INDUSTRIAL DISPUTE ACT, 1947
TheIndustrialDisputesActhascomeintoforceintheyear,
1947.TheActwasenactedtomakeprovisionsforthe
preventionandsettlementofindustrialdisputesandfor
providingcertainsafeguardstotheworkers.Theactaims
tominimizetheconflictsbetweenlabourand
managementbyensuringpossibleeconomicandsocial
justice.Theregulationsmadeunderthisactappliestothe
entireconstitutionofIndia.

Tosupportmeasuresforsecuringandpreservinggood
relationsbetweenemployersandemployees.
Toprovidesuitablemachineryfortheequitableand
peacefulsettlementofindustrialdisputes.
Topreventillegalstrikesandlockouts.
Toaffordrelieftoworkersagainstlayoffs,
retrenchment,wrongfuldismissalandvictimisation.
Topromotecollectivebargaining.
Toimprovetheconditionsofworkers.
Toavoidunfairlabourpractices.

wastosupervisetheworkovermachines.
Duringaninspectionon28

march1985,between2:30
am–4:30am,hewasfoundsleeping,alongwiththe
workerhewastosupervise.
Hewassuspendedimmediately.Achargesheetwas
issuedandaninquirywasmaderesultinginhis
termination.

LABOUR COURT, VADODRA
Petitionersaidhecouldnotbeterminatedashewas
workingasasupervisorbutwasaworkmanandthus
cannotbeterminated.
Therespondentssubmittedthatterminationwasjust
andproperforthe“misconduct”,ofsleepingonduty,
committedbytheappellant..

GUJRAT HIGH COURT
Petitionerputsforwardthepointthathedrawsasalary
oflessthanRs.1600/-andassuchisaworkmanasper
section2(s)ofIndustrialDisputesAct,1947.
Respondentssitethatthedefinitionstatesthata
personprimarilyinamanagerialpositionisnottobea
workman.

GRAVITY OF MISCONDUCT
Labourcourtapprovedofthefactthatterminationwas
justfortheactofmisconductcommittedbythe
appellant.
Theappellantsitedthejudgmentmadebythehon’ble
SupremeCourtinthematterofColour-ChemLtd.vs
A.L.Alaspurkar,whichisidenticaltothepresentcase,in
lightofwhichthepetitionercannotberemovedfrom
serviceforasinglelapse.

JUDGEMENT
ThelearnedLabourCourtwasnotjustifiedinholdingthatthe
petitionerwasnotaworkman,but,wasasupervisor.
Inthecasereferredtothehon’bleSupremeCourtfoundthat
wherethemisconductisnotofagravenature,reinstatement
andcontinuityofserviceshouldbeawardedasarule,but,
thepaymentofback-wageswouldbeinthediscretionofthe
Court.
Thepetitionerbereinstatedandbeawardedcontinuityof
serviceandbepaid30%backwages.

TheFactoriesAct,1948(theFactoriesAct)laysdown
provisionsforthehealth,safety,welfareandservice
conditionsofworkmenworkinginfactories.Itcontains
provisionsforworkinghoursofadults,employmentof
youngpersons,leaves,overtime,etc.Itappliestoall
factoriesemployingmorethan10peopleandworking
withtheaidofpower,oremploying20peopleand
workingwithouttheaidofpower.

Itcoversallworkersemployedinthefactorypremisesor
precinctsdirectlyorthroughanagencyincludinga
contractor,involvedinanymanufacture.Someprovisions
oftheActmayvaryaccordingtothenatureofworkofthe
establishment.
