sittingsatChennai,Mumbai,Delhi,Kolkataand
Ahmedabad.
•Objectiveisspeedydisposalofappealsand
rectificationsofapplicationswhichwerependingin
variousHighCourts.

relatingtopatentsanddesigns.

Tribunal
•Quasi-judicialbody(Tribunal):Anindividualor
organizationwhichhaspowersresemblingthoseof
acourtoflaworjudgeandisabletoremedya
situationorimposelegalpenaltiesonapersonor
organization.
•Forexample,IPAB(IntellectualPropertyAppellate
Board)orIncomeTaxAppellateTribunalorRailway
claimTribunalsarequasi-judicialbodies.
•U/S77,theControllerisvestedwithcertainpowers
oftheCivilCourt.Controlleristhequasi-judicial
(Tribunal)Authorityandinanyproceedingsbefore

shallapplytotheAppellateBoardin
thedischargeofitsfunctionsunder
thisActastheyapplytoitinthe
dischargeofitsfunctionsunderthe
TradeMarksAct,1999.

Controllershallbeinthediscretion
oftheAppellateBoard,butthe
Controllershallnotbeorderedto
paythecostsofanyoftheparties.

FollowingcasesshallbetransferredtotheAppellate

•AppealsagainstanyorderordecisionoftheController;
and
•Allcasespertainingtorevocationofpatentotherthan
onacounter-claiminasuitforinfringement;and
•RectificationofregisterpendingbeforeanyHighCourt.

TheAppellateBoardmaymake
rulesconsistentwiththisActasto
theconductandprocedurein
respectofallproceedingsbefore
itunderthisAct.

Board to make rules]

Question
Every appeal to IPAB should be made in
prescribed form by paying prescribed fee
within the period of:
a)1 month
b)2 months
c)3 months
d)15 days
