Foreword
TostreamlinetheprocurementprocessinSriLankatheGovernmenthasdecidedto
developaseriesofStandardBiddingDocumentsforprocurementofGoodsandWorks.
TheCabinetofMinistershasentrustedthistasktoNPA-TheProcurementGuidelines
(2006)requiresthatallPEshallusetheappropriateSBDsapprovedbyNPA.
Accordingly,asajointeffortofNPA/ICTADtheSBDspublishedpreviouslybyICTAD
were revised for conformity with the Guidelines.
ThisBiddingDocumentforProcurementofWorksshallbeusedforNational
CompetitiveBidding(NCB)withinthelimitsspecifiedintheSBD,forthecontractsthat
arefinancedbyGovernmentofSriLanka.Thepublicationisdraftedtosuitforforeign
fundedcontractsandisadvisedtouseinsuchcontractswiththeconcurrenceofthe
fundingagencies.
TheseBiddingDocumentsforProcurementofWorks,assumesthatnoprequalification
hastakenplacebeforebidding.However,forthedomesticcontractorsICTAD
registrationisapre-requisitetoeligibleforcontractawardandforallcontractorsa
suitablepostqualificationshouldbecarriedout.

Thegrowingneedtostandardizeprocurementdocumentswas'expressedfromseveralsectorsoftheindustry.
Itsimplifiestheprocess,andanattempthasbeenmadetoachievetheseobjectiveswithsimplicitybutwith
precision.ToachievetheseobjectivesICTADcommencedtodevelopnewstandarddocumentswiththe
assistanceoftheIDAoftheWorldBank.
ThistaskwascarriedoutbyMr.EddiedeZylvaandMr.JayanthadeMelundertheguidanceofaSteering
CommitteeandSubCommitteeappointedforthereviewofICTADPublications.
ThefirstoftheseriesofsuchdocumentsistheStandardBiddingDocumentforProcurementofWorks,which
waslargelybasedontheWorldBankStandardBiddingDocumentforSmallerContracts.Thissupersedesthe
ICTADConditionsofContractforWorksofBuilding&CivilEngineering(SCA/1)andissuitableforusebothby
InternationalCompetitiveBidding(ICB)andbyNationalCompetitiveBidding(NCB)procedures.Thisdocument
mayalsobeusedforworksofhighervaluesprovidedthattheworksarenotofacomplexnature.Substantive
instructionshavebeengiveninordertoensurethatcontractsarecarriedoutinaccordancewithpoliciesand
procedureslaiddownbytheGovernmentofSriLankawithoutdeviatingfromthegeneralrequirementsofthe

This Standard Bidding Document (SBD) is intended for use in measure and pay contracts.
It includes many guidance notes to the user. Hence this publication is not intended to use
as a biddingdocumentfor a specific procurement. Procuring Entities (PEs) are advised to
use Volume 1 and Volume 2, which are published separately as the bidding document for
a specific procurement. The users are advised to follow the directions given below:

5.1 Each bidder shall submit only one Bid, either individually or as a

27.1 Bids determined to be substantially responsive will be checked by the
Employerfor anyarithmeticerrors. Errors will becorrectedby the

(b) where there is adiscrepancybetween the unit rate and the line

rate as quoted will govern, unless there is an obvious gross

security, the Employer will promptly notify the other bidders that
theirbidshavebeenunsuccessful.
33.5 At thesametime that theEmployernotifiesthesuccessfulbidderthat
its-lrid has been accepted, the Employer will prepare the agreement in
~)rm provided in the bidding documents, incorporating all

A.General

BillsofQuantitiesmeansthepricedandcompletedBillsot
Quantitiesformingpart of the bid.
CertificateofCompletionisthecertificateissuedbytheEngineer
oncompletionof the Works.
CompensationEventsarethosedefinedinClause44hereunder.
CompletionshallmeanwhenintheopinionoftheEngineerthe
Workshavebeencompletedtoanextenttobeconsidered
functionalfor theintendedpurpose.
TheCompletionDateisthedateofcompletionoftheWorksas
certifiedbyEngineer,inaccordancewithSub-Clause55.1.
TheContractis the Contract between the Employer and the
Contractorto execute the Works and shall include the documents

TheContractor isaperson,corporatebody,partnership,
proprietorshiporjointventurewhoseBidtocarryouttheWorks
has been accepted by the Employer.
TheContractor'sBidis the completed bidding document
submitted by the Contractor to the Employer.
ThevContractPriceis the price stated in the Letter

Drawingsincludecalculationsandotherinformationprovidedor
approved by the Engineer for the execution

TheEmployeristhePartynamedintheContractData,who
employstheContractorto carryout the Works.
TheEngineeris the personnamedin theContract Data(or any
other
competentpersonappointedby theEmployerandnotifiedto
theContractor)who isresponsibleforadministeringand
supervisingthe
executionof thework.Suchpersonmaybe an
engineer,architectoranyothertechnicalperson.Intheabsenceof
such appointment the Employerhimself.
TheEngineer's Representative
meansapersonappointedfrom
time to time by the Engineer under Sub-Clause5.1ofthese

Equipmentis the Contractor'smachineryand vehicles brought
temporarily to the Site to construct the Works.
FinalCertificateis thecertificateissued by theEngineerafterthe

Acceptance.
TheIntended Completion Dateis date on which it is intended

LetterofAcceptancemeansthe letter signed andissuedby the

9. 1 TheContractorshall employ the keypersonnelif namedby the
Employerinthescheduleofkeypersonnel,asreferredtointhe
Contract Data, to carry out thefunctionsstated in the scheduleor
otherpersonnelapproved by theEngineer.The Engineer may
approveanyproposedreplacementof keypersonnelonly if their
relevantqualificationsand abilities aresubstantiallyequal to or
better than those
ofthe personnel listed in the schedule.
9.2 If the
Engineerasks theContractorto removeapersonwhois a
member
oftheContractor'sstaffor work force,statingthe
reasons, the Contractor shall ensure that the person leaves the Site
withinsevenDaysand has nofurther connectionwiththeworkin
theContract.
10.1TheEmployercarries the risks which this Contract states are
Employer's
risks,and theContractorcarriesthe riskswhichthis
ContractstatesareContractor'srisks.
11.Employer'sRisks11.1From theStartDateuntil theFinalCertificatehasbeenissued,the
following areEmployer'srisks:
(a) The risk
ofpersonal injury, death, or lossofor damage to
property(excluding the Works, Plant,Materials,and
Equipment),which are due to;
(i) use or occupationof the Site
ofthe Worksor for the
purposeof the
Works,which is theunavoidable
resultoftheWorksor
(ii)negligence,breach ofstatutoryduty, or interference
with any legal right by the Employer or by any
person employed by or contracted by him except the
Contractor.

Equipment to the extent that is due to :
(i) a fault

therisksofpersonalinjury,death,andlossof ordamageto
property(including,withoutlimitation,theWorks,Plant,
Materials,andEquipment)whicharenotEmployer'srisksare
Contractor'srisks.
13.1TheContractorshallprovide,inthe jointnamesofthe
EmployerandtheContractor,insurancecoverfromtheStartDateto
the end of theDefectsLiabilityPeriod,in theamountsand
deductibles stated in the Contract Data for the following events
whichare due totheContractor'srisks:
(a)lossofordamagetotheWorks,TemporaryWorks,Plant
andMaterials.
(b) lossofor damagetoEquipment;
(c)lossofordamagetopropertyofthirdpartiesandthatofthe
Employer;(excepttoWorks,TemporaryWorks,Plant,
Materials,andEquipment)inconnectionwiththeContract;
(d)personalinjuryordeathtoanypersonofathirdpartyand
includingemployeesof theEmployerandotherpersons
engagedbytheEmployerinconnectionwiththeContract;
13.2TheContractorshallprovideinsurancecoverfromtheStartDateto
theendoftheDefectsLiabilityPeriod,in theamountsstatedin
theContractData for thefollowingevent which is due to the
Contractor'srisk:
(a)liabilityforpersonnelinjuryordeathofworkmenorother
employeesoftheContractor.TheContractor'sliabilityfor
personalinjuryordeathofworkmenshallbeasprovided

63.2 For each provisional sum, the Engineer may instruct:
(a) Work to beexecuted(includingPlant,Materialsor services to

(b) Plant, Materials or services to be purchased by theContractor,
fromanominatedsubcontractorasdefineunderSub-Clause63.4

63.3 If executed by the Contractor, the total sum paid to theContractor
shall include only such amounts, for the work, supplies or services to
which the provisional sum relates, as the Engineer shall have
instructed.

64.1 TheEngineermay at any timeinstructtheContractortosuspend
