What should the Procuring Entity do in anticipation of contract completion? QUESTION
Once the project reaches an accomplishment level of ninety-five percent (95%) of the total contract amount, the Procuring Entity may create an inspectorate team to make preliminary inspection and submit a punch-list to the contractor in preparation for the final turnover of the project. This punch-list will contain, among others, the remaining works, work deficiencies for necessary corrections, and the specific duration/time to fully complete the project considering the approved remaining contract time. This, however, shall not preclude the Procuring Entity’s claim for liquidated damages. PROJECT COMPLETION

According to Sec 7, Annex E of the 2016 Revised IRR of RA 9184, the procuring entity has the right to claim liquidated damages even the project is still ongoing and is at 95th percentile of completion. When can the procuring entity claim LD before the intended date for project completion?
When the inspectorate team has proven that the contractor can no longer catch up with the schedule even after creating catch-up plans for the project. ANSWER
Within 15 days upon the inspection , a completion inspection report shall be submitted to the Implementing Office/head of the procuring entity At 100 percent completion or upon the notice of the contractor, the inspectorate team shall perform the first completion inspection.
The Head of IO issues a Notice of Defects/Deficiencies to the contractor, instructing them to commence repairs within 7 days and complete them within 30 days.
Upon confirmation of corrections by the contractor, the IO's Head instructs the Inspectorate Team to inspect the project and submit a Completion Inspection Report within 7 days. If the report confirms satisfactory corrections, it serves as the Final Completion Inspection Report; otherwise, the process repeats until all noted issues are resolved.
Is there a limit on the number of inspections to be performed by the inspectorate team? QUESTION
The number of inspections per se has no limit. The only limit shall be the applicability of the provisions of 01. Annex E Sec. 9.4 of RA 9184 IRR ANSWER 02. Annex E Sec. 8 of RA 9184 IRR
