SUMMARY OF LEAVE RULES
–General Principals
•Leave cannot be claimed as matter of Right
•Mayberefusedorrevokedbytheauthority
competenttogrant.
•Anyclaimtoleavetothecreditofanemployeewho
isdismissedorremovedorwhoresignsfrom
Sangathan'sserviceceasesfromthedateofsuch
dismissalorremovaloftheemployee.
•No employee shall be granted leave of any kind for a
continuous period exceeding five years.
•Prefixingandsuffixingholidaystoleaveotherthan
leaveonmedicalcertificatesshallbeallowed
automatically.

SUMMARY OF LEAVE RULES
•Incaseofemployeewhoisrecalledtodutybeforethe
expiryofleave,suchrecallofleaveshallbetreatedas
compulsory.
•Anemployeeonleaveshallnotreturntodutybeforethe
expiryofperiodofleavegrantedtohimunlesshe
permittedtodosobytheauthoritywhichgrantedhim
leave.
•Anemployeewhohastakenleaveonmedical
certificatemaynotjoindutyuntilhehasproduceda
medicalcertificateoffitnessofForm'B'.
•Anemployeeonleaveshouldnottakeupanyserviceor
employmentelsewherewithoutobtainingpriorsanction
oftheappointingauthority
•Vacationcanbecombinedwithanykindofleavebut
thedurationofvacationandearnedleaveshouldnot
exceed 180 days at a
time.

Grant of leave on Medical grounds:
(i)ACGHSbeneficiaryshouldproducemedicalcertificate/
fitnesscertificatefromaCGHSdoctor.
(ii)Non-CGHSbeneficiaryandCGHSbeneficiarieswho
proceedoutsidetheHeadquarteronduty,leave,
etc.,shouldproducethecertificatefromAMA,and in
suchcases,anon-GazettedGovernmentservantmay
producecertificatefromRMPifthereisnoAMAavailable
withinaradiusof8kmsof`hisresidence.
(iii)Whereanon-GazettedGovernmentservantfindsitdifficult
toobtainMC/FCfromCGHS/AMA,theleavesanctioning
authoritymayconsidergrantofleaveonthebasisofthe
certificatefromanRMPaftertakingintoaccountthe
circumstancesofthecase.

Earned Leave
•Whileaffordingcredit,fractionofadayshouldbe
roundedofftothenearestdayi.e.7-1/2daystobe
roundedas8days.
•Earned leave can be accumulated upto 300 days.
•Earned leave be taken up to 180 days at a time.
•Earnedleaveexceeding180daysbutnotexceeding
300daysmaybegrantedtoGroup'A'andGroup'B'
Officerscontinuously,iftheentireleaveoratleastthe
amountofleaveinexcessof180daysisspentoutside
India.
•Earnedleavemaybetakenatatimeupto300days
inthecaseofleavepreparatorytoretirement.

•Theamountofleaveshouldbelimitedtothehalf
payleavethattheemployeeislikelytoearn
subsequently.
•During the entire service
360 days with M C
180 Days with out M C.
Maximumperiodthatmaybegrantedatatimeis
90days
•Fortemporaryemployee,grantedonlyifheis
sufferingfromT.B.,Leprosy,cancerorMental
illnessandtherequestforsuchleaveissupported
byaMedicalcertificate.Further,heshouldhave
putinaminimumofoneyearserviceandthepost
fromwhichheproceedsonleaveshouldbelikely
tolasttillhisreturntoduty.

•LeavenotduewillbedebitedagainsttheHPLthatan
employeemayearnsubsequently.
•Whenanemployeegrantedleavenotdueresigns/retire
voluntarilyfromservice,theleavenotdueshouldbe
cancelled.
•Theresignationorretirementwilltakeeffectfromthe
dateonwhichsuchleavehadcommencedandthe
leavesalaryshouldberecovered.
•Whereanemployeewho,havingavailedhimselfof
leavenotdue,returnstodutybutresignsorretiresfrom
servicebeforehehasearnedsuchleave,heshallbe
liabletorefundtheleavesalarytotheextenttheleave
hasnotbeenearnedsubsequently.
•Leavesalarywillnotberecoverediftheretirementisby
reasonofill-healthincapacitatingtheGovernment
servantforfurtherserviceorintheeventofhisdeathor
ifheisretiredprematurely.

Extraordinary leave
•ExtraordinaryleavemaybegrantedtoaSangathan
employeeinspecialcircumstances:-
–when no other leave is admissible.
–when other leave is admissible, but the employee applies in
writing for the grant of extraordinary leave.
•Extraordinaryleavecannotbegrantedtorun
concurrentlywiththenoticeperiod,incaseofofficials
goingonvoluntaryretirement.
•AnyamountofE.O.L.maybesanctionedtoa
permanentemployeeaslongasthecontinuousspell
ofallkindsofleavedoesnotexceedfiveyears.

Extraordinary leave
All employee–upto 3 months with or without medical certificate
Minimum of one year's continuous service
i)Upto6monthswithmedicalcertificateforcommonailments.
ii)Up to 18 months with medical certificate for cancer, mental illness,
pulmonary tuberculosis or pleurisy of tubercular origin, tuberculosis
of any part of the body and leprosy
• Completedthreeyears'continuousservice-upto24months,wherethe
leaveisrequiredforthepurposeofprosecutingstudiescertifiedtobein
thepublicinterest.
• EmployeesbelongingtoscheduledCastes/ScheduledTribes-
Commissionermaygrantleaveexceedingthreemonthsforattendingthe
pre-examinationtrainingcourseatthecentresnotifiedbythe
Governmentfromtimetotime-Rule32(4)
• Twospellsofextraordinaryleave,intervenedbyanyotherkindofleave,
shouldbetreatedasonecontinuousspellforthepurposeofapplyingthe
maximumlimit.
• EOLmayalsobegrantedtoregularizeperiodsofabsencewithoutleave
retrospectively.
