HISTORY OF INEFFECTIVE ACCIDENT PREVENTION
Bhopal Disaster (1984) Location: Bhopal, India Casualties: 15,000 fatalities Overview: A gas leak from the Union Carbide pesticide plant released methyl isocyanate (MIC) gas into the surrounding community. Piper Alpha Disaster (1988) Location: North Sea, UK Casualties: 167 fatalities Overview: A gas leak due to maintenance errors led to a catastrophic explosion and fire. Deepwater Horizon Spill (2010) Location: Gulf of Mexico Casualties: 11 fatalities Overview: An explosion on the BP-operated rig resulted in the largest marine oil spill in history, releasing approximately 4 million barrels of oil into the Gulf

ADDITIONAL DUTIES FOR EMPLOYERS/PRINCIPAL The Amendment Act also provides additional duties for employers, self-employed person and principals which is a proactive approach towards reinforcing preventive safety culture in the workplace.
ENHANCED DUTIES OF PRINCIPAL 18A It shall be the duty of every principal to take, so far as is practicable, such measures as are necessary to ensure the safety and health of (a)Any contractor engaged by the principal when at work (b)Any subcontractor or indirect subcontractor when at work and (c) Any employee employed by such contractor or subcontractor when at work Joint Liability: The Amendment Act broadens the categories of individuals who can be held jointly and severally liable for offences committed by companies . (directors, managers, partners … etc involved in the management. Unless ……… the individual is able to prove ( i ) that the offence was committed without his knowledge, and (ii) without his consent or connivance and he had taken all reasonable precautions and exercised due diligence to prevent the commission of the offence.
ADDITIONAL DUTIES FOR EMPLOYERS/PRINCIPAL Duty to develop and implement procedures to deal with emergencies. - Section 15(2)(f) Duty to conduct and implement risk assessment in relation to health and safety risk. - Section 18 B Duty to ensure specific employees’ attendance of occupational safety and health training course . Section 31A Requirement for appointment of occupational safety and health coordinator
