BACKGROUND

The Hazardous Products Regulations
(HPR) in Canada conform to the
Globally Harmonized System (GHS),
which aims to standardize the
classification and labelling of
chemicals.
These regulations specify criteria for
the classification, labelling, and safety
data sheets of hazardous products.
BACKGROUND ON HPR

The Globally Harmonized System of
Classification and Labelling of Chemicals
(GHS) is a United Nations standard for
classifying and communicating chemical
hazards, used globally to improve
health and safety, and to facilitate
international trade.

Embracing the HPR and aligning
with GHS enables Canada to
conform to global standards,
promoting trade, and maintaining
uniform hazard communication
across different countries.
BENEFITS OF HPR & GHS

On January 4, 2023, Health Canada issued
amendments to the Hazardous Products
Regulations (HPR).
Align with the 7th edition of the Globally
Harmonized System of Classification and
Labelling of Chemicals (GHS), and
Specific provisions from the 8th edition.
The amendments came into force on
December 15, 2022.
CANADA'S UPDATE TO THE HPR

SUMMARY OF UPDATES

New hazard classes and categories
The physical hazard class Chemicals Under
Pressure has been adopted
The hazard class name, Flammable Aerosols, has
been changed to Aerosols.
The HPR has also adopted a new category for
aerosols: Aerosols – Category 3 (non-flammable
aerosol products)
Modification of classification criteria
Subcategories for Flammable Gases, Category 1
Repeal of the Pyrophoric Gases, these are now
included under Flammable Gases, Category 1A
SUMMARY OF UPDATES

Modified statements for Safety Data Sheets and labels
Example: Modified hazard statement for products
classified as a Combustible dust
Changes to disclosure requirements
Amendment to allow narrower concentration
ranges that fall within one of the prescribed
concentration ranges
All hazardous ingredients that are present above
the applicable cut-off levels will need to be
disclosed on the SDS regardless of whether or not
the ingredient is eliciting the mixture classification
Clarity on the provisions concerning significant new
data (section 5.12 of the HPR)

The filing process for confidential
business information claims remains
unchanged by the new amendments.

WHAT’S NEXT?

During the 3-year transition period until
December 14, 2025, industries can choose
to comply with either the amended or
former Hazardous Products Regulations
(HPR), but not both.
Hazard classification, safety data sheets,
and labels must fully comply with the
chosen version.
