identify and establish forest production and protection lands (allocation/sub-allocation); c) To protect the remaining second growth forest to enhance biodiversity; d) To rehabilitate denuded areas for water production; e) To establish other areas for Marine Reserve (Tapon Norte and Jilocon ); Goal 1: Sustainable utilization of lands and water resources and protection of critical environmental areas.

Objectives: a) To increase agricultural production (corn, root crops and vegetables etc.); b) To upgrade agricultural infrastructure support facilities and amenities; c) To improve marketing assistance and services in crop, livestock and poultry production; d) To develop all tourism potential sites; Goal 2: Improvement of local economy through improved/maximized agricultural production, and development and promotion of all tourism potential sites.

Objectives: e) To institutionalize, promote and sustain tourism, culture and arts programs and activities in the municipality; f) To conduct tax mapping; and g) To promulgate supportive local policies/ordinances and incentive system to encourage private and public sector investments. Goal 2: Improvement of local economy through improved/maximized agricultural production, and development and promotion of all tourism potential sites.

Objectives: a) Establish sustainable levels of service for basic services (i.e. health and sanitation, fire, police, social welfare, water, parks, and greenways maintenance) that are in line with the available revenue sources. Goal 3. Adequate access to basic services and facilities

Objectives: a) Provide disaster and climate change resilient infrastructure support facilities; b) To install local mechanisms to protect the lives and properties of the community especially those settled within the hazard prone areas; - Provide signages and early warning system; - Equipped with rescue equipment and materials; c) To maintain peace and order in the locality; d) To strictly implement laws, ordinances and administrative orders concerning forest protection lands. Goal 4. A healthy and safe environment.

Objectives: a) Strengthen the collaboration with National Government Agencies, Academic Institutions, NGOs, POs for planning, budgeting, program/project implementation and monitoring and evaluation activities. b) To establish and maintain fed backing mechanism. c) To establish and update database and conduct efficient regular reporting of programs, projects and activities. Goal 5. Responsive, transparent and accountable governance.

Objectives: a) Strengthen the collaboration with National Government Agencies, Academic Institutions, NGOs, POs for planning, budgeting, program/project implementation and monitoring and evaluation activities. b) To establish and maintain fed backing mechanism. c) To establish and update database and conduct efficient regular reporting of programs, projects and activities. Goal 5. Responsive, transparent and accountable governance.

Objectives: d) To empower responsible communities through CEPA in the delivery of municipal services and develop opportunities for community participation; e) To strengthen the Municipal Project Monitoring System. Goal 5. Responsive, transparent and accountable governance.

REGIONAL TECHNICAL REVIEW AND APPROVAL OF FLUP

1. Adoption, enactment and strict implementation of local ordinances (CLUP, FLUP, Zoning Ordinance, SWM Ordinance, Ordinance Prescribing Environmental/ Ecological Fee in the Municipality of San Jose imposing penalty thereof; CFRM Ordinance, RA 7160, RA 7586 NIPAS Act, RA 8550-amended, RA 10654, Water Code of the Philippines, RA 10121, RA 9729 Climate Change Act of 2009, RA 9147 Wildlife Resources Conservation and Protection Act of 2001, etc. and resolutions on the following: POLICIES

Prohibition of illegal cutting of trees and illegal harvesting of resources Regulation on the use of toxic chemicals Prevention of the destruction of coral reef, sea grass and marine product and conservation & protection of marine biodiversity Protection and rehabilitation of watershed areas Project maintenance under the National Greening Program (NGP) in Barangay Janay-Janay Increase agricultural productivity of the existing agricultural areas No burning of agricultural waste POLICIES

2. Full utilization and development of water resources 3. Compulsory relocation of people that are living in the hazard prone areas(landslide areas) 4. A resolution that states the adherence of conducting a tree planting activity, especially at the 50% and above slopes, riverbanks and buffer zones POLICIES

5. Identification of protection-production areas 6. Enactment of Ordinance regulating the cutting and gathering of forest products 7. Strict implementation of Republic Act 9003 (SWM) POLICIES

8. Enactment of ordinance prohibiting the grant of tenurial rights 9. Organize and institutionalize Bantay lasang and Bantay dagat both at the Barangay and Municipal LGUs. 10. Coordination between institutions on projects implementation, tenure agreements and profit sharing. POLICIES

Organization and deputation of law enforcers (Bantay Lasang on eight(8) upland barangays and Bantay Dagat on six (6) Coastal Barangays.); Training on Agroforestry development (Farmers, MENRO, MAO personnel); Training on new farming technology for MAO personnel and farmers; Skills enhancement on the Establishment of Production Forest more likely fast-growing tree species; Skills/ Livelihood Training for farmers; Training of values responsibility (stewardship); Training on plant propagation and Training on preparation of project proposal CACITIES

INSTITUTIONAL SET-UP Organizational Structure

The Steering Committee will regularly meet to review and provide oversight in the implementation of FLUP. The Steering Committee shall have the following functions and responsibilities: a. Subject to the concurrence and endorsement of the concerned Barangay Councils, formulate and recommend to the Sangguniang Bayan, thru the Municipal Environment and Natural Resources Officer; policies that will stimulate sustained community participation and stewardship in the forestland area; b. Review and recommend for approval the annual work plan and budget, as well as investment proposals to the Sangguniang Bayan through the Municipal Development Council; MANAGEMENT: THE FLUP STEERING COMMITTEE ( SCom )

c. Review and recommend for the approval the resource management plans or tenure holders and integrated resource management plan for the communal forest to the DENR; d. Review and approve sub-agreements with actual occupants for the stewardship of selected portions of the communal forest/community watershed area, provided that the sub-agreements shall not be interpreted as permanent substitutes for the tenure instruments to be issued by the DENR and other agencies, The Mayor as the Chairman of the Steering Committee, shall sign the sub-agreements approved by the Steering Committee; MANAGEMENT: THE FLUP STEERING COMMITTEE ( SCom )

e. Review, endorse and enter into business or venture contracts and other sub-agreements with private individuals, cooperatives, corporations or government agencies for the protection and management of selected portions of the communal forest/community watershed area provided that the sub-agreements and contracts shall not be interpreted as permanent substitutes for permits/licenses to be issued by the DENR and other agencies. The Mayor, as Chairman of the Steering Committee, shall sign the sub-agreements and contracts approved by the Steering committee; f. Identify personnel involve in the FLUP implementation and enforcement of local and national policies who shall be deputized by the DENR; MANAGEMENT: THE FLUP STEERING COMMITTEE ( SCom )

g. Initiate resolution or mitigation of conflicts arising from forest forestland protection, management and development activities especially with respect to those arising from boundary conflicts, overlapping claims, illegal activities and other forms of negative externalities; and h. Review and endorse to DENR, applications for the issuance of Environmental Compliance Certificate (ECC) or Certificate of Non-Coverage (CNC) pursuant to DAO No. 2003-30. MANAGEMENT: THE FLUP STEERING COMMITTEE ( SCom )

The following process shall be followed in the preparation, review and approval of sub-agreements and contracts stated in paragraph d & e above: a. The Municipal ENRO, in coordination with the DENR shall do all the necessary stall/groundwork relating to all existing and/or proposed sub-agreements and contracts; b. The sub-agreements and/or contracts shall be endorsed to the Municipal ENRO to the Steering Committee for review and approval; c. Upon approval by the Steering Committee of the sub-agreements and/or contracts, the Mayor, as Chairman of the Steering Committee, shall sign the approved sub-agreement contracts. MANAGEMENT: THE FLUP STEERING COMMITTEE ( SCom )

The Project Management Office (PMO) shall be organized with the following manpower: a. Forest Resource Management Coordinator b. Coastal Resource Management Coordinator c. Solid Waste Management Coordinator/ Pollution Control Officer MANAGEMENT: THE PROJECT MANAGEMENT OFFICE (PMO)

Functions of the Project Management Office Serve as the primary office to implement the Forest Land Use Plan (FLUP) Responsible on Information Education and Communication Campaign Activities Coordinate all the Barangay activities in the Forest Protection and Law Enforcement both upland and lowland forestland, and management of all sub-allocated lands within co-management areas; and Perform all other duties assigned by the Steering Committee. MANAGEMENT: THE PROJECT MANAGEMENT OFFICE (PMO)

Serve as the secretariat of the Steering Committee Keeping all the records of transactions from the Steering Committee and other functions for being the Secretariat; Serve as the primary planning office on FFM; Conduct researches and studies Coordinate with the CENRO, Agriculturist, PEDO/PNP, and other pertinent agencies in the preparation of their respective annual forestland investments plans; MANAGEMENT: MPDO

f. Establish, design and conduct periodic monitoring and evaluations; g. Provide advice to the Steering Committee on the implications of, among other plans, the Comprehensive Land Use Plan; h. Maintain an updated socio-economic benchmarks and database on the forestlands, and communities, including other data that may be required by the Steering Committee; i . Conduct Forest Management Advocacy; and j. Perform other duties assigned by the Steering Committee MANAGEMENT: MPDO

a. Supervise all forestland activities b. Lead and coordinate with communities and concerned Barangay ENRO in the planning of activities in the communal forest/community watershed that are consistent with the approved IRMP. c. Maintain FLUP related data and make it available to all stakeholders as needed; d. Coordinate ongoing and proposed projects, programs and public and private investments, extension, and support systems in the forestland and collaborate with other agencies (DTI, DSWD, DILG, PNP, DOST, DepEd, and others) and-government organizations for investments, support, and services to communities in the forestland; MANAGEMENT: MENRO

e. Organize a continuing information, education and communication campaign and regular consultations to get the support and participation of occupants/stewards and qualified private sector within the area; f. Coordinate monitoring of the FLUP results based on monitoring plan, and provide periodic reports to the Steering Committee on the status, sources and uses of funds, development, and challenges in the protection and management of the forestland; g. In coordination with Provincial Forestland Management Committee, organize periodic evaluation of the FLUP results based on FLUP indicators and expected outputs of annual work plans; MANAGEMENT: MENRO

h. Involve all concerned agencies in the regular progress evaluation and submit annual report to them; and i . Perform other duties assigned by the Steering Committee. MANAGEMENT: MENRO

Enforce the forestland use, forestry and other environmental laws and ordinances, including filling of charges in court; Initiate deputing and supervise deputized forest officers; Devise and recommend to the Steering Committee the appropriate ordinances and to improve enforcement of environmental laws and regulations; Organize and act as convener of the Multi-sectoral Forest Protection Committee; and Perform other duties that may be given by the Steering Committee MANAGEMENT: THE POLICE ENVIRONMENT DESK OFFICER/ PHILIPPINE NATIONAL POLICE SHALL

Design and Implement agricultural productivity maintenance and/ or enhancement programs; As a member of the Project Management Office, coordinate activities with the CENRO or the Project Management Coordinator and the PEDO/PNP; Devise and recommend to the Steering Committee the appropriate ordinances, incentives and subsidy systems on soil and water conservation, multiple utilization of farmlands, and increasing farm yields; Assist the Municipal Planning and Development Office in the design and collection of periodic socio-economic benchmarks in the forestlands; and Perform other duties that may be given by the Steering Committee. MANAGEMENT: THE MUNICIPAL AGRICULTURIST

Organize, mobilize and manage as many numbers and kinds of Barangay-level working groups in an effective manner; Implement their priority work plans which they themselves will identify in the collaboration with the Project Management Office (PMO).In the minimum, the Barangay Councils shall: MANAGEMENT: BARANGAY COUNCILS

Allocate modest funds to support the plan for implementations. Collect user fees, rentals and charges Operate and manage the Barangay level and backyard nurseries. Supervise and manage deputized forest officers. Assist in the enforcement of the ordinances. Manage community watersheds, river easements, protection forests and other land use categories as provided in a municipal ordinance enacted for the purpose; and Submit periodic reports to the Steering Committee. MANAGEMENT: BARANGAY COUNCILS

The Barangay Captains also serve as a member of the Steering Committee; hence, they shall also provide direct feedback to the citizen regarding on the progress of work. Inter-agency Partnerships: The emerging DENR-LGU partnerships which have started in the earnest during the preparation of this Forest Land Use Plan should be expanded into the areas of: Resource conflicts resolution; Forestry policy guidance and technical forestry assistance; Design, standards, specifications and monitoring and evaluation of the forest management projects, and Forest enforcement. MANAGEMENT: BARANGAY COUNCILS
