Chapter – I

General Information
Part - I

1. Formation of a Bio-chemic Concern:
a) Any five or more person forming a concern/department for
Any literacy, culture, scientific, medical treatment, medical education or any development of medical culture,
religious purpose or for any such purpose as described in detail in section 3(2) of the Act may subscribe their
names to a memorandum of concern/group and fill it along with certified copy of regulation with the
Registrar/Higher authority of ‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant
Commission’ for the registration of the concern/department/group as a concern under the Act.
b) There are no prescribed form to be filled in for registration of a concern. Print out the
memorandum of concern/group/department and regulation of concern as per model form appended to this book
on one side double space of demy paper and file them to the registrar of ‘Bio-chemic Swasthya West Bengal’ or
‘Bio-chemic Education Grant Commission’ with a fee of Rs. 10,500/ or schedule- in Bank(D.D.) for
registration under the Act.
c) Do not submit postal order or do not send money order. Nationalized Bank (D.D.)/Cash is
accepted by the office of the Registrar/Higher Authority. For Preparation of the memorandum of
concern/group/department, read section 3,5,10 & 11 of the Act and for the regulation, section 6 of the Act.
2. Alteration of memorandum:
Alteration of memorandum section 8&9 and Rule No-9 under the alteration of memorandum of
concern/group/department come the following three things:
i) the name
ii) the address of the registered office
iii) the object of the concern/group/department before making any alteration of the memorandum
apply to the registrar of ‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant
Commission’ in form V (appended to the rules) for permission to the alteration

under section 8 of the Act. Having received permission from the Registrar, get the alteration passed by the staffs in a
consult. File the altered memorandum in form IV to the Registrar of ‘Bio-chemic Swasthya West Bengal’ of ‘Bio-
chemic Education Grant Commission’ within 30 days of the alteration along with a fee Rs.200/- in cash & a copy of
the resolution adopting the alteration.
3.Alteration of regulations:
Section 9 and rule No-9. No permission of the registrar is required of the alteration of the regulation. Get
altered regulation passed by the staffs in a consult, file the altered regulations within 30 days of such alteration
in form IV to the Registrar (‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant
Commission’) with a fee of Rs. 200/- in cash along with a copy of the resolution passing the alteration

Part-II
Statutory obligations of a concern/group/department
1.Name of the concern/group/department to be prominently shown:
Section-13: Every concern/group department shall (a)prominently display its name out- side its office the place
where the business is carried on (b) have a seal with its name engraved thereon (c) have its name mentioned in
all documents executed in its favour or on its behalf.
2.Register of staffs:
Section-14: Concern/group/departments are obliged to maintain at its registered office a register of its
staffs. It shall contain the following particulars, namely a) the name and address of each staff b) the date on
which the staffs was recruited c) the date on which a staff choose to be such.
1. Books Account & Audit:
Section-15: Every concern shall keep at its registered office proper books of account in which shall be
entered accurately a) all sums of money received and the source there of and all sums of money expended by
the concern and the object of purpose for which such sums are expended. b) The assets and liabilities of the
concern. Every concern shall have its accounts audited once a year by a properly qualified auditor/Accountant.

Section-16: Every concern shall hold an annual general meeting at least once in every year and not
more than 19 months shall elapse between two successive annual general meeting . The balance sheet and
auditor’s report shall be placed at the annual general meeting of the concern/department.
5. Annual & other returns:
Section-17: Every concern, within 30 days after the holding of every annual general meeting, shall file with
the registrar(‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant Commission’) a) a list of the
names, address, rank of the staff of Governing Body/In-charge/authority and other office bears of the concern.
b) an annual report on the working of the concern for previous year. c) a copy each of the balance sheet and the
auditor’s report. The annual report and other returns are to be forwarded to the registrar (‘Bio-chemic Swasthya
West Bengal’ or ‘Bio-chemic Education Grant Commission’) in form VI with a filling fee of Rs. 500/- in cash.
Every concern shall notify to the registrar (‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education
Grant Commission’) any change in the composition of the Governing Body within 30 days of a such change.
6. Power of Registrar (‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant
Commission’):
Section 43: Every officer of the concern shall furnish such information or explanation as demanded by the
Registrar within such time not being less than two weeks from the date of the receipt of the order by the
concern.
7. Investigation of affairs of a Concern:
Section 44: It shall be the duty of every officer of the concern, when so required by the commissioner for
enquiry to produce any books and paper of or relating to the concern which are in his custody, and otherwise to
give to the commissioner for enquiry all assistance in Connection with the investigation or inspection which he
is reasonably able to give.
6. Terms of gift to be observed:

Section 36: Where a concern accepts a gift of any kind from any person for a specific purpose it shall not
use the gift or any part thereof for any other purpose without the written consent of the donor or if the donor be
dead without the written consent of the registrar (‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic
Education Grant Commission’).


Part-III
1. Inspection of Documents:
Section-35: of the Act and rule-No.8. Any person may inspect any document filled with the registrar under
this Act on payment of a fee fifty rupees for every inspection. Apply to the Registrar in form III appended to
the rules. The applicant shall not be allowed to make a verbatim copy of the documents inspected. He may,
however be allowed to make short notes in respect of the contents of document inspected.

2. Certified copy of the documents:
Section 35: Any person may obtain a copy or extract of any document of any part of any document certified
by the registrar (‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant Commission’). Apply to
the Registrar in form III along with the follows:-
a) Affix a medical court fee / stamp of one rupee in application.
b) Supply a few cartridge papers two non-judicial stamp paper of Rs. 50/- or medical court stamp Rs. 50/-
or 100/- or 500/- or 1000/- or 5000- or 10000/-
for each documents.
c) Pay search fee of Rs. 50/- in cash.
d) Pay copying fee of Rs. 100/- for every page or fraction thereof in cash.
Such certified copy shall be prima facie evidence of the matter therein
contained in judicial proceedings.

3. Duplicate copy of certificate of registration:
Apply to the Registrar in form III along with the following:-
a) Affix a court fee stamp of 1 rupee in the application.
b) Supply one cartridge paper.
c) Pay search fee of Rs. 50/- in cash.
d) Pay copying fee of Rs. 100/- in cash.

Part-IV


Offences and Penalties:
Every officer-in-default shall be punishable for the under mentioned offences. For the definition of officer-
in-default, please consult section 2(g). Prosecution shall be instituted for any offence under Act except the
previous sanction of the ‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant commission’,
vide section-20&21, after effection of the Act.
Any officer-in-default shall be punishable (fine) decision to be taken by Registrar/Higher authority.

Chapter – II

INDIAN BIO-CHEMIC ACT-2009

It is hereby enacted in the 59
th
year of Republic of India as follows:-

1. Short title, extent and commencement
a) India Bio-chemic Act-2009
b) It extends to the whole of India.
c) It shall come into force on such date as the Central Government office,
May by official notification.

(Notification Published in The Gazette of India , Extraordinary on dated 11 June’2014)

2. Interpretation: In this Act, unless the context otherwise requires:
a) “Court” when used in relation to Department means the Principal Medical Court of original jurisdiction
of the BEGC within which the registered office of the department is situated and in relation to a
Department situated within the BEGC Medical court/Special Medical Court.
b) “Governing Body” means the body, by whatever name called entrusted for the time being with the
management of a Bio-chemic Departments under its regulations:
c) “In-charge” means Higher authority.
d) “Staff” when used in relation to a Bio-chemic Department means a person who has been admitted with
his consent as a staff of the Bio-chemic Department according to its regulations.
e) “Memorandum” means the memorandum of group referred to in section 3.
f) “Officer” means a staff of Governing body, the In-charge, Chancellor, Principle, Doctor or any other
office bear of a department and includes also an employee of the department whose work is not of a purely
ministerial nature.
g) “Officer in default” for the purpose of any provision in this Act, means any officer who is knowingly
guilty of any
contravention, failure or refusal or who knowingly and willingly authorises or permits such contravention,
failure or refusal.

h)“In-charge” means the In-charge, the Chancellor/Principal
/Chairman or the formal head by whatever name called of a
Department and includes a person who for the time being acts
as the formal head.
i)“Registered Office” means the registered office mentioned in the
memorandum.

j)C.E.O. or Chief means a person appointed as C.E.O. or Chief under section-4 and includes in
relation to the exercise of any power or functions under this Act, any person referred to in that section on
who such power or functions have been conferred under that section.
k) “Regulations” means the regulations made by a Department and in relation to a department
deemed to have been registered under sub-section (ii) of section 30 of this Act, include its rules and
regulations.
l) “Rules” means rules made by under section 40.
m) “Authority” means the authority or principal executive officer by whatever name called of a department
and includes a person who for the time being acts as authority.
n) “Department” means a department registered or deemed to have been registered under this Act.
3.Department to be formed by memorandum of group and registration:
I) Any five or more individuals join together for any of the object mentioned in sub-section (2)
may subscribe their names to a memorandum of group and file it along with a copy of the regulations with
the register for registration of the group as a department under this Act.
II)The objects referred to in sub-section (1) may relate to the promotion of literature, arts, science,
treatments any charitable purpose including the care or relief of orphans or of aged, sick, helpless or
indigent persons, the alleviation of the sufferings of animals, the diffusion of knowledge, dissemination of
social, economic education, Bio-chemic Education: the establishment and maintenance of Libraries or
**C.E.O.-Chief Executive Officer
Hospitals/Medical Colleges/Universities/Medical Boards regarding rooms for the staff or for the public, the
collection and preservation manuscripts, paintings, sculptures, work of art antiquities, natural history
specimens mechanical, scientific or medical instruments and designs, promotion and development of “Bio-
chemic Education Grant Commission” as being objects beneficial to the public or to a section of the public.

4.Staff Appointment:
Appointment of C.E.O. or Chief Commissioner or Chief Justice or M.D.(Managing Director)
a) The Central Govt. or Act. Authority may appoint by official notification or certify a person to be the
M.D./Chief/C.E.O. of Bio-chemic Education Grant commission Govt. of India for India.

b) Appointment of Deputy, Assistant Director and Registrar or any Rank.
i)The Authority may appoint a person to be the Deputy Chief of “Bio-chemic Education Grant
Commission”.
ii) Other a person to be the E.O./Director of ‘Bio-chemic Swasthya West Bengal.’
iii)Deputy/Assistant Director and Registrar or any Rank as it thinks necessary to assist the
Authority and may be General or special order confer as such person or persons assisting the Authority any
of the powers and function of the Authority under this Act.

5.Memorandum of Group:
A) The memorandum shall contain amongst other things, the following particulars, namely-
i)The name of the group.
ii)The address of the registered office of the group.
iii)The objects of the group.
iv)The names of the first staff of Governing body and
v)The names, address and occupations of the signatories to memorandum.

B)After registration a department shall not change the memorandum except in accordance with
the provisions of this Act.
6.Regulations: The Registrar shall not accept any memorandum for registration of a Bio-chemic
department/Centre unless it is accompanied by a copy its regulations providing amongst other things for
following matters namely-
a)The composition of Governing Body and manner of appointment and resignation and the term of office
of the staffs of the Governing Body, the in-charge, chancellor/principal and others officials.
b)The recruitment to staff ship and resignation and removal of staff.
c)The maintenance of a registrar of staffs and facilities for inspection thereof by the staffs.
d)The safe custody of the property of the Bio-chemic department including in particular, the manner of
keeping or investing any moneys of department.

e)The maintenance audit of accounts.
g)The inspection of account and of the proceedings of meetings by staff of Governing Body.
h) Any other matter relating to the objects or affairs of the department.
7.Registration:
a)The Higher Authority or Registrar upon being satisfied that the memorandum and regulations
accompanying it comply with the requirements of this act and the rules and upon payment of the fee referred to
in subsection (2), shall certify under his hand and seal that the department is registered under Act.
b) There shall be paid to the Registrar/Higher authority, for the registration of a department under this Act,
such fee not exceeding ten thousand and five hundred rupees or as the C.E.O. of ‘Bio-chemic Education Grant
Commission and Bio-chemic Swasthya West Bengal’ from time to time direct.
c) An appeal shall lie to the ‘Bio-chemic Education Grant Commission and Bio-chemic Swasthya West Bengal’
against an order of the Registrar/Higher authority refusing to certify the registration of a group as a department
under this Act and the decision of the C.E.O. of ‘Bio-chemic Education Grant Commission’ or ‘Bio-chemic
Swasthya West Bengal’ on such appeal shall be final.

8.Alteration of memorandum and regulation:
a)A department/Group shall not alter its memorandum except with the previous permission of the
Registrar/Higher authority writing and the consult of Governing Body staffs.
b)Before granting permission under sub-section (1) the Registrar/Higher authority shall satisfy himself that
the alteration does not make the department illegible for registration under this Act.
c)Subject to the provision of this Act, the rules and the provisions of the memorandum a department may,
by the consult of Government body staffs alter its regulations.

9.Alteration to be filled:
a)A copy of every alteration of the memorandum and a the regulations shall be filled with the
Registrar/Higher authority within thirty days of such alteration.
b)The Registrar shall accept for special reasons to be recorded by him in writing within thirty days from the
date of such receipt record the alteration and send to department or communicate to the department. His object
to such alteration.
c)An appeal shall be lie to the ‘bio-chemic Education Grant Commission and Bio-chemic Swasthya West
Bengal’ against any object made by the Registrar/Higher authority and decision of the Director/any Higher
authority of ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’ on such
appeal shall be final.
d)An alteration shall have effect from the date on which the intimation referred to in sub-section(2) is received
by the department or in the event of any objection being raised by the Registrar/Higher authority from the date
on which the director of ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’
allows alteration or appeal.
10.Name of department / Group / Concern:
No department shall be registered under a name which is identical with or too nearby resembles, the name
of any other department or any body corporate which has been previously registered or incorporated under this
Act or any other law for the time being in force as the case may be, or is deemed to have been registered under
Act.
11.C.E.O. of ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’ may
direct change of name:
a)A department is registered under a name or alters its name to another name which in the opinion of the
C.E.O. ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’ is identical with or
too nearby resembles the name of any other’s department or body corporate which having been previously
registered or incorporated under this Act or any other law for the time being in force or being deemed to have
been registered under this Act continues to exist the C.E.O. r of ‘Bio-chemic Education Grant Commission’ and
Bio-chemic Swasthya West Bengal’ may by order made in this behalf direct such department to change its
name and alter its memorandum within three months from the date of the order or such longer period as the
C.E.O. ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal thinks fit to allow.
b)No change of name shall effect the right and liabilities of department or any legal proceeding by or against the
department.
c) In case of non-compliance with an order under sub-section (1) every officer in default shall be
punishable with fine which may extend to fifty rupees for every day until the order is complied with.

12.Department to have power to amalgamate with another department:
a)Whenever two more department desire to amalgamate the governing body of each such department shall
submit the proposal in writing to the staffs thereof and such proposal shall be considered in a general consult of
the department convened for the purpose.
b)No such proposal shall have any effect unless-
i)it shall have been delivered or sent by registered post to the Governing body staffs of the department at
least fifteen days before the date of consult at which it will be considered.
ii) It has been sent to the registrar/authority before the consult and communicates his approval thereto with or
without any notification.
iii) The proposal with the modifications if any suggested by the registrar/any higher authority is agreed to by
the consult of each departments confirmed.

c) An appeal shall lie to the ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’
against any order of the registrar/any higher authority refusing to accord his approval to that proposal or suggesting
any modification and the decision of the ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya
West Bengal’ on such appeal shall be final.

d) On the proposal being confirmed-
i)the amalgamated department shall be registered under its new name.
ii)the registration of the amalgamated departments shall be cancelled.
iii)the assets and the liabilities of the amalgamating departments shall be
the assets and the liabilities of the amalgamated department.

13. Name of department/concern to be prominently shown:
A) Every department shall-
i) Prominently display its name outside its office or the place where its business is carried on.
ii) Have a seal with its name engraved thereon.
iii) Have its name mentioned in all documents executed in its favour or
on its behalf.
B) For any contravention of the provisions of sub-section (1), every officer in default shall be punishable
with fine which may extend to fifty rupees.
14. Register of staffs:
i) Every department shall maintain of its registered office or register of its staffs and shall enter there in the
following particulars namely-
a)the name and address of each staff.
b)the date on which the staff recruited.
c)the date on which a staff ceased to be such.
ii) If entries are not made within fifteen days of the recruitment of a staff or ceassation of staff ship, every
officer in default shall be punishable with fine which may extend to fifty rupees for every day during which the
contravention continues.

15. Books of account and audit, every department shall keep at its registered office proper of account in
which shall be entered accurately:
I. a) All sums of money received and source thereof and all sums of money expended by the department
and the object or purpose for which such sums are expended.
b) The assets and liabilities of the department.

II. i) Every department shall have its accounts audited once a year by a duly qualified auditor and have a
balance sheet by him. The auditor shall submit a report showing the exact state of ‘Bio-chemic Education Grant
Commission’ and ‘Bio-chemic Swasthya West Bengal’, three copies of balance sheet and auditor’s report shall
be certified by the auditor.
ii) Explanation-A duly qualified auditor means a chartered accountant within the meaning of the
chartered accountants Act 1949 or a person approved by the registrar in this behalf.
iii) For any contravention of the provisions of sub-section(1) or sub-section(2) every officer in default
shall be punishable with fine which may extend to fifty rupees for every day after the detection of the default
during which the default continues.

16.Annual General Meeting:
i) Every department/concern shall hold an annual general meeting at least once in every year and not more
than fifteen months shall elapse between to successive annual general meeting.
ii)The balance sheet and the auditor’s report referred to in sub-section (2) of section 15 shall be placed at
the annual general meeting of the department.
iii)For any contravention of provision of sub-section (1) or sub-section (2) every officer in default be
punishable with fine which may extend to five hundred rupees.
17. Annual and other return to be forwarded to Director/Deputy Director/Registrar/Higher Authority:
I)Within thirty days after the holding of every annual general meeting, there shall be field with the higher
authority.
a) a list of names, address and rank of the staffs of the governing body: Principal/In-charge/Other office
bearers of the department.
b) an annual report by the governing body on the working of the department for the previous year.
c)a copy each of the balance sheet and the auditor’s report certified by auditor under sub-section (2) of
section 15.
II)The list and annual report referred to in clauses (a) and (b) of sub-section (1) shall be certified by the In-
charge and Principal.
III)If any change occurs in the composition of the governing body or in the holder of the office of the In-
charge/Principal/Authority at any time for any reason whatsoever, such change shall, within 30 days, be notified
to the director/deputy director/higher authority.
IV)For any contravention of the provisions of sub-section (1) sub-section(2) or sub-section (3) every officer
in default shall be punishable with fine which may extend to five hundred rupees.
18. Property of department how to vested:
All property belong in to a department if not vested in trustees, shall be deemed to be vested in the governing
body of the department but shall be referred to as the property of the department.
19.Suits and proceedings by and against a department:
i)Every department may sue or may be sued in the name of the

In-charge/Principal/Authority or any office-bearer authorised by the governing body in this behalf.
ii) No suit or proceeding shall abate by reason of any vacancy or change in the holder of the office of the
In-charge/Principal/Authority or any office bearer authorised under sub-section(1).
iii) Every decree or order against a department in any suit or proceeding shall be executable against the
person or the property of the in-charge/principal/authority or any office bearers.
iv) Nothing in sub-section(3) shall exempt the in-charge/principal or office bearer of a department from any
criminal liability under this Act or entitle him to claim any contribution from the property of the department in
respect of any fine paid by him on conviction by criminal court.

20.Power of Bio-chemic Swasthya West Bengal:
i)Services to establish and administer medical treatments only for India Bio-chemic Doctors, those Doctors
who have the registration number provided by the ‘Bio-chemic Swasthya West Bengal’ can only issue
prescription, medical certificates, death certificates and birth certificates.
‘Bio-chemic Swasthya West Bengal’ can permits to establish Hospitals, Nursing Homes, Health Centres,
Clinics, Pharmacies and Laboratories etc. all over India.
ii)Services providing Education and Training to establish & administer of Bio-chemic education, providing
Bio-chemic Pharma Copoeia and education books medicals technical courses, providing Bio-chemic Council &
University, Medical Colleges & Institutes & medical Board & Bio-chemic Doctors of India.

21.Power of Bio-chemic Education Grant Commission:
a)Services to establish & administer Bio-chemic medical education & Medical Technical Courses, control Bio-
chemic Universities & Bio-chemic Councils & Bio-chemic Health departments all over India. Bio-chemic
Education Grant Commission can permit certificates to establish Universities, Councils, Medical colleges,
Medicines Research Institutions & Medical Boards etc. all over India.
b) ‘Bio-chemic Education Grant Commission’ always controlled ‘Bio-chemic Swasthya West Bengal’ –
called under section 21(a) in this Act.
22.Appointment of Medical Board Chairman:

The Director of ‘Bio-chemic Education Grant Commission’ may appoint a person to be the Board
Chairman of Bio-chemic Medical Board Chairman for the separate state by state, and vice, joint, deputy or
assistant Chairman as it thinks necessary to assist the Director of ‘Bio-chemic Education Grant Commission’
and may be general or special order confer on such person or persons assisting the ‘Director of Bio-chemic
Grant Commission’ any of the powers and function of the Director of ‘Bio-chemic Education Grant
Commission’ under this Act.
23.Appointment of Registrar & Registrar Power for ‘Bio-chemic Swasthya West Bengal’ and B.E.G.C.:
a)The Director of ‘Bio-chemic Swasthya West Bengal’ may appoint a person to be the Registrar of
departments for India. The Registrar can permit to establish Hospitals, Nursing Homes, Health Centres, Clinics,
Pharmacies & Laboratories all over India and control doctor’s registration books & provided doctor’s
registration numbers. The Registrar always has connection with his Director.
b)Appointment of Registrar for Bio-chemic Education Grant Commission & Registrar Power:
The Director of ‘Bio-chemic Education Grant Commission’ may appoint a person to be the Registrar of
departments for India. The Registrar can permit certificates to established Universities, Councils, Medical
Colleges, Medicines Research Institutions & Medical Boards etc. all over India. The Registrar always has
connection with his C.E.O.
24.a)Doctor’s Power:
(i)The registered Doctors may treat people as per principles of Bio-chemic system of medicines.
(ii)Doctors can establish and administer Chemicals Medicines treatment.
iii)Doctors can research Bio-chemic & Chemicals or Chemical Medicines.
iv)Doctors can issue prescription, Medical Certificate, Death Certificate, Birth Certificate to only the
genuine persons undergoing his/her treatment.
v)Doctors can issue Compounder’s Certificates.
vi)Doctors must inform to registrar about any change in his/her address.
vii)Doctors can surgery & gynaecology treatment.
viii)Doctors can write treatment history & medical books & culture, medical pharmacopoeia & research.
ix)Doctors can attestate.

b)Those Doctors who completed bachelor course or his/her Registration of Bio-chemic Education system
from Bio-chemic Swasthya West Bengal or Bio-chemic Education Grant commission they can appear in all
types of competitive exam, (Govt. or Non-Govt.) all over India or foreign country.

c) Those who are passed any courses from Bio-chemic Councils/Universities/Medical Colleges/Research
Institutions(affiliated from ‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant Commission’)
can participate in Govt. or non-Govt. competitive exam. all over India or foreign country.

25. Entitle of Bio-chemic Concerns.:
All types of Bio-chemic Education Concern in India those who are permitted by Bio-chemic Education Grant
Commission in the year 2010, Dated 31
st
May. They will be entitle called in this Act.

26. Entitle of Doctors:
i) Those Bio-chemic Diploma & Course holders passed before the date 31-01-2010, if they are interested to take
permission by ‘Bio-chemic Education Grant Commission’ and ‘Bio-chemic Swasthya West Bengal’ –it will
also be legal in this Act.
ii)Those Students are to take – N.O.C.(No objection Certificate) in the dated 31-01-2010 from Bio-chemic
Education Grant Commission, they will be legal, is called in this act.

27.Entitle of others(Nurse/Technical course holder/other therapeutical):
Same section 26(i), 26(ii), 42(A),

28.Power of department in-charge/any authority:
i)any authority/in-charge can attest.
ii)to maintain & control his department/institute/university/medical college/others.
iii)In-charge/authority can certify character certificate, work experiment certificate for students and staffs.
iv) control account branch.
v) any authority/in-charge have gazetted power.

29.Avoid political system:
a)All types of Bio-chemic system/departments always avoid political system,
b)Students should always avoid political system.
30. dissolution by resolution:
i)A department/Institute/Medical college/University/others may be dissolved by the consult of three-fourths of
the staffs it passes a resolution for such dissolution at a general consult convened for such dissolution at a
general consult convened for the purpose.
ii)Where a resolution for dissolution of a department is passed under sub-section (1), the Governing body
shall take such steps for the disposal and settlement of the property of department and its claims a liabilities as it
may think fit subject to the regulation of the department, if any.
iii)After all necessary steps have been taken under sub-section (2), Governing body shall send a report to the
authority/Registrar mentioning if there are any surplus assets.
iv)The registrar/authority shall thereupon issue a notice in the official Gazette to the effect if no objection is
received from any client or creditor or any staff of the department/any concern within three Months from date of
the notice, the department/concern shall, subject to the provision of section(33) be dissolved.
v) If no objection is received within three months as aforesaid, and after the surplus assets, if any, have been
disposed of as provided in section(33) the registrar/authority shall make an order confirming the dissolution of
the department/ concern and thereupon the department/concern shall stand dissolved. The registrar/authority
shall record the order of dissolution in the register maintained in this office.
vi)If any objection is received from any claimant or creditor within the period of three months as aforesaid the
department/concern unless he is satisfied that the relevant claim or liability has been duly settled and the surplus
assets if any, have been disposed of as provided in section(33).
If however any objection is received from any staff the registrar /authority shall not make an order confirming
the dissolution to the department/ concern but shall make an application to the court under section 31.

31. Dissolution by court:
i)The court may on the application of the registrar/authority or on the application of not less than one fifth of the
staffs make an order for the dissolution of a department/concern in the following cases:
a)If there is any contravention by the concern of the provision of this Act.
b) If the number of staff is less than five.
c) If the concern has ceased to function for more than three years.
d)If the concern is unable to pay its debts or meet its liabilities.
e) If it is proper that the concern should be dissolved.
ii) When an order for the dissolution of concern/department is made by the court, dissolution shall take place is
such manner as the court may direct.

32.Dissolution by Registrar/Higher Authority:
i)Where in the opinion of the Registrar/Authority there are reasonable grounds to believe that a
concern/department is not managing its affairs properly or is not functioning he shall send to the concern at its
registered office a notice by registered post calling upon it to show cause within such time as may specified in
the notice why the concern shall not be dissolved.
ii)If no cause is shown or if the cause shown be considered by the Registrar/Authority to be unsatisfactory
the Registrar/Authority may move the court under section (31) for making an order for dissolution of concern.
33. Staff to receive no profit upon dissolution:
If after the disposal and settlement of the property of a concern and its claims liabilities, there are any
surplus assets, such assets shall not be paid to or distributed among the Staffs of the department/concern or any
of them but shall be given to some other concern to be determined-
a)In the case of dissolution under section 30, by the consult of three-fourths of the staffs, or in default
thereof, by the registrar/authority, with the approval of Bio-chemic Education Grant Commission or Bio-chemic
Swasthya West Bengal or Central Govt.
b)In case of dissolution under section 31, by the court.
34. Disqualification for being staff of Governing Body etc. of a concern/department:
A person shall be disqualified for being chosen as and for being a staff of Governing Body or In-
charge/Authority or any other office bearer of a concern, if he is an undischarged insolvent, or b) he has been
convicted of any offence in connection with the formation, promotion, management or conduct of the affairs of
concern or a body corporate or of any offence involving moral turpitude. Provided that the disqualification

under clause (b)shall cease at the end of five years after the date of conviction or where department and any
person may obtain a copy or extract of any document or any part of any document, certified by the
Registrar/Authority on payment of such fee as evidence of the matter therein confined in all legal proceeding.
36. Terms of Gif to be observed:
i) Where a concern/department accepts gift of any kind from any person for a specific purpose it shall not
use the gift or any part or if the donor be dead, without the written consent of the Registrar. The Registrar shall
not give such consent unless he is satisfied that the purpose for which the gift was made is incapable of
execution by the concern/department.
ii) For any contravention of the provision of sub-section (1) every officer in default shall be punishable
with fine which may extend to five hundred rupees.
37. Communication with a concern:
All communication with a concern shall be addressed to the concern by name and sent to its registered
office.
38. Indemnity:
No suit, prosecution or proceeding shall lie in any civil a criminal court against the director or registrar or
against commissioner for enquiry appointed Section-44 and no suit or proceeding shall lie in any civil court
against the ‘Bio-chemic Swasthya West Bengal’ or ‘Bio-chemic Education Grant commission’ for anything in
good faith done or intended to be done under this Act or the rules.
39. Limitation:
i) an appeal under this Act may be filled within thirty days of the date of the objection or order appealed
against.
ii) The provision of section (5) and 12 of the Indian Limitation Act 1908, shall apply to any appeal under
this Act.
40. Power to make rules:
i) The Director/C.E.O.(Chief Executive Officer)/M.D.(Managing Director) of Bio-chemic Education Grant
Commission Govt. of India may make rules for carrying out the purposes of this Act.
ii) In particular and without prejudice to the generality of the foregoing powers, such rules may provide all
or any of the following matters namely-
a) The procedure for any appeal under this Act to the Bio-chemic Education Grant Commission Govt. of
India and the fee for such appeal if any.
b) The fee, if any, to be paid for filling any document, other than memorandum and the regulations under
sub-section (1) of section-3,.
c) The maintenance of register of concern/department and other books, fee to be paid for obtaining any
copy or extract of any document certified by the Registrars/Higher Authority.
d) All fees paid under this Act shall be to the consolidated fund of the Bio-chemic Education Grant
Commission Govt. of India.
41. Provided need:
a) the memorandum of staff group and regulation of any such concern shall if they are repugnant
to any of provisions of this act and rules, be brought in conformity there with within six months from
the commencement of this Act or within such further period as the Registrar/Higher authority may
allow and thereafter shall to the extent of such repugnancy be deemed to be void and of no effect.
b) any officer appointed to an office before the commencement of this Act and holding such office
immediately before such commencement shall continue to hold such office until the expiry of his term
of office or unit such office is lawfully terminated.

c) nothing in this section shall affect:
i) any right, privilege, obligation or liability acquired accrued or incurred under
this Act.
ii)any punishment incurred in respect of any offence committed said this Act.
iii) any investigation, legal proceeding or remedy in respect of any right, privilege, obligation, liability,
penalty or punishment as aforesaid.
iv) any proceeding in dissolution commenced before the coming into of this Act and any such investigation,
legal proceeding or remedy may be instituted, continued or enforced and any such penalty or punishment may
be imposed and any such proceeding in dissolution may be continue.

42. A: Problem & solved of Indian Bio-chemic system:

i) All over Indian Bio-chemic Doctors/Technical Course holder and Bio-chemic concern should be taken
permission/registration from BEGC/TCMB/TSBMC, otherwise this type of Doctors and concern will not be
entitled called in this section Act, not only that their (Doctors/Technical Holders/Concern) activities will not be
established.[See Rule-14,15]
ii)Those Doctors and clinics are taken Registration in year 2008-2009 from Bio-chemic Swasthya West
Bengal they will be or have been attached see section 20(1).
iii) Those Bio-chemic Doctors or Technical Course holders practice after 31

May 2010 in their field they
will be treated/worked as illegal and as punishment they will be kept minimum 3years in Jail or pay as penalty
Rs. 10,000/-
iv) Bio-chemic Doctors and Bio-chemic Technical Course holders if facing any problem regarding the time
of their treatment/work any administration section will be liable to report-by written.
Bio-chemic Education Grant Commission after that they will take any action as per their rules.

B. Bio-chemic Education System:
According the Bio-chemic model prospectus the course will be open as per direction of Bio-chemic
Education Grant Commission Author/Authority, also any changes or include as per direction/decision.

If the Bio-chemic Education Grant Commission open the Bio-chemic Entrance Exam. then it will be four
years course and course fee likely Rs.6,00,000/-(Six Lacs) or Rs. ............(any). The student of this course will
get service to Bio-chemic Education Grant Commission after passing. If the project completely fulfil. For the
group minimum 80 students will be needed.
43.Power for registrar(Bio-chemic Education Grant Commission) to call for information or explanation
to call for information or explanation:
i) The Registrar may, by written order, call on a concern to furnish in writing such information or
explanation within such time, not being less than two weeks from the date of receipt of the order by the concern,
as he may, specify in the order in connection with the affairs of the concern or any document filled by the
concern under this Act.
ii) On receipt by the concern of an order under sub-section(1) it shall be the duty of officer concerned to
furnish such information or officer in default shall be punishable with fine which may extend to fifty rupees for
every day during which the failure continues.
44. investigation of affairs of a concern:
i) Where an information received, the Bio-chemic Education Grant Commission Govt. of India is opinion
that there are circumstances suggesting that the business of a concern is being conducted with intent to defraud
its creditors, staffs or that the concern is guilty of mismanaging its affair or of any fraudulent or unlawful Act,
the C.E.O. Bio-chemic Education Grant Commission Govt. of India may appoint a competent person as-
ii) Commissioner for enquiry to investigate into the affairs of the concern or inspect any institution
managed by the concern and report on such matter to the C.E.O. Bio-chemic Education Grant Commission
Govt. of India/ Bio-chemic Commissionarate Govt. of India may direct.
iii) It shall be the duty of every officer of the concern when so required by the commissioner for enquiry to
produce any books and papers of or relating to the concern which are in his custody, and otherwise to give to
the commissioner for enquiry all assistance in connection with a investigation or inspection which he is
reasonably able to give.

iv) A commissioner for enquiry may call upon and examine on oath any officer of the concern in relation to
the affairs of the concern and it shall be the duty of every officer when so called upon to appear before the
commissioner for enquiry for such examination.
v) On the conclusion of the investigation or inspection as the case may be commissioner for enquiry shall
make a report to the Bio-chemic Education Grant Commission Govt. of India on the matters on which he was
directed by the Bio-chemic Education Grant Commission Govt. of India to report.
vi) For refusal to comply with the provision of sub-section(2) or sub-section(3) the officer in default shall
be punishable with fine


which may extend to five hundred rupees.
vii) On perusal of the report made by the commissioner for enquiry, the ‘Bio-chemic Education Grant
Commission’ may give such direction as it may think fit to the concern for the removal of any defects or
irregularities within such time as may be specified and on the concern making any default in taking action
according to such direction the Bio-chemic Education Grant Commission may direct the registrar to move the
court for dissolution of the concern.
viii) If on a perusal of the report made by the commissioner for enquiry it appears to the ‘Bio-chemic
Education Grant Commission’ Central Govt. that any person has in relation to the formation, promotion,
management or conduct of the business for the concern, been guilty of any offence for which he is criminally
liable the ‘Bio-chemic Education Grant Commission’ may direct the prosecution of such person for the offence.
ix) the expenses of and incidental to an investigation by a commissioner for enquiry appointed by the ‘Bio-
chemic Education Grant Commission’ shall be defrayed by the ‘Bio-chemic Education Grant Commission’
Government of India.

45.Bio-chemic Court:
The Bio-chemic Education Grant Commission Govt. of India can be establish & administer courts for
necessary. That court will solve the different kinds of problem of Bio-chemic Doctors of Bio-chemic Technical
course trainer activities to. Except this any problem of Bio-chemic the court will solve it.

46. Leaves & other facilities. :
Leave or other works of concern will be decided by the C.E.O. of Bio-chemic Education Grant
Commission’ Govt. of India.

Chapter – III

INDIAN BIO-CHEMIC RULES-2009
1.Short Title:
These rules may be called the Indian Medical Doctors, Institutions, Chemicals and medical related course
holder and others registration rules-2009 (Indian Bio-
chemic Rules-2009).
2.Definitions:
In these rules, unless there is anything repugnant in the subject or context –
a) “the Act” means Indian Bio-chemic Act – 2009.
b) “form” means a form appended to these rules.
c) “section” means a section on the Act.

3.Examination of the documents received by the C.E.O. / Controller General / Registrar / any higher
authority:
On receipt of every document required by the Act to be filled in office, the C.E.O. / Controller General /
Registrar / any higher authority of ‘Bio-chemic Education Grant Commission Govt. of India’ shall examine the
same and if it is found defective or incomplete in any of the particulars required to be given therein, he shall
return the document of the person who filled the same. Unless proper rectification is made and the document
resubmitted within fifteen days from the date of its return by the C.E.O. / Controller General / Registrar / Higher
authority of ‘Bio-chemic Education Grant Commission Govt. of India’ the document shall not be deemed to
have been filled at all.

4.Register of concerns / doctors:
There shall be maintained in the office of the registrar ‘Bio-chemic Education Grant Commission Govt. of
India’ a register of doctors / concerns in form I/A or I/B in which doctors / concerns / other shall be given serial
numbers in the order of their registration. All entries in the register shall be attested by the Registrar of ‘Bio-
chemic Education Grant Commission Govt. of India.
5.Index to the register of concern:
There shall be maintained in the office of the Registrar of ‘Bio-chemic Education Grant Commission Govt.
of India’ an index to the register of the concern in form II in which the names of concerns shall be arranged
alphabetically as soon as entries are made in the register of concerns.

6.Filling of documents:
A separate file shall be maintained in respect of each concern in which all documents relating thereto
received from time to time by the Registrar of ‘Bio-chemic Education Grant Commission Govt. of India’ shall
be kept. No document shall received by the Registrar of ‘Bio-chemic Education Grant Commission Govt. of
India unless the fee prescribed therefore has been paid.

7.Acknowledgement of registration and documents-
i) upon registration of a concern/doctor, the registrar of ‘Bio-chemic Education Grant Commission Govt. of
India’ shall grant a certificate of registration.
ii) on every document, filled under the Act, the registrar of ‘Bio-chemic Education Grant Commission
Govt. of India’ shall endorse by means of skeleton rubber stamp the following particulars:-
a) Registration number.
b) Serial number of documents.
c) Date filling.
d)
The registrar of ‘Bio-chemic Education Grant Commission Govt. of India’ shall affix his signature and
the seal of his office to such document and shall grant to the person at whose instance a document is filled an
acknowledgement therefore.

8.Inspection of documents etc. –
Any person who wishes to inspect a document or obtain a certified copy of the same or an extract there
from shall apply to the registrar of ‘Bio-chemic Education Grant Commission Govt. of India’ in form III. The
application shall be accompanied by the fee mentioned in section 35 or in the schedule to those rules as ‘Bio-
chemic Education Grant Commission Govt. of India ‘/of a person authorised by him in this behalf. The
applicant shall not be allowed to make a verbatim copy of the documents inspected. He may, however, take
short notes in respect of the contents of the document inspected.

9.Alteration of Memorandum and Registrations:
Whenever a concern alters the memorandum of regulations a separate statement showing the previous
provisions and the altered one shall be filled with the Registrar of ‘Bio-chemic Education Grant Commission
Govt. of India’ in form IV along with a copy of every alteration of the memorandum or the regulation as
required under sub-section (a) of section 9.
10.Gift for specific purpose:
Whenever a concern applies to the Registrar of ‘Bio-chemic Education Grant Commission Govt. of India’
for his written consent as required under section (1) of section 36 for using a gift for any purpose other than the
specific purpose for which the gift was made the Registrar of ‘Bio-chemic Education Grant Commission Govt.
of India’ in order to satisfy himself that the purpose for which the gift was made is incapable of execution by
the concern may call on the concern to furnish any information explanation or particulars in connection with the
gift.

11.Appeal:
A. A memorandum of appeal shall
i) be filled in duplicate
ii) contain the grounds of the appeal
iii) be accompanied by a certified copy of the order appealed against and
iv) be accompanied by the challan showing payment of the prescribed fee.

B. An appeal may be summarily rejected if the same not in accordance with the provisions of the Act &
Rules.

12. Permission for alteration of Memorandum:
An application for permission for alteration of the memorandum
of a concern as contemplated in section 8 shall be filled in form V.
13.Filling of annual and other returns & fee:
a) The annual and other returns mentioned in section 17 shall be forwarded in form VI.
b) Fees – the fees payable under the India Bio-chemic Act 2009 shall be as provided in the schedule to
these rules. All fees shall paid in draft or cash.

Staff Ship
1. Admission/Recruitment
A. i) The signatories to the Memorandum of concern & the office bears of Governing Body/Staff Committee
of the concern shall be 1

ii) The Governing Body/Staff Committee may recruit to officers before take permission from Higher
authority of Bio-chemic Education Grant Commission .Candidate will be qualified person of any cast,
creed or sex who has attained the age of 18 years & agreed in writing to be bound by the memorandum
of concern and whose opinion of the Governing body will be interested in advancement of the objects of
the concern.
B. Power to recruit staff:
Be it noted here that power to recruit staffs is the sole and absolute power of the governing body and the
governing body and the governing body may refuse to recruit any person as a staff or officer assigning any
reason therefore, before governing body inform – Bio-chemic Swasthya West Bengal or Bio-chemic
Education Grant Commission’s Director / Any Higher Authority.

3. Register of staff –
The concern shall maintain a register of staffs containing the names, address and their Rank, the date of
recruitment of staff ship.

Governing Body
1. Appointment of Governing Body –
There shall be a Governing Body consisting of not less than five staffs. This body will be appointed
by ‘Bio-Chemic Education Grant Commission Govt. of India’. The office bearers of governing body
shall comprise of In-charge / Principal / Professor / Medical Officer / Superintendent / Inspector /
Sub Inspector etc. The office bearers & other staffs shall be appointing by ‘Bio-chemic Education
Grant Commission Govt. of India.\

2. Power and duties of the Governing Body / authority / officer / any In-charge
The Governing Body shall have general power of supervision and conduct over all the affairs of the
concern and in particular shall discharge the following duties.
a) To appoint authority / officer / in-charge with such power and duties as may be considered necessary
or experiment.
b) To accept donation, gift, subscription, movable or immovable property for the object of the concern.
c) To sell, lease, deal for development works management of the concern.
d) To keep proper accounts of the concern and open bank account in the name of the concern.
e) To maintenance of account etc.
f) To maintain & control / Student admission.
g) To follow & maintain law & order of Bio-chemic Education Grant Commission Govt. of India.

Safe custody of properties –
The governing body shall be responsible for the safe custody of mutual funds and be
invested in any securities specified under sec – 20 of the Indian trust Act – 1882.
Book of Account & Inspection –
The books of account and other statutory books shall be kept at the registered office and shall be open to
inspection of the staffs at such time and place as the governing body directs on a written request made by officer
(Inspector / Administration officer).

General Meeting –
The Governing Body may direct to convince general meeting for consideration of addition attention of
memorandum / regulation of the concern, consult for development of the concern & consult money
management etc.
Duties of the office Bearers –
1. In-charge / principal / any officer:- He shall –
a) Preside over all meetings / consult of the concern.
b) Take all disciplinary actions such as removals, dismissal etc, in consultation with the Governing Body.
c) Advice the ‘other senior staff’ in any matter requiring urgent attention.
d) Call emergement consult / meeting.\
Principal – Head of the institution / Medical college. He is over all of concern.
Vice principal – In the absence of principle, the vice principal shall perform all the duties of principal.
2. Chancellor – Head of the University. He is over all of concern. Same duties for In-charge, follow No.-1.

3. Administration Officer – He / She shall –
a) Convence all meeting of the concern.
b) Maintain minute books of all meetings.
c) Issue general circular and notices.
d) Receive all applications for staffship which shall be placed before Governing Body.
e) Sign on behalf of the concern all receipts for all sums received as subscription etc.
f) Sign and give pay order on all bills for payments.
g) Get the accounts of the concern audited.
h) Ensure compliance with statutory requirements.
i) Transact all other business subject to the direction of the Governing Body.

4. Treasurer – He shall
a) Collect and receive all sort of subscriptions, donations and deposit of money and grant receipts thereof.
b) Maintain and keep cash book and such other accounts where ever as necessary.
c) Operate bank account jointly either with the in-charge / Chancellor / Principal / any authority.

Maintenance and Audit of Accounts –
The concern shall maintain books of accounts as required under section 15(1)(a), (b) of the act. The
accounts shall be audited by a duly qualified auditor as stated in section 15(II) of the Act.

Suit & Legal proceedings –
All suits and legal proceeding by or against the concern shall be in the name of the Administration officer
of such person as shall be appointed by the group.

Alteration of Memorandum & Regulations –
The Memorandum and Regulation may be altered, modified, re-scinded or added to by special resolutions
passed by the 3/4

staffs. interest of smooth functioning of the concern.

Dissolution of Concern –
Subject to the provision of section 30 & 33 of Indian Bio-chemic Act-2009 or any statutory modifications
thereof, the concern may be dissolved by a resolution to that effect passed by 3/4

staffs of the concern at the
general meeting. The said meeting shall also decide the manner of disbursement of the funds and asset of the
group, if any after dissolution.

RULE – 14 to 75

14. All the course holders / students of Bio-chemic, under section-26 (i), 26(ii) and 27 have avoided may –
a)They can start a new course by depositing a penalty (see section -42(A) to Bio-chemic Swasthya West Bengal
or Bio-chemic Education Grant Commission. b) The course or the studies may be started under section 42(B) by
the order from Bio-chemic Education Grant Commission.

15. All the health department / Hospital / Health Centre / Education Concern Incharge have avoided section –
25 may start their respective department / concern by paying a minimum penalty of Rs. 2 Lacs to Bio-chemic
Swasthya West Bengal or Bio-chemic Education Grant Commission under section 3 or 20 or 21.

16. The application of the new concern will get permission under section 3 or 20 or 21 and all the concerns
those have avoided the rules and regulation and running the concern will get permission. by accepting rule – 15

17. All types of form those are needed will be developed and printed by B.E.G.C. or B.S.W.B.
18. N.O.C. can be issued by the director / C.E.O./ Act Authority or B.E.G.C. or B.S.W.B. if necessary.
19. All the concern in-charge can approach the higher official and place their demand or complain in written.
20. The higher official can solve the problem of rule – after discussion with the director / C.E.O. / Act Authority
of B.E.G.C. or B.S.W.B.
21. It is to be kept in notice that no extra work or illegal work is done by the concern.
22.All the application will be accepted by legal process by maintaining the rules & regulation.
23. Absence without reason for the consecutive 2days can be discharged by the in-charge.
24. Any loss or disturbance to the concern occurred by any staff student can be discharged / rejected at the very
moment without any reason.
25. Any staff can be suspended if they are absent without reason by the in-charge.
26. The promotion will be held if any staff has bad report for the consecutive three times and can be demotion.
27. The in-charge or the higher authority can discharge any staff for the good or bad of the concern.
28. The monthly pay of any staff will be decided by the director / C.E.O. / Higher Authority.
29. If the monthly pay is not satisfying the staff can leave the job willingly.
30. Any advice or complaint be educational concern or business concern has to be discussed with the director /
C.E.O. / Higher Authority B.E.G.C. or B.S.W.B.
31. Necessary official management can be –
a)Registration, withdrawal, transfer, services, refusal, limitation, advertisement, renewal, removal, cancel
order, hearing etc.
a) Author royalty.
b) Rectification of concern.
c) Permission of Medicines manufacturing, Retail & Wholesale, Stockiest.


32. If necessary any Higher authority / In-charge of B.E.G.C. or **B.S.W.B. can take help from any
administrative Act of India.

33. All the Bio-chemic Educational Concern / Medical Institutional In-charge have neglected the warning
letter for registration issued by Bio-chemic Education Grant Commission or Bio-chemic Swasthya West
Bengal will never be given power or registration or approval from ‘Indian Bio-chemic Act’ and will have
no power to run those Institutions. This rule will come into effect after 30 days.

34. If any Concern In-charge or any person those who are not registered under Bio-chemic Act. Will not be
able to use the word ‘Bio-chemic’. If they use the word ‘Bio-chemic’ they will be punishable with 12
years’ imprisonment and penalty of Rs. 2Lac.

35. Function of TCBMC (The Central Bio-chemic Medical Council) services to establish and counselling
Bio-chemic Doctors, Pharmacists, Nurses, First-Aider, Medical related practitioners & Technicians and
Bio-pathy, Bio-chemic & Co-related Homeo treatment, chemical research &b legal services, providing
foods and drinks, Beauty care.

101. Library Rules :
A. Books of reference, text books and rare collections shall not be lent out to the students.
B. All books taken on loan should invariably deposited before long vacations.
C. Failure to return a book on the due date entails the student to pay a fine for Rs. 10/- per day for delay
including intervening holidays.
D. The making of books with ink or pencil, causing damage to bindings, the underlining on pages the
writing of remarks of illustrations, tearing of pages, pictures etc. are absolutely forbidden.
E. If any book is lost, damaged or mutilated, the borrower shall be required to replace the book with fine or
pay such compensation as may be fixed by the Principal. If any student does no pay such compensation, he /

F. If a book belonging to a set or series, is lost or damaged and a new volume is not separately available,
the borrower shall be required to replace the whole set or series.

103. Normally at the time of admission every student must submit an application for Registration. The College
will not allow students to submit fees and forms for final Examination without Registration Certificate.
Transfer Certificate must be produced at the time of admission.
104. Any student found guilty of misconduct and violation of the College rules. Misuses of College and
Hospital properties, misbehaviours to any teaching or non-teaching staff of the Institution or criminally
convicted or any such behaviour provocative or detrimental to general interest of the Institution or misuse of his
/ her studentship may be liable for expulsion from the Institution.

108. Internal assessment is to be done by the College by the Council of Examination periodically as per

common room or library Reading Room. Loitering in the corridors. Disturbing classes, copying in
examinations, creating nuisance in the campus are treated as misconduct and breach of discipline.

both the structure and vitality of the organs of the body are dependent of its Organic constituents. These remain

material basis of the Organs and tissues of the body and are absolutely essential to their integrity of structure
and functional activity. According to My Bio-chemic theory, any disturbance in the molecular motion of this
cell salt in living tissues cost by a deficiency in the requisite amount, constituent disease, Experiment made by
professor Loeb seem prove that the virus tissues cells will rapidly disintegrate in the absence of the proper
proportion of Sodium, Potassium and Line salt in circulating fluid, the normal ratio being 100 molecules of
Sodium, 2.2 molecules of Potassium and 1.5 molecules of Lime. Any marked departure from this proportion is

The maintenance of a stable metabolism with the cell is due to the presence of these salts in the proper
ration in the fluid, which surrounds the cell. It is thus a protective process. They maintain a sort of physiologic
balance in the liquids surrounding the living cells and any upsetting of these proportional interrelations of the
virus salt may lead to physiologic disturbance and disease. Which can be rectified and the requisite equilibrium
re-established by administering the same mineral salt in small quantities. This is supposed to be brought about
by virtue of the operation of chemical affinity in the domain of histology: and hence this therapeutic procedure
is styled by M.C. The Bio-chemic method and stress is laid on the fact that it is in supposed harmony with well-
known facts and laws in physiological chemistry and allied sciences.
152. THE CONSTITUENCE OF HE HUMAN ORGANISM:-
Blood consist of water, sugar, fat, aluminous substances, chloride of sodium, chloride of Potash, fluoride of
lime, silica, iron, lime, magnesia, soda, Potash etc. The latter are combined with phosphoric, carbonic,
sulphuric acids etc.
The salts of soda predominate in the blood plasma, while those of potash are found especially in the blood
corpuscles. Sugar, fat and the aluminous substances are the so-called organic components of the blood, while
the above-named salts and water constitute its inorganic components. Sugar and fat are compounds of carbon,
hydrogen and oxygen, while the aluminous substances contain in addition sulphur and nitrogen.
Sulphur, carbon and phosphorus are not present within the organism in a free state, but combined with
organic substances. Sulphur and carbon are found in the albumen, carbon in the carbohydrates like sugar, starch
and in the products incident to metamorphosis of organic substances. Phosphorus is contained in the lecithins
and nucleons. The sulphur of the albumen is oxidized by the oxygen of the inspired air, forming sulphuric acid
which combines with the bases of the carbonates, forming sulphates and setting free carbonic acid.

153. TISSUE-BUILDING:-
Blood, containing the material for every tissue and cell of the body, furnishes nutriment for every organ,
enabling it to perform its individual function; thus it supplies every possible physiological want in the animal
economy.

It does this by the transudation of a portion of its plasma into surrounding tissues through the capillary
walls, by which the losses sustained by the cells on account of tissue metamorphosis are made good. According
to modern biological views this pabulum is a material suri generic, called irritable matter or protoplasm, and is
the only living matter, and is universally diffused throughout the organism, of which it constitutes about one-
fifth, 15

the remaining four-fifths being organized and relatively, therefore, dead matter. In its physical
character it is nitrogenous, pulpy, structure less, semi-fluid, translucent, homogeneous, and similar to that of the
gangflionic nerves and to the gray, nervous matte. In this transuded fluid appear find granules, which unite to
form germs, from which again, cells develop. By union of these cells are formed the tissues of very kind
needed for the up building of the whole organism. Two kinds of substances are needed in this prose’s of tissue-
building, and both are found in the blood-namely, the organic and the in organic constituents. Among the
former organic constituents are the sugar, fact and albuminous substances of the blood, serving as the physical
basis of the tissues, while the water and salt-namely, potash, lime, silica, iron, magnesium and sodium-are teh
inorganic substances, which are believed to time be found, but the forgoing, however, embrace all which are
constantly present. Wherever, then, in the animal organism, new cells are to be generated and formed, and there
must be present, in sufficient quantity and proper relation both these organic and inorganic substances. By their
presence in the blood, all the organs, viscera and tissues in the body are formed, fixed and made permanent in
their function and a disturbance here causes disturbed function.
154. INORGANIC CONSTITUENTS OF CELLS:-
The principal inorganic materials of nerve-cells are magnesia phos., natrum phos. And ferrum phos. Muscle-
cells contain the same, with addition of kali mur. Connective tissue-cells have for their specific substance
silica, while that of the elastic tissue-cells is probably Calcarea flour. In bone-cells we have Calcarea flour and
magnesia phos. And a large proportion of Calcarea phos. This latter is found in small quantities in the cells of
muscle, nerve, brain and connective tissue. Cartilage and mucous cells have for their specific inorganic
material Natrum mur., which is found all so in all solid and fluid parts of the body. Hair and the crystalline lens
contain, among other inorganic substances, all so ferrum. The carbonates, as such, are according to
moleschotte, without any influence in the process of cell-formation.

155.FORMATION OF TISSUE CELLS:-

The oxygen of the air, upon reaching the tissues through the blood by means of the respiration, acts upon the
organic substances which are to enter in the formation of new cells. The products of this transformation are
organic materials which are to enter in the formation of new cells. The products of this transformation are
organic materials which form the physical basis of musicale nerve, connective tissue and mucous substance.
None of this substance is present as such in the blood, but are formed within the tissues from the albumen.
With them, the in organic form combinations by virtue of chemical affinities, and thus new cells are formed.
With the formation of new cells there occurs at the same time a destruction of the old ones, resulting from the
action of oxygen on the Organic substances forming the basis of these cells. This oxidation has, as
consequence, a breaking down of the cells themselves.
The ultimate result of this combustion of the organic substances are the formation urea, uric sulphuric,
phosphoric, lactic and carbonic acids, and also water some intermediate members of the series, as, for instance,
hypoxanthine, acetic acid and butyric acid, etc. need not be mentioned with this therapeutic method, because, so
far as our present knowledge of them extends, they play as very subordinate role. Urea, uric acid and sulphuric
acid are the result of the oxidation of the albuminous substances, while phosphoric acid is produced by the
oxidation of lecithin contained in the nervous tissue, brain, spinal cord and blood corpuscles. Lactic acid results
from the fermentation of milk-sugar, and finally breaks down into carbonic acid and water.
The final products of the oxidation of the organic substances are urea, carbonic acid and water. These,
together with the salts set free, leave the tissues, and here by give place to less fully oxidized organic bodies,
which in turn finally undergo the same metamorphosis.
The products of this retrograde tissue change are conveyed through the lymphatic, the connective tissue and
the veins, to the gall-bladder, lungs, kidneys, bladder and skins, and thereby removed from the organism with
the excretions, such as the urine, Perspiration, faces, etc.
The importance and dignity of the function of the connective tissue was established after the researches of
Virchow and Von Recklinghausen led to closer study, and demonstrated its fertile activity. That which
formerly seemed only intended as a feeling in or protective covering appears now as the matrix, in which the
minute capillaries carry plasma from the blood to the tissues and return the same to the blood vessels; at the
same time it serves as one of the most important breeding places of young cells, which are capable of
developing out of the embryonic latent form to the most differentiated structure of the body.

156. HEALTH AND DISEASE:-
Health may be considered to be the state characterized by normal cell metamorphosis; thus, when by means of
digestion of food and drink, recompense, is made to the losses it sustains by furnishing nutritive material to the
tissues this compensation is made in requisite quantities and in proper place, and no disturbance of the motion of the
molecules occurs. Under these conditions alone will the building of new cells and the destruction of old ones
proceed normally and the elimination of useless materials be furthered.
Disease is the result of a disturbance of the molecular motion of one of the inorganic tissue salts. The cure
consists in the restoration of the equilibrium of the molecular motion by furnishing a minimal dose of the same
inorganic substance, since the molecules of the material thus used remedially fill the gap in the chain of molecules
of the affected cell or tissue salt.
Virchow says that disease is an alert state of the cell, and hence the normal state of the cell constitutes
health. The constitution of the cell is determined by the composition of its nutritive environment exactly as a plant
thrives according to the quality soil around its roots.
In agricultural chemistry we add as fertilizer that element most lacking in the soil. But three essential
substances used as fertilizer are required, namely, ammonia, phosphate of lime or potash. The others substances
need full or plant nutrition are found in sufficient quantities in the soul. The same law supplying a lack applies to
bio-chemical remedies; for instance take the following example.
A child suffering with rickets shoe a lack of phosphate of lime in the bones due to a disturbed molecular motion of
the molecules of this salt. The quantity of phosphate of lime intended for the bones, but falling to reach its goal,
would accumulate within the blood were it not excreted by the urine, for it is the office of the kidneys to maintain

constituent. Now after the normal molecular motion the phosphate of lime molecules is again established within the
involved nutritive soil by administering small doses of the same salt the surplus can again enter the general
circulation and the cure of the rachitic be brought about.
Every normal cell has the faculty of absorbing or rejecting certain substances. This property is diminished
or suspended when the cell has suffered a loss in one of its salt in consequence of any irritation. As soon as this
deficiency is made good by a supply of a homogeneous material from the immediate nutritive soul, the

equilibrium is re-established. But if the supply is not offered spontaneously, it is assumed that the needful salt
is lacking in quantity or, on the other hand, that the diseased cells have suffered a physical alteration besides,
which precludes the entrance of the required tissue salt. I such a case the salt must be offered in amore diluted
state, that is a higher trituration or attenuation.
If the altered cells regain the integrity by recovering there loss, they can again perform their normal
function and bring about the removal by chemical processes of morbid products, exudations, etc. the bio-
chemical therapeutics aids nature in her efforts to cure by supplying the natural remedies lacking in certain
parts, that is the inorganic cell salts and in this way corrects abnormal states of physiological chemistry.
The aim of bio-chemistry is to cover deficiency directly. All other methods of cure reach this goal
indirectly, when they make use of remedial agents heterogeneous to the constituents of the human organism.
